    Why don't you start a similar forum for "going back to India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.

    The Indian economy is booming and the salaries are excellent. You just need to make some adjustments with quality of life (pollution, traffic). Atleast its better than going to Canada, living in limbo while looking for suitable jobs for a long-time, sometimes even doing odd jobs just to make ends meet. I hate our Indian mentality that "every place in the world is better than our own country". Give me a break guys.

    My plan of action is very clear: Go back to India and live there happily. If there are other opportunities in US then come back.

    Here is what people forget in this debate. They point out disadvantages of Canada over US. Fewer jobs, High taxes, extreme cold etc.

    No doubt US is better than Canada for most people. That is why US is our first choice and Canada is backup - not the other way around.

    We arent talking about people who have a choice here. If you had choice between US GC and Canadian PR we would always choose US blind folded.

    But we are people without much choice. Yes we have choice to go back to India, and it may be a good choice for thoise who have come recently and have work exp in India. But some of us have spent 10 plus yrs in the US, have US degrees, never worked in India etc. For us it is extremely difficult to move back to India when we dont have a days work exp there. Ofcourse if you are SC/ST or OBC o reserved category your kids have great future there but not for other "normal" people.

    So what other choice do we have. Well English speaking countries you can migrate to and who are taking people as PR's are:

    1) CANADA
    2) AUSTRALIA
    3) NEW ZEALAND
    4) SINGAPORE
    5) UK.

    UK is very difficult to go to as PR. The points required are extremely high. Unless you have MBA from top 10 school or make over 100 K it is difficult.

    Singapore is a good option also, but cost of living is high and you can only apply for PR after working in Singapore for 3 plus yrs. Also Singapore is not a democracy.

    New Zealand economy is 10 times worse than Canada

    That leaves Australia and Canada. Well Canada is closer to US, but Australia has better weather. Canada is less racist but Australia has cricket :).

    So bottom line is conduct this discussion as if US is not the option. If we could stay here with PR for sure we wouldnt even be having this discussion.

    Thats what my Question is......how i am gonna prove it i paid 3k for my H1. They are deducting 500 (for my H1) everymonth from my paycheck in the name of CASH ADVANCE DEDUCTION.
    I really want to teach them a lesson....so that they stop messing many vulenerable people like me who go to them every year. Could somebody tell me how i am gonna complain DOL in new jersey about this company and does DOL really takes any action.
    Greencard is not i am much looking for......i am planning to go back to india after 2-3 years.

    How come we didn't have any phone campaign? What were our lobbyists doing?

    I'm glued to C-SPAN whenever anything related to immigration is going on in the senate. This time I wasn't aware of it.

    We need to be more alert this time. Maybe a phone campaign or web-fax campaign would have turned the scale! We gotta be more alert.

    Don't worry. This is not the complete defeat yet, since this ammendment ties into the troops withdrawl bill. The president would have definately vetoed the bill.

    The bigger thing is the SKILL ACT, which has yet to be at the floor. If we really want any success, we have to ensure that the immigration act is passed a a standalone act and not an ammendment to any other bill regarding defense.

    Big corporations do a very good job in accommodating minorities and racial diversity. We had number of special classes to understand Indian culture when we started outsourcing. Some companies have diversity councils and they meet regularly to discuss issues or topics of interest.

    I agree with some one's suggestion here that cosmopolitan cities are better than interior places where they don't see many people from other countries.

    Many of my colleagues like Indian food but I will be selective in what I eat at my desk. As much as I like it, I Don't bring spicy Biryani to work.

    Just curious, why are you not porting your PD?. Nowadays Perm takes less than 2 months and with premium, 140 takes a few months.

    I-140 premium processing was stopped last year...It takes upto a year or more to get I-140 approved, that too if its a direct case...If its a interfiling case to capture PD from Eb-3 to Eb-2, then its taking even longer..One of my friends filed I-140 in March 2007 to capture his Eb-3 PD of Apr 2004 to EB-2 and he is still waiting....I-140 processing dates are well beyond his receipt date but still his application is pending....So porting PDs is not that straightforward these days...

