    I am in same boat as you.

    2 i-140's approved with same company, both are EB2, one is RIR one is PERM.

    PERM one had Jan 2006 PD where my RIR had Nov 2004.

    I-485 was applied using Nov 2004. USCIS may be looking at other one and thinking PD is not current. What a mess.
    leoindiano, I too have exactly same situation. Two I140 both EB2, one RIR (Nov 2004) and other PERM (Jan 2006). I called Nebraska SC using POJ method and verified with them if both 140 are linked to my 485 application or not. IO confirmed it over the phone and then reiterated that later PD is going to get picked up so my case is current per them. So, I would suggest that you do the same thing.
    Another thing is that, after opening a service request, you can send a followup email to ncsc email address and get your query about priority date answered . I did that too and even got response from them . (Both A# consolidation and difference in PD)

    Friends, I understand the concept of marrying before and after 485.
    My question: Lets say I go ahead and apply for 485. However, my H1 has expired, so I will be traveling on AP. So when I travel outside the US, I am technically not on H1, when I come back...am I right? So, if my spouse wants to apply for H4 visa will she be granted one? Since I had traveled on AP? I am sorry if I confused this with EAD. Bottom line, my H1 stamp has expired and I do not intend to go for another stamping while outside.

    It�s really a sad state for us, first the lawyer�s then the BEC delayed the cases, then the july fiasco.

    With a PD of 11/01 I am not sure porting to EB2 will be worth it specially with premium I-140 gone and the costs associated, ????? :(

    Actually I know someone who got it even faster.

    This Pakistani guy came to the US in 2004 fresh off boat to do Masters. Completed Masters by mid 2005, immediately landed job at MS, they started his GC immediately in EB2 ROW and by end of 2005 he had GC in hand. It was ridiculous.

    This is truly unfair where country of birth determined who gets an 'Employment' based greencard before someone else. It can only be fixed by eliminating per-country limits.

    what if Obama does not win :) ..if something has to pass it will pass during this term. things and priorities change after a person gets elected. this is politics 101. I appreciate your optimism and if there is no spill over then EB3-I faces the worst case scenario. as usual the truth is somewhere in between. i.e. be ready for a long road ..if you get before that ..then good.
    as others mentioned ..the only other thing you can do is support IV.

    It doesn't matter what the president wants to do as far as CIR is concerned. As far as CIR is concerned, George W begged it to be passed in both houses well before he became a lame duck. I don't see how the lawmakers on far right can come and align with the far left or even the lawmakers who are in the center. For the CIR to pass through without issues, Dems should control both houses with a big majority. Also, if you are thinking that Obama is going to win this, you are very well underestimating Mac. watch out for the GOP machine in the last 2 months and it will be a different ball game. Clinton lost because her campaign was over confident and by the time they realized they had a string of 10 bad states whose background does not suit her. Mac's campaign can't be over confident after they saw what happened. GOP is going to do its best to further divide the badly bruised Democratic party. Its few states that will decide this election and its difficult to carry states winning only the metropolitan areas. Obama won 5 counties of 90 some counties in OH. If his performance in general election is going to be the same, forget OH. Same situation in WV.

    For now, I feel Obama is a great visionary and ideologue. No one knows whether he will achieve most of the things he is promising to do if he becomes the president. But he has been very logical and rational esp with the gas tax holiday. All said, he looks like a destiny's child. Imagine where he would have been if the Rev wright wreck came before the Iowa caucuses.

    There are so many ifs and buts. our interests are best served with out the big vehicle CIR. If thats the only vehicle, we possibly are going to be held hostage.

    Is immigration a right? ABSOLUTELY.

    Well, over the past few months we have heard a lot of sound bites like �Immigration is a privilege, not a right�. �We are a country of immigrants but we are also a country of laws.� We will see about that in moment when we look at history and find out how lawful immigration has historically been.

    Let�s focus on one thing sorely missing from our community: The sense of entitlement.

    A lot of employment based immigrants in this country, legally here, on H1, L1, J1 etc. have asked themselves, �What right do I have to ask for change in laws or relief from congress? I am not even a citizen. Lobby congress? As an alien? Are you kidding me? Do you want to get deported? Do you realize you are going �against� the Government?�

    Therein comes the lack of sense of entitlement.

    First of all, legally speaking, there is no distinction between the constitutional rights of citizens and the constitutional rights of those who are non-citizens � legal or illegal. (Non-citizens are also called �aliens�, but I refrain from using that word whenever I remember coz none of us look like characters of Star Wars and we are not green-headed animals with 6 limbs, so I don�t consider myself an alien just because I was born somewhere else on the same planet).

    Second of all, as a person within the jurisdiction of the United States, the first amendment actually prohibits the congress from making any laws against stated rights � one of which is the right to petition the Government for redress of grievances. So not only its legal to do what we are doing, it unconstitutional to pass a law to make it illegal for us to petition (or lobby, advocate, litigate) government for a redress of grievances. And that first amendment isn�t changing, coz to change it, its going to need two-thirds of US congress and three-fourths of states to back it. And we all know, how lucky we are to have 51 senators agree on the fact that sun rises from the east.

    Earned Right or Birthright?

