    We had around 17 highly charged up and dedicated IV members who definiitely want to do "something".

    There was a diverse crowd this time. We had F1 students, who are now beginning to understand the gravity of this issue. One student is a student in Journalism and is currently doing project in legal immigration.

    One physician came all the way from Connecticut and his wife another physician doing residency came all the way from Long Island and our dedicated leader mpadapa came all the way from Poughkeepsie.

    Me and another family came from Queens. Some were from Manhattan.

    Almost everyone else resided in New Jersey.

    'laborchic' was the man behind this meet and greet and his enthu never went down, he always stood up and adressed the gathering. He stressed on the importance of Unity, which the community lacks.

    mapdapa discussed about local law maker meetings. He has been managing and scheduling local lawmaker meetings. Almost everyone instantly offered to meet their lawmakers - but definitely with training and some direction and efficient management.

    Me, mpadapa, singhsa3, siravi and laborchic were explaining to folks the importance of IV, our goals, plans etc...

    One of them was a "Birthday Boy". He accompanied his sister and brother in law whose IV handle "sweet23guyin"

    We had ndbhatt, healing_wong, dressking, supermann, frankiesaysrelax, devillion696 who also actively participated.

    In addition, logiclife's email newsletter got us a few more people and I do not have their IV handles, they are Badri, Tejesh, Alpesh, Sailesh.

    One guy (Alpesh) was a part of San Jose rally and was an active member in the CA chapter and recently moved to NYC.

    Maya is a beautiful place for a evening drink and a snack and discuss things - only drawback was that they played music that was loud, and we had to ask them to reduce the volume. The snacks were very good.

    Based on the feedback over past few days and also based on some feedback about local meetings in general
    Everyone wants to have a Saturday afternoon meeting in New Jersey.
    The meeting must be in a conference hall or a banquet hall and have parking facilities.
    One or two core members must be present
    Training for law maker meets must drive the entire session with other stuff also being discussed in between.
    Educating people about IVs goals and the hard work IV does in the background is a must in every chapter meeting.

    We all decided that we will be active from now on, if we were not active earlier. We will build a strong State chapter.

    Those who were in the "meet and Greet" yesterday - please post your experience - we all took turns and spoke and shared ideas - do please post your experience and your views.

    To make an impact, we need in the order of 50,000 to 100,000 letters with their personal US address on it. Anything less doesn't hold any water..
    Are you kidding me. Nobody will write personal address on a letter. Even if they write one, it will be a fake address. and forget 50-100 thousand letters. Even IV members are not that many. Have you ever wondered where all the applicants are when we say there are 500 thousand or 1 million backlog?

    Remember, 245i cases were the NOT the same as the mexican illegal aliens that are being spoken of in relation to CIR .. lots of educated, legal H1-Bs lost their jobs (and their legal status) during the dot com burst of 2000 - 2002. Some of them stayed on even after going out of status, and then became eligible to file for GC under 245i.And needless to say, many more of those H1s came from India than mexico.
    Any clarifications why India EB3 is behind mexico?

    1. May be there are more Indians in 245(i) cases than mexicans.
    2. May be lots of Indians have applied 245(i) cases eventhough they are not illegal. I heard that this is possible and you can use this to any future employer.

    Think of it this way. Conservative estimations say that in the recent application rush, USCIS received 300K applications.

    That is 2 year's worth of applications alone, not including those already at USCIS.

    If you compound that with the asinine 7% country limit, and assume that there are MUCH more than 7% of that 300K from Indian nationality - I'd say you are looking at much longer than a 3 year wait on average. I'd guestimate 7 years.

    The only way this will change is to support the DC rally. We are getting major traction and positive news on this and it's potential affects. Please do everything you can to come.

    There are people offering to pay 100% of airfare, there are free buses being set up. There are very few valid reasons not to come!

    Bernanke's predecessor Alan Greenspan has written a book (check it on Amazon) where he makes a case for increased high-skilled immigration. He makes a forceful case that its good for the greater economy (and not just limited to housing sector). And yet, we don't see any action on the Capitol (do we?!).

    If Bernanke gives a media statement about the benefits of increased high-skilled immigration to media, it will create a few articles, a few heated discussions. It will peter out after that ( like Bill Gates testimonies to US Congress). Ultimately its the guys sitting in the Capitol and WH who control what becomes the law. And they aren't going to decide on immigration based on what Bernanke states in a brainstorming session.

    Here's the complex process - Someone has to write a bill, work on getting sponsors and co-sponsors, network with other Congressmen to support the bill. Get it through the bureacracy of the Sub-committee on Immigration in the Senate, get a filibuster proof majority of 60 senators to get it passed. Same has to be done in the House. Get it out of House immigration sub-committee. Get a majority vote in the House. In doing all this they shouldn't create a reason for Pres. Bush to veto it. In case he does veto it (for any reason) it will go back to Congress and 2/3rd majority is required to override the veto.