    In its Response to the Ombudsman’s 2006 Annual Report recommendation (AR 2006 – 01), USCIS agreed in principle to provide a breakdown of all incomplete cases by the number of months pending and application type.

    Given the constraints of existing legacy case management systems, USCIS would today need to perform a cumbersome, labor intensive, recurring manual audit of all pending files in order to compile the suggested data. Such audits would be cost prohibitive.
    USCIS has opted not to use its limited financial resources to extract data from current systems and prefers to spend it on prospective systems that are years in the planning. For example, USCIS has not made corrections to the CLAIMS 3 system to capture data on applicants’ priority date information, country of nationality, and the preference category under which the application is filed that USCIS must review before the application is accepted for green card processing.
    Failing to correct the system annually results in hundreds, if not thousands, of wasted hours by all levels of USCIS leadership in trying to account for an often asked question by Congress, the Ombudsman, stakeholders, and others: “Exactly how many employment-based green card applications does the agency have pending?” USCIS still cannot answer that question today with certainty.

    It will be like attending for a H4 visa and prepare documents required for H4.

    Did you had the paystubs or the immigration officer did not ask for it?
    No, She don't have pay stubs and office just asked her husbands pay stubs ( for whom she is a dependent) and she didn't mention about her H1 and not attached H1 release in the visa documentation. She just attended for H4 visa with only documents that required for H4.

    What did you mentioned at line # 30 and # 38 of DS-156?
    I don't know but I can check my friend tomorrow.

    How long was your wife out of status? Please respond. I am unable to get the paystubs from the employer. He is not picking up the phone.
    I can check with my friend, but I remember she was out of status for more than 1 year.

    Thanks for all the inputs. I still have not received the letter ( probably because of winter strom - delay with traffic) .

    Now if the Deniel is because of AC21 and 140 revoke , when we reply with MTR, should I sent copy of the AC21 letter we sent before or do we need to sent a fresh one ( employment verification letter ) ? The reason I ask this is when we originaly filed AC21 docs ( in Feb 2008) I was with Company2 . Now I am with company 3 ( just 2 months ). And good part of is company3 is well aware about the "same or similar " letter and is ready to issue the letter .

    As I said before
    "EB3 I and in general all EB applicants need a solution now.
    Until this process becomes so painful for us that we either go back or do a mass movement to get some legislative relief there are no better days for us."
    As current bail out clearly points out that for any change to happen in this country situation has to go extreme.
    So unless....
    when new immigrants stop comming because of GC issues and current immigrant leave enmass
    or
    we do a some big enough show for our needs (not a single rally but something all over the country)
    .....there are no better days for us.


    This is indeed a gloomy and (in my view credible) story. The only thing possibly that can help us within the current laws, is the visa overflow from EB1 and EB2 ROW.

    Lets hope for the best. The Nov. Visa bulletin will be confirmatory.

    A quick analysis of election results and its relevance to us:

    As of 11:45 PM PST, House has gone to Democrats in a landslide; the Senate is on its way depending on outcome in Montana and Virginia. If Democrats win MT and VA (Jon Tester in MT, Jim Webb in VA), the Democrats would control the Senate too.

    What it means for us:

    Change of control in the House:
    This is of biggest consequence. Since Democrats won the House, every chairman of every committee in the house will be a Democrat. They will decide what goes into each committee, what comes out of the committee, what gets floored on the house floor and when. They set the agenda, they set the timetable. They run everything...including what gets served in the House Cafeteria and who occupies which office and who gets how much budget to run their offices. Republicans in the last few years have followed the mantra of “Majority of the majority” when it came to setting the agenda and timetable of house floor votes. What this did was, bills that would win the majority of 435 votes by combining Democrats plus moderate Republicans never got floored onto the house, since the majority of majority (conservative republicans) were against such CIR and by that token non-receptive to the legal variety of immigration.