    The fact that you are here and you are here legally and working with the system to earn immigration is something you should be proud of. Not guilty of. If you treat yourself as guests, the government will treat you like a guest. I would rather treat myself two times the citizen. Why, coz it simply much harder to earn a citizenship than to be born into it. I believe that not only we deserve fair and speedy immigration, but also when we do become citizens we should have the privilege to give two votes in elections. Now, I am not trying to display chutzpah here. I am going to back up my claim with reason. See, a lot of us came here 5-10 years ago with almost no money. Many of us never received any formal education in America. However, we have been able to survive and keep a job in this country, even during the stock market crash of 2001 and the economic recession after that. No small feat. We are the last ones to leave the office at night (Actually, that is true for both legal and illegal workers, coz the legal computer programmer is still coding Java at 7:00 PM while the illegal janitor starts vacuuming the office). We relocate across states as-if its relocating 2 traffic lights away. We adapt to different employers, we adapt to all employers. And all these without driving down the wages. Yes, it�s true. We don�t depress the wages and we don�t steal jobs and the labor certification is designed to prevent that and it�s working. We all know how great its working and how intense the process is, especially those who are stuck in Philly and Dallas backlog creation centers.

    So, to sum it up, we have twice to right to petition the government for a redress of grievances, twice the right to everything. It�s an earned right, not a birthright. Our natural instinct should be to exercise the rights we have earned. If we cannot do it now, we are not going to really make anything out of citizenship of Greencard that we are pursuing.

    And coming back to the sound bites about privileges and �Nation of laws� coming out of Washington today, let me say this: The pilgrims, who dropped anchor near Cape Cod in 1620 didn�t go through a port of entry and get their passports stamped and their I-94s stapled. I don�t think the Indians were waiting at the coast of Virginia to stop immigrants. They just came. And they settled. And they called it home. No priority dates. No visa bulletins.

    So you see, what really matters here is whether you feel you are entitled to something or not. If you don�t feel entitled to a fair immigration process that does justice to those who seek legal ways to immigration, then you probably aren�t entitled. To ask for something, you must first believe that you deserve it. And to show that you deserve it, you must ask it loudly and clearly from rooftops. Don�t predict visa bulletins, but work to change and influence the visa bulletin 6 months from now. And no, you wont be deported for exercising that constitutional right.

    Do you know if they have a record of everytime we talk to the CSRs?

    I have only been able to talk to an IO once, and I feel they definitely have more info than these CSRs who are sitting there like bots. To get to the IO, I basically had to tell them that I have not opened a SR so far (which was not true).

    When I tried calling yesterday, I told the CSR, that my attorney opened a SR on 1st September and if she could kindly transfer my call to a IO. She said she will not be able to transfer my call, as I had already opened a SR. When I told her that I already got a response for the SR, so I now need to open another SR, she said she cannot as it asked me to wait for 60 days. I requested her a couple times to please transfer me to a IO, she said, Sorry, cannot do it as you have already opened a SR.

    I am planning to call them next week again, will tell them I have not opened a SR yet. Atleast, I will then get to talk to a IO.....!!

    Just in, Obama Administration wants to change law allowing employee to sue past employers and seek compensation. Current laws allows employee to sue for events up to 24 months in the past. This will change and suing employer is going to be a lot more easier. Bring it on baby, this time employees will be millionaires by suing body-shoppers. I am no longer going waste my money to buy lottery ticket :p

    whats up with USCIS issing RFE's and stuff for people with PD's so far away..Iam not sure what the RFE is but it makes me wonder what USCIS is doing with files with a PD of 04 that too eb3..:rolleyes:

    So far what I have seen from various forums, looks like its a standard RFE for most of the cases.
    Asking for updated G-325A(Its an updated form little different than what we submitted during july 2007) and EVL.

    Just submitted my evidences today to USCIS to the RFE I received on March 19th. Hopefully it may mean that all other evidences are fine...like BC, MC and Medicals....

    Applying GC in EB2 is appropriate with your education. As long as you have a valid computer science degree ( U R MCA) .. with solid 7 years of experience should be good.
    But, it is wise to consult an immigration lawyer because of the current scenario..
    Considering earlier days , you would qualify for EB2 with your exp and Masters.
    Dont know what exactly , is the case now..

    Given a opportunity , do not miss EB2.

    A very sensible post. You dont need to have ur life around the GC and Priority dates. You need to do what u want to as much as within ur limits.. But one thing is USCIS can be staright forward and say EB-I wont move for such and such time and people can still plan better... :)

    I agree. On an average, it seems, one spends just about 6 yrs to get his/her GC. That's nearly 20% of our productive "employment" life. At some point in the process, one starts to wonder if he/she can lay their roots in this country.
    It is not an easy or trivial task to "just move on" and pursue plan B or plan C.
    With passage of time, the priorities and the drive of people change.
    So, the immigration system should be quick and transparent.
    If you notice in daily life, there is always a "good-faith" disclosure of terms and conditions before signing up for anything. And both parties strive to keep their end of the deal.
    That's all we are really asking from the SYSTEM - "If you are willing to open the gates for immigrants, please process their applications to the best extent possible and don't hold up our lives"

    What is missing in this system is "empathy". Rules are fine and we also understand the over-subscription in certain categories. But at the end of day, the controlling or executive authorities have to show some empathy to those that are left hanging. Rules are made to help people and they should not become an excuse to punish [PR process delayed is justice denied, truly] the common folks instead.

    President Obama has stated he would like have an empathetic judge on the supreme court. Likewise, we need someone heading the immigration system that empathizes with the lives of prospective PR lot.

    What can we do to seek such a leader or change?
