Because of ppl like the OP and maybe you, we Indians are getting a really bad rep everywhere. It is true that the law does not impose punishments on backstabbers, womanizers, sexual perverts, etc. Prostitution is legal in a lot of countries. The fact that the law permits some things, does not have any bearing on the moral severity or the lack thereof, of those things. Would you choose a 'prostitute' over a 'shop lifter' for a wife? If these are the only 2 options, I would be content with a shop lifter. Would you choose a 'prostitute' because there are no criminal issues involved and you will get your greencard faster?
Even though not many people have posted in support of my post, my reputation has gone up, and yours probably went down. Please don't respond just because you want a revenge.
I will always stand up for the one weak guy who is bullied by a 100 really nice & powerful ones. This can't be called defending the act of 'shop lifting' !!!

You are not reading it correctly. Lawsuit is not limited to July 2nd filers. That is the reason why attorney's are encouraging to file even now.

Thanks you all for the responses and help. We are searching for employers who can help me out in the situation. Most of them are thinking twice bcoz I am pregnant and have to take maternity leave within a 2- 3 weeks.
Which will be the good option for me in this situation H1 transfer or EAD? I have EAD in hand, but never used. I like to maintain the status of H1-B as long as time permits. My husband is going to get health information next week once he joined in the job.

1) Under HIPAA ACT , pregnancy CANNOT be considered as a pre existing condition by GROUP HEALTH coverage . This means you can also get health insurance by applying while u r pregnant.
2) you have 30 days to enroll the baby after birth

And also from my experience --- You got to keep poking the USCIS authorities for them to wake up and take your application to process.
Let me tell you my story:
My company applied for my extension after 1st 3 yrs of H1 last year in Sept. I expected to get extension before Nov and I had planned to go to India in December. Well the dec came and I did not have extension, but I went to India as I was supposed to hoping that the extension would just arrive. Dec over, Jan over, Feb over, I am sitting Idle at home in India. Then I called USCIS- the officer told that since I left the country while extension applied and my h1 has expired, it means I have abondoned my application.. What the f***. Well, later I started following up with my h1 company.
Finally my office Amin staff personally went into USCIS office, explaining my situation and also showing proof that the client is waiting for me to get back and start work, I got h1 extension approved on Jul 24th.. What a relief.
Ran to Chennai for stamping and flew into Bay Area. Next day Med appointments cause i was to file 485 before Aug 17th.
Oh Gosh! I could barely do that and my application reached the NSC on Aug 17th. Now got the receipt numbers.
So Unless you keep poking them You wont hear updates. Just my 2 points experience in the swarm of people here.

Just because OP steals office supplies ( his bad habit of shoplifting) he is accusing all immigraants. I take offence to that and when someone asks others to make a choice to marry a hooker or a shoplifter wife as a defence to that shoplifter. How crazy is that?

I think you have received some good and some useless advise on this post. It is in your interest to go to an attorney and find out what is the best scenario for you and act accordingly. The offense has been committed and the law has judged you .You have to deal with the consequences whatsoever.

Here is my dilemma--
MY INFO---
Occupation -- Physician
EB2, INDIA, PD APR 2006, EAD renewed till sept 2010, H1 valid till feb 2010 (non-profit company), I-140 approved, I-485 filed July 2007
I have a very good job offer and I really want to get out of my present job. They expexct me to start work next year in about apr 2008-- The new job is not in my present state but I am freaked out about using AC 21 for following reasons:
-New company has no clue about H1 and they cannot file H1 any way because they are "for profit" and my h1 is presently from non profit and the QUOTA is now over. My occupation still remains same -(I am a physician ---no way to change occupation -- still have to do same job !)
-New company can only give me a generic letter for employment (EVL) ---
"To whomsoever ---etc..it may concern..and only briefly describing my title and job description"

1) should I invoke Ac 21 ??-- I am worried that the EVL may not meet USCIS needs as it may not be fully detailed
2) The other option I have is to take a leave of absence from my present company for one year and start working for the new company? IN this case what happens if I get RFE for EVL ? Not that you know , you should have bought it before or you should have done through research before wasting others time.
I have 7 polices with LIC in India, One 700k term life with prudential and 300k whole life for my wife, but whole life in US Prudential is bad experience with one of well known company then done research on this topic. Whole life insurance policy all over the world has surrender charges(including LIC in India). you would not get full benefit if you do not complete 10/20/30 years term on your policy,you would get part of your money and loosing a lot.
