Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing

Yes, France is a developed and rich country and, if I had stayed there, I would certainly be today in a much better situation, professionaly and financially!
So, I certainly did not come here for the $$. It is extremely simple: it was just my childhood dream to live here and I am proud today that I made it.

Would I do it again, even to fulfill my dream? Certainly not, I am not that mad. Will it prove worth it eventually? I don't know yet.

True, but you are forgetting the basic definition of demand. Demand is willingness to buy supported by ability to buy. If you are from any metros in India, think how many of your Non-IT, mainstream friends draw more than Rs. 50,000 per month? How can someone making even Rs. 50,000 a month afford 50 Lakh flat?
If there are 10 people drooling out side Ferrari showroom that does not mean there is demand for 10 Ferrari :)

Finally I am a US citizen after being 10+ years in this country. This is one of my biggest fulfillments and it means everything to me. US is just not home anymore for me, it is my country.

What a stupid post.
Do you really think that all EB3 people are no US-educated? EB2/EB3 is dictated by job requirements and not the actual qualifications of someone. I am graduate of a top ranked US university but applied in EB3 since my job didn't require M.S and my company didn't want to manipulate the job requirements.
I am sure there are many more like me who were qualified for EB2 but applied in EB3.
If this is the best you can come up, I really hope that this was your first and last post.

Niether many has tried this option (entering on AP and filing H1B transfer to different employer other than GC sponsers) nor USCIS has strong history of approving/dealing with these type of cases. After entering in AP, though one can very well contine the H1B with the same employer to whom any one work on H1B before leaving US. There is a memo for this type of situation. However, there is no specific memo to address this situation (Transfer). It is all depends on the individual adjucidator's logic. If they see your latest I-94 with parolee stamp, then they may deny (or issue a RFE )the H1B transfer, by the applying the the logic of one must be in the smae status to seek extension. If the deny/issue RFE, you can not counter act as there is no secific memo or policy by USCIS in this case.

Does someone have an experience of application process, so that i send in the right papers, before leaving here. i mean the set of documents to send to DOL, so that i do not miss out on something important which could nail him to the maximum

As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.
May be EB2 India and China can see some movement in July VB published in June.

The VB when it defines the categories, also defines EB2 as 27.6% of 140K and what ever is left over from EB1. The example you state is a violation of anyone's civil rights...leave alone an immigrant.
To use your example, no one is "raping" the applicant by imposing a per-country limit on your green card application and making you wait a few years while you work in the country and enjoy all civil rights.
Congress used the power given to them by the Constitution to frame Immigration laws and they created a formula for regulation. Per-country limit is that formula which they had the constitutional right to create in order to uphold the balance of immigration in their country. Getting a GC is not anyone's right..its a privelege bestowed based on the applicant meeting certain criteria which includes quotas, as per the country's laws. There is NO civil rights impact. You are getting your green card in the end...only problem is they are making you wait 10 years because of that formula. But none of your civil rights are being impinged upon. So we should work to change flawed law and the formula rather than try to muddle the issue with civil rights. No matter what extreme example you give, you will still never be able to prove that your civil rights were impinged because you are having to wait for 10 years in a legal queue while your application is pending.
Don't get caught up trying to defend a stance no matter how irrelevant it may be. Its better we focus our time and effort on more achievable and valid provisions.

"...Demand" and "right" will work up to the point in which we don't irate Americans. America has been sympathetic to immigrants in good part thanks to the capacity that America has to accomodate us here. If an excessive number of immigrants get in and that alarm citizens, I can tell you this country will become as unsympathetic to immigrants as many European countries are.
....Just be careful with the idea of "demanding" and "rights" though :)

I agree that it is very important to clear what is "rihgt", "privilege" and "symphaty". I tried to do that several times before and in order to avoid any misunderstanding have quoted below a part of one of my messages. Please read it carefully.

It seems to me that the way they currently handle the H1 immigrants has a lot to do with the "Las Vegas" type of business (gambling) - shall I get my LC approved, when will I get the LC approved, shall I get a GC, when can I get the GC etc. The rules change permanently and half a million hard working people are in limbo for a decade and more. That is not fair and this is what you have to explain to the Americans.
And, btw, if the local IT "professionals" you were debating with were so great, they would not be unemployed...
....Just be careful with the idea of "demanding" and "rights" though :)

I agree that it is very important to clear what is "rihgt", "privilege" and "symphaty". I tried to do that several times before and in order to avoid any misunderstanding have quoted below a part of one of my messages. Please read it carefully.
"I do believe that I HAVE THE RIGHT to get my LCA adjudicated in 2-3 months time (OK, make it 6 months, having in mind you are dealing with an inefficient administration).
I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.
These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege..."
Americans have the right to determine how many immigrants they need and how to handle this issue. But we have the right to follow clear and simple rules for that process.