    To get an idea of the minority in the house read this quote from more than a 100 years ago:

    ”The job of the minority is to make a quorum and to draw its pay.”
    -- Speaker Thomas B. Reed, 1890.

    Throughout 2006, the biggest obstacle to high-skills-only bill to be floor on the full house or on the judiciary committee was the Republican controlled judiciary committee headed by Jim Sensenbrenner. He has won his own race(Wisconsin’s 5th) – no surprise there – he would not be heading the house Judiciary committee. Even if Republicans would have controlled the house, it would not have been Sensenbrenner, it was his last term as chair of judiciary committee. With Democrats winning, the difference is that it would not be Lamar Smith heading the house judiciary committee; it would be the Democrat John Conyers of Michigan. Whenever there was a non-CIR bill related to high-skills employment based immigration, like the one sponsored by John Shadegg (SKIL bill of the house) it was referred to House Judiciary committee. And Sensenbrenner basically put it on the shelf. That would change. How much? Only time will tell.

    Individual Races:
    Firstly, J.D. Hayworth of Arizona is on his way to losing his house seat. That’s house congressman called by Arizona Republic Newspaper as a “bully”, a strong anti-immigrant, who is gone from the House.

    Secondly, Jim Kolbe (pro-immigrant) retired from Arizona and a Democrat(Giffords) now occupies that seat. A strong anti-immigration candidate (Graf) lost election for that seat. That’s another good news.

    Thirdly, Jon Kyl almost lost his Senate seat in Arizona. If it’s any indication that anti-immigration noises are no career-savers, this may be it.

    CIR and Democratic majority:
    Democrats may still be weary of CIR because of its Amnesty component, but if they win with a landslide they may go for it. If they have a slim majority in the house, CIR could still be in jeopardy. But once CIR is dead, a legal skilled immigration bill may have a better chance as the House Judiciary committee wont be killing it every time it sees it and the Senate has already passed high-skills relief in one form or other more than once since December 2005 – S 1932 provisions, Managers amendments to CIR and Cornyn’s SKIL amendment to CIR.

    I fully resonate with gc_chahiye;169769 . People like GooblyWoobly are good for nothing. They have no right to pick on one of our distinguish ,well respected and an active member. The Rally have been quite successful and have made people think about our issue.
    Unfortunately, people like GooblyWoobly will also be benefited by the hard work of people like Franklin.

    "Those people???". What do you mean by that? These are people who are trying to get permanent residency on their own right, based on the skills they have honed for years. I don't like the condescending tone of your voice. What makes you better?

    ok, that really ticks me off. This post is probably going to get me a red splotch, but you should'nt have picked on Franklin:
    I think all the work that Franklin did in preparation for the Rally and then at the Rally itself makes it obvious that she is better than most of the IV members (me included) who could not make it to the Rally.

    If you dont like the condescending tone of the voice of someone who has worked hard for IVs goals, feel free to stop coming to IV and posting here. Honestly why should someone here care about whether you like the voice or not when the voice speaks the truth?

    Look at all the blog posts and pictures of the DC Rally before saying anything against any of the volunteers who worked at the rally. unlike the people who are "trying to get permanent residency on their own right" these dedicated bunch of IV volunteers are trying to get permanent residency soon for all of us. See the photos, the videos of the speeches and then talk.

    What Franklin meant by that post (I think) was that IV is much more than a discussion board for reports of who signed whose Fedex package and what was the timestamp of the package. Its very important that we all actively participate in getting IVs goals met. The rally was a big, for-the-first-time event, and still people seem more excited by tracking receipt notices, and the short-sightedness of it all has made many people ticked off. The turnout could easily have been higher (like someone said, see the lines to the doctors office for getting medicals done when the dates were current, and compare that with how many showed up at the rally).