    If it was so easy to get a bill passed [by getting Mr. Bernanke to support it] lobbying business would've been long dead. Companies wouldn't be spending millions of dollars every year to safeguard their interests.

    Point is - getting Bernanke/media support may create a traction for our issue and get it some coverage. I'm not saying the effort is completely useless. It has it's place. But it will not fix the issue by itself. We still need to meet the lawmakers and convince them, we still need to send those letters, make those phone calls, send those faxes and so on. Getting Bernanke/media support will never be an alternative to IV efforts. They will, at best, complement it.



    Bernanke gets called often to talk about the economy and that gets Media attention (so even if he says everything should be done to increase demand and if he mentions immigration ..that would help) ..that is commonsense 101. it is definitely worth trying.

    ofcourse Ben may not read our letters but hopefully someone in his staff would (Approaching Ben or the realtors has more chance of success than sending mails to VP or to Bush) ...and maybe suggest the same during their brainstorming ..ofcourse all of this is hopes ..and with ifs and buts ..but I dont see lot of other options ..

    While IV is already on the major Restrictionists (NumbersUSA, FAIR, CIS.org etc) Radar, it is now being followed by smaller, single issue restrictionist organizations like the Anti-h1b Zazona. Ever wonder why Mr. Sanchez of Zazona targets only Legal Immigrants - people who've always followed the rules laid down by their US lawmakers- like us, instead of illegals??

    A new organization of called Immigration Voice (IV) has been formed to
    lobby the U.S. government. Most of the members are foreign nationals on
    H-1B visas. They want the U.S. government to issue more green cards so that
    H-1Bs can gain permanent residency. Immigration Voice seems to be a single
    issue advocacy group because they don't mention H-1B, however, they are
    supporting the Specter bill in the Senate that has a massive increase in
    Green Card visas as well as H-1B and a new visa called F-4.

    H-1B is a temporary visa that can last for up to six years, but due to a
    new 7th Year Extension rule visas can be renewed indefinitely until the
    visa holder obtains a green card. As long as the green card application is
    in the cue the H-1B can stay. There are limits to the number of green cards
    issued per year, and that is what IV wants to change. As Dr. Philip Martin
    from UCDavis wrote, "There Is Nothing More Permanent Than Temporary Foreign

    described Swartz as a "pro-immigration lobbying kingpin who has represented

    1980s, back when the Guild was a Soviet front group. The group's

    When I started reading the Washington Post article below the first question
    that came to my mind was the legality of H-1Bs and other foreign nationals
    to actively lobby our government. The DOJ answers that very definitively:

    Kalita does a good job of reporting what Immigration Voice is all about but
    the article is not objective, and therefore should be considered lousy
    journalism. It's a rather long article with quotes from many advocates for
    increasing immigration but not one sentence from somebody that disagrees
    with the IV agenda. This statement about IV's quest for more green cards
    for H-1B visa holders goes totally unchallenged:

    "This is a sympathetic story," said Nick Maduros, a lobbyist
    for Quinn Gillespie. "For this group, their issues are very
    technical and are frankly not that controversial, but they
    have been overshadowed ."

    There have been many attempts at forming organizations but all of them are
    struggling. In all their years of existence they haven't been able to raise

    Why do citizens of the United States lack the passion we are seeing from

    Idea of sending cds, chips, to congress has been discussed last year.

    I am of the opinion that we should send helmets. (kids bike helmets).

    I suggest we initiate a campaign called "PROTECT THE BRAIN". That is protect the talent and knowledge of immigrants,

    I agree that we should send lawmakers something big, bulky, and noticeable.
    Something that sits in their offices, is personalised with different colors and notes giving the same message. I feel that books or cds can just be unattractive and not a big topic of discussion amongst the staff. (Ultimately it has to be something unusual to create curiosity and attract attention and discussion)
    So we send them helmets with our degree certificates/ message from IV pasted on it.
    Helmets will say "protect brains". Save the country from losing legal high tech workers.

    5 for legals and 10 for illegals.
    That's the only fair thing to do, for us suckers as well as for the illegals. And the lawmakers anyway have to create the perception that illegals are being "punished" in some form (In this case, by having a greater number of years)

    The other option is to state, that they can apply but they wont get processed (approved) until all the other applicants in the legal categories are processed first. Given the size of the illegal community, they will start pushing the USCIS through their morchas, etc to process faster and the legals can benefit as a result.

