I am from India and I have worked in the USA for the last 6 years. I have immigrated to Canada with a Job 6 months back to avoid overystaying. My experience in Canada is very bad. I am a MCAD and Sun Certifitied Developer having more than 8 years experience. I am looking for a job for more than 3 months in Canada and still not able to get a job. There is lots of racism here and people are not polite. I have been regularly applying for .NET jobs and the response is very bad. Maybe because I am from India. Try avoiding Canada as much as you can.

I even has the print out from USCIS.gov in which they have mentioned that they will honor the date on which applications were received in the mail room but he did not budge.

Well we desis can only follow the lead of firingis.. so firingis say that who the f*** asked you to come here in the first place and we understand their logic and tell ourselves who the f*** asked us to be here in the first place .. so we are to blame ourselves for everything and take the crap anyway..
But that is not the point.
The point is that me and my company and you and your organisation have paid a service fee with a reasonable expectation of service. reasonable expectation of service is subject to interpretetion based on common sense and no f**king common sense says that waiting 10 years for GC is reasonable .. unless your common sense has been replaced by self disrepecting logic ....
i am not a lawyer but i think that when you pay a processing fees to apply for a privilege (drivers license, business permit, visa, green card etc) from the appropriate statutory authority (DMV, USCIS, Dept of Commerce etc) - the payment of fees does not make you the customer of the statutory authority - so to the extent that USCIS has not broken a law to discriminate against a particular set of applicants (class) - a class action may indeed have no merit.
However, if it can be proved that there has indeed been gross negligence or that USCIS has not followed its own established procedures, made commitments but not honored those, lied or broken the law of the land - then there may be a case.......
another angle is that if the law itself violates the constitution - there is a separate procedure to appeal against such a law (like may suits going on in state courts on laws related to gay rights) - however USCIS would not be party to such a lawsuit since USCIS does not make laws. one would need not only a good immigration lawyer but also a constitutional expert for a venture like this.

Until this point of time, no one knows how USCIS or state is calculating the figures. So, lets wait and see the lottery results. Thats the only way to get the green card faster :)

Guys, i'm not a member of the IC board or anything, but it's clear to me the benefits of contributing.
Illegals are contributing money, and more importantly their time and particpating in rallies en masse, meeting lawmakers, talking with the press, etc....folks, i'm not saying everyone can do such things here....but the leasst you could do is contribute $100 or $200 to this effort. Writing a check is the simplest thing to do....no one is asking you to stand in the cold air rallying for the cause (altho that would be helpful too...but i know many folks on the west coast, texas, etc probably won't be able to make it).
To put this more directly, if no relief comes out of this immigration reform session for us legal, skilled immigrants, you will have no one else but yourself to blame:(

I revisited this thread today and saw several heartwrenching stories of some of our IV members. One way for IV to help you is through letting your situation be known to others via media. We have a few opportunities and if you are interested please send an email to himanshu at immigrationvoice.org. Do not PM me since my PM box gets filled very often.
It will not only help all of us generate awareness about our plight to american public, lawmakers too will be influenced by the magnitude of problems we face while waiting patiently in line for several years. I feel media is a great tool and we can use it very effectively when we all can get our message across in the world outside of this forum. Once we get IV members ready to volunteer for such interviews and to talk about their plight, IV will try its best to get their voices heard.
It will not only help all of us generate awareness about our plight to american public, lawmakers too will be influenced by the magnitude of problems we face while waiting patiently in line for several years. I came to US on h4 i applied for H1-B Visa.again I would like convert to H4 Visa.
My H4-visa stamped until 09/30/2007
My husband H1-B Visa stamped until 09/30/2007.
My husband applied for his H1-B extension But we didnt receive approval notice.we have recipe copy.

After apology/providing GC, they are going to provide settlement assistance as a welcome gift....
Right!!! and in the future bulletins, the dates will continue to move to the future and all the FOBs will be forced to take the GC at the POEs else they will be denied entry into the US of A.

Look at this. Even when the conversation if totally on "high-killed workers", there is always and has to be always, a line or a sentence about illegal immigrants. The only sensible reason to discuss illegal immigration in same topic as "attract and retain" the "high-skilled workers" is that if there are people who are high-skilled, need to be "attracted and retained" and also happen to be "illegal".

1. Your spouse can't work . Think about their self esteem and self respect they are loosing.
2. You don't know about your future if tomorrow you loose your job , you will be kicked from this country.
Tell me what is hell then ? Don't think its just about counting dollars , think about your life stability and about your family members too. Try to come out of Sambhar-Rice world(thats the way you save money here and call US heaven). Live with pride ,ok . Fight for being treated like H1 ( HIGHLY SKILLED PROFESSIONAL) not slaves.
