    Its not a case of inter filing where people are using other peoples priority date. Thats long gone. This is using ones own earlier I-140 priority date. Its not an easy process. It involves redoing everything. It involves time. It involves losing a lot of money. And we too have waited in the line. Some people are fortunate to apply in EB2 and some have to do it in EB3. Then as years go by they become eligible to apply in EB2.(When they are promoted to be manager, they are eligible to apply in EB2 quota) So that does not mean they now should go and stand behind the queue. So be kind. Everyone is in the queue. And I am working for a reputed company and not like what you have described. I was frustrated like you when USCIS did many things like opening up the queue for EB3 and recently EB2. People who applied for Green Cards after me have got it. Many even have become citizens.

    Put efforts to better the whole process..

These people are forcing lawmakers (who know very well that Border Securty will not work). That is why Kennedy had a large unskilled worker visa quota: less motivation for coming in illegally.

    In CIR, border security and amnesty were together. Now border security is before amnesty with the hope that there will be NO amnsety.

    While we are at it let me throw this in....
    Assuming you decide to persue MBA from a good university instead of online. What kind of investment of time and money are you looking at? Is it really worth the investment when you are already in your 30's? Is is worth spending the time and money on a MBA? If you spend the same time/money on a business opportunity wouldn't that be better in the longer run? Is it practical to start a business when you are in the 7th/8th/9th year of H1b with no idea if/when you will get GC? Is it a safer bet to invest in education?

    In my opnion starting your own business is always a good idea, of course with uncertainities with GC process it is another risk added to the enterprise.

    In my opinion, doing an MBA from a good school can open up doors to further growth in a comapny. With jsut technical skills it can get stagnated.
    Age should not be a restraint, but with age comes other responsibilities of familiy etc, those could be more limiting.

    I think doing MBA from a good institute is good idea, India is really humming and has lot of growth opportunities for MBAs.

    Some of the reasons I can think of�

    Employers will be right in the eyes of the law since there will be an agreement signed by both parties, the law does not care if the agreement was signed under duress, under mild threat or when the employee was ignorant.

    Employer is legally bound to pay only what is in the LCA, that amount will be way less than what you get by pay rise, percentage or whatever. So when the employee leaves the employer could keep majority of the share and give only what is mentioned in LCA.

    Good employers treat both their current employees as well as old employees equally and that is how they grow, but bad employers don�t. They do not want the employee to leave when they do not have a GC yet, so they will try all the tricks in the book (perfectly legal but highly unethical and totally unprofessional) to keep him saying that if an RFE shows up, they might not be able to respond in time if they are not with them.

    They do not find projects, but since the employee is on their payroll, he will find a job himself to remain in status. Here too the employer has not broken any law.

    In all of the above instances do you have a case to sue the employer?. No, even if you do have a case do you sue them?. No, cause you need them and then history repeats�.

    I would like to share my experience and it may help some people here.
    My H1 was sponsored by company A when I was working with them on OPT. I paid $3000 for H1 filing and attorney fees and company A gave me the H1 approval notice only after I signed an agreement that I would work for atleast one year with them.
    Afetr 1 month of my H1 approval, I got a better job offer from company B and I got the H1 transferred. I notified my client and company A who threatened to revoke my H1, take me to court etc etc. They also withheld 4 weeks of my pay.
    After joining company B, I filed a complaint against company A with DOL that they withheld my salary and also they demanded H1 fees from me. After 2 weeks of that complaint, my salary was deposited into my account and DOL was looking into my complaint about H1 fees. This case finally got resolved last week after about 18 months, when DOL finally persuaded company A to pay $3000 back to me.
    I would request everyone who is a victim of these blood sucking employers to
    take every possible action against them. There's a very little chance that they would go to court because they are themselves involved in gross irregularities.

    now that this is not a private issue anymore (you have taken the employer to the court and DOL) you can defenitely save some souls if you reveal your employer here. having said, wish everyone had courage like you. good job.

    Why don't we all put an end to finger pointing and concentrate on what we need. If someone is doing wrong or has followed wrong ways, govt may/may not take care of them, it is upto the govt, why do we always blame fellow citizens or immigrants?

    We all know, people immigrate doing manipulation, being illegal, over stay visas, jump fences, modify resumes, etc...... at some stage everyone of us would do some level of manipulation so why finger pointing?

    Making our lives better and fixing retro is the goal why drag in consulting companies.

    I have very high regards for Aman due to his dedicated efforts. 64K he spent is the big big amount as an individual.

    I was thinking about this today.

    All great Ideas and we are never short of Ideas on this website. However, we are always short of commited people who are willing to put in time and make their Ideas become a reality. We sure are 25,000 real members and If each of us commit 10$ every month diligently we have a consistent cash flow of $250,000 every month and committing 10$ every month is not hard at all. All of us in here are highly skilled, we all have decent paying jobs and we are definately not cheap labor because we have US Department of Labor (DOL) certifying our salary before we take up any Job in this great land.


    Would you be willing to the lead on making your Ideas become a reality. We have very few highly committed members in here who can provide support and guidance.

    I know many of you may have already thought about this at some point. I'll lay out my views on the donations...IV can object/correct.