    Hi,

    My EAD renewal was filed in TSC in the middle of June. Now it is more than 2 months I haven't heard anything from them. I wonder do they request for FP during EAD renewal ? When I applied for EAD first time in 2007 there was no request for FP and the EAD was approved without FP. But I have seen several posts where folks mentioned that they have got FP notification after they filed their EAD renewal. I have done one FP beginning of 2008 as part of my AOS filed on July 2, 2007. So, I wonder do I receive another FP notification as part of my EAD renewal or USCIS can use my existing FP (they may have in their system) ?

    08/20/2008: Immigration Reauthorization Bills and Senate Needs a Political Push

    * There are four reauthorization legislative bills in the Congress. (1) Conrad 30 NIW bill , (2) Regional Center Pilot Investment bill (EB-5), (3) Nonministerial Religious Worker R-1 and Special Immigration bill, and (4) E-Verify Electronic Employment Authorization bill. The E-Verify reauthorization bill is very controversial adn currently facing a stong political opposition from political forces. The House passed the first three bills and forwarded to the Senate quite some time back, but as we reported on 08/02/2008, the Senate floor referred the bills to the Senate Judiciary at the last minute before the Senate left the Hill on August 2, 2008. These bills are currently presented to the Senate in two different formats: One is the format of the Senate's consent to each of these House bills separately. The other is Senator Specter's consolidated bill that put together all of these four bills into one bill. Obviously, Senator Specter's strategy must have been to tie the reauthorization bills to the controversial E-Verify Reauthorization bill. We reported that he apparently changed his mind and was pressuring the Senate Majority Leader to introduce E-Verify bill in the Senate first. Accordingly, it is unclear which strategies will work better to get these reauthorization bills passed in the Senate before they return to the election recess in early October.
    * The Senate is scheduled to return to the session on September 5, 2008, Friday, and to pick up the defense appropriation billl debates. The House is not scheduled to return to the session until September 8, 2008, Monday. Procedurally, unless each of the reauthorization bills is consented by the Senate floor without amendment, they will have to go to the conference committee or the House just consent to the Senate's amendment. The problem is the House bills were referred to the Senate Judiciary Committee just before the recess and unless a sufficient political pressure is added to the Judiciary Committee Chairman Lehey, they are destined to go nowhere when it comes to the time frame. On the other hand, Senator's consolidated bill faces its own problem because of the E-Verify reauthorization proposal. Besides, even if the Senate floor quickly takes up this consolidated bill, since it is a Senate bill, it will have to be presented to the House for their consent for the Senate versions. The question is how and when all of these actions will be taken up by the leaders of the Senate. The answer appears to be obvious. The relevant immigrant communities must recharge themselves and act quickly to add pressure on the Senate leaders to take up the bills quickly as soon as they return to the session. Probably it may be too late to attach these bills to the defense appropriation bill which they will pick up on the first day of their return to the Senate.

    Has anybody filed lawsuit against uscis for EAD delays till now ? And what is the process for this, do we need a lawyer ?

    You do not need a lawyer, I can guide you thru the process :) Yes, I know a few cases where plaintiff requested court to force the USCIS to issue EAD. Some people were waiting more than a year! Those cases were usually bundled with I-485 WoM. One case is well-known class action lawsuit Ngwanyia v.Ashcroft, No.02-CV-502 (D.Minn.). Government promised to issue EAD within 100 days for the class.

    However I think you better of waiting 90 days from the receipt date and then requesting EAD on infopass. Lawsuit is not a speedy process, the government has 60 days to respond to your complaint and that's not the end of it.

    I didn't think my answers were making fun or teasing anyone - sorry if you felt that way, I didn't mean them to be interpreted like that.

    The main problem is that no one really knows for sure whether these steps are taken in sequence. There is little to no transparency. There are procedures, but we can not guarantee that they are followed.

    To answer your second part. No, I don't believe there are any standard updates that indicate this, but I could be wrong. I think that there is an update if you clear it, but not if you are stuck in it. Make sense?     To answer nlssubbu with the query about the "pre-approval" - I don't think it is a 1 time thing. Its a fairly standard USCIS practice. I have a link somewhere to the IO AOS processing manual. If I can find it I'll post it here.

    Do I think they have enough resources to process them all? Absolutely not, but I doubt there will be a rush considering PDs won't be current for a while (esp eb3)

    For the past so many years of observing various forums and information, I did not come across the situation of pre-approval process except this time. I am sure that they will be doing various background checks to make the application ready for approval. It is not mentioned any where that how the pre-approval process is different from background checks? Are they the same or different? What processes are done during approval? I do not have any idea and hence I would like to keep the various checks and approval process separate.

    If you say 'pre-approval' is to complete all the checks required the case of approval, then why they issue a notification regarding a 'pre-approval' in visa bulletine?

    I hope someone will provide some information regarding these clarifications.