    I'm following the donations thread along with many of you and there is not much to be excited there.2000$ in 2 weeks....for all the Agenda that pappu has posted. I understand that everyone(including me)...will have limited resources at our disposal every month...may it be mortgage/daycare/medical/school or those unexpected repairs...so the bottom line is there is not much room to increase our monthly contributions or...holiday contributions.

    I was thinking...we are 25000 'real' people...and there are more than one visit by each person to this site.

    1. Can IV use any space to advertise...so that IV can get some AD Money?

    2. Is it possible to get some space on popular pro-immigrant or immigrant driven websites...to donate to our cause?

    3. Would it be possible to split the donation denominations further down...like 5 dollars..or even low..so that all immigrants...including people who got the GC's/Citizenship can contribute with out looking deeper into their pockets.

    4. Optional....ebay/paypal donation to the peoples questions/answers...Mind you it is totally optional...if you want to donate 5/10/20/100...or how important the question is and hw satisfied the person is with the information...etc

    5. DOnation boxes at Immigrant owned grocery stores...with out compromising their principles

    Folks, I have layed them out with good intentions...and have also given a thought of what I personally can do for each point above...I'm not expecting the vultures to prey...on the post with mundane comments.

    They moved from 8/1/2002 to 9/22/2002.
    According to the I485 inventory they published, there is what.. 400 cases between these two date, why only move 400 cases per month = 4800 per year when the annual quota for EB3 ROW is what.. around 30,000?
    Never mind the spillover, can ROW just get its normal quota at least?

    Write to Mr. Bush (no kidding). They will send an inquiry to FBI and you will get something from FBI NNCP (name check division). If that does not help, file a lawsuit against USCIS/FBI. Or you can file a lawsuit first and then write a letter to save some time. The lawsuit will get things moving. The do-it-yourself guide is located here:

    I am 50% done with an MBA from a top 18 school. Unless you are planning to start a career in financing or economics, *I seriously* doubt that rankings would make a lot of difference. For people in IT wanting to move to a CTO/CIO position, I cannot see how rankings would make a significant difference. Instead of spending the money and resources to go to a top school, I'd prefer to invest in certifications such as CISSP, management certifications, etc and then take a degree in a less known school would be totally OK. I agree that by going to a reputable school, you may meet people there that can help you get positions in the future. So far I've got an invitation to work for classmate's team, thanks to the connection I've made at the MBA.

    For those of with you without true passion for management and soft skills, you might want to consider a MSIS or MSIM instead. Those degrees usually are less expensive and less time consuming to achieve. I started the MBA planning that I would be a great CIO. After taking many courses at my MBA, I decided that the last thing I want is to be a CIO; CIO's are about people, executive management and I learned that's not where my passion is.



    Can anyone provide some useful insight based on personal experienceas to how valuable is Part Time MBA for oppurtunities in India?

    I am IT professional with lot of experience and currently pursuing Part time MBA from a business school which is ranked in top 25 and not in top 10.

    The way I see it that it will take me around 4 years to complete it and I have to invest atleast $30,000 even if I get employer to pay a part of it.

    In the end if it fetches me a top notch management position it will be well worth it. However I see limited chances of getting into management positions in US just based on MBA degree however I am not sure about India.

    Any thoughts?

    Thanks, you are right. It's like the water bucket analogy. Put your hand inside the bucket, and then take it out, and you won't see much difference in the water level. That's how expendable we are to our employers.

    A lot of people are indespensible based on employer needs and competition and skills. So you just have to find the right employer and concentrate on your skills.

    Companies like MSFT and Google believe in retaining employees at any cost and taking care of employees in best possible ways. But getting into them will be competitive.

    So it all depends on a lot of factors, company finances, employer attitude, bad luck, bad time, business going down, bad managers, problems in departments, co workers issuees, consulting company blues, immigration issues etc.. ................

    The chances that someone goes through this situation is 100% and remember no one is "despensable" or "indespensable", it is all about how resistant you are to changes

    Good to know, thanks. Maybe we were reading different threads :) One thing though, because of the heavy rush of citizenship filing in 2007, combined with the election-year pressure of 2008, petitions were fast-tracked in recent years. There are so many confounding factors, anything is possible.
    I can attest to this as well, I know couple of close friends one in NJ area and one in Bay Area CA both of whom got naturalized in 3-5 months time frame. This occurred in the last 2 months so this is fresh data. In both cases the N400 app was approved within 3 months of filing..And the interview was a month later after the approval. Again i just know these 2 guys so my data spread is limited. On other hand i dont know anybody in my circle waiting for a long time on N400.

    No It was not a joke.

    If you think you earn way more then go ahead and contribute more. I just put dollar amounts in front. Many desis here work at 55-65K per year and that is roughly $30 an hour. The ideas is get off your high horses and earn money through sheer labor to get the job of funds done. I see no problem with that.





    Hey, dude, I hope that this was a joke :D

    Because I doubt that anyone willing to wash my car for a few bucks is highly skilled. Personally, I prefer, give 1 day of salary - that's way over $25, and far more effective (I get paid more than $25 for the time it takes to wash a car).

    Actually I think that the other ideas to be "less than optimal", thus I thought they were a joke.
