My congressman asked for an authorization letter from my employer & lawyer to look into it in-depth. Dead end.

My attorney says he cannot promise June 1 filing b'cos of volume...but not to worry b'cos date is current the entire month of June. Is that true? Does FIFO matter?

I sent emails to 20 of my friends. I explained about this site and what we r doing to one of my chinese friend. He registered and he said he will post about this site in some chinese forums. I had some of my green card friends register to increase our strength.

I agree that going through this again next year is irritating (which is euphemistic, at best), but...
assuming for a second that CIS is willing to give you a replacement card with 2-year validity, are you willing to send them the card you have finally received (after another nerve racking wait) so they can process your request? I don't think so...
BTW, there's a guy on Ron Gotcher's forum who's been issued a 2-year EAD eventhough his dates have been current for the last 4-months. Check this out: http://www.immigration-information.com/forums/showthread.php?t=5855
so CIS is issuing 1-year cards to some folks whose PD was not current when the EAD application was approved...and 2-year cards to some whose PD was actually current. typical CIS stuff...
I wonder for those who have got one year cards, if this would help - call USCIS and point out the inequality ...or maybe say that by mistake they sent 1 year when they should have sent 2 year ..would that help ..any thoughts ??

I have H1-b petition approval but i dont have h1-I-94 card.
Is it legal to work without h1-I-94 Card?

Read the approval letter. It states that you would need to travel outside the US and apply for H1 visa at US Consulate abroad. If your visa is granted then you can re-enter US with new I-94 card. Stay inside US without a valid I-94 is considered Out-Of-Status.

What was your PD ,and wating time for I-140.(ie I-140 applied and approved date.)
OK I'm from ROW EB3. PD Apr 2003. 140 and 485 were filed concurrently in June 2004. I 140 was approved in 1 week (I guess because my son was aging out) and I-485 for all family were approved in June 2007.

the main thing we need to watch for is whether AC21 rules remain suspended for the next yr. If not.. trickle down policies will make sure that retrogression remains at a decent level.

I also have another suggestion. Why don't we also do a targeted campaign at partnering with corporate HRs to push for EB relief. Many corporate HRs are aware of the EB2 and EB3 retro pains. These corps rely on EB2 and EB3 folks for innovation and technology. Corporations have a lot of power in pushing legislation. I am just suggesting to try other channels as well. Corporates being just one.

An attorney I know told me today that:
(1) they believe EB2/3 mid-month retrogression is unlikely in July based on coversations with relevant folks in govt.
(2) USCIS is unlikely to want a spirited fight from AILA by retrogressing mid month, especially given the fight that's already on about June EB-3 unskilled
(3) The June EB-3 unskilled mid-month should be viewed in the context of the just 5000 visas that were left.
I am not going to qualify the attorney by firm name or with adjective phrases such as "very high profile." Nor am I going to quote the attorney in multiple colors. Posting it here for what it's worth (even though I realize this would sound totally bogus if I were to start this post with "a bird told me that...") None of the above is secret knowledge; apparently other AILA attorneys are also up to speed on these points.
In any case, however relaxed attorneys might be, we should probably work on trying to hit that ever-moving target of "as soon as possible," if we want to see the smile that an EAD card will bring to dear spouse's eyes.

Yes ..she can use H4 if H1 is denied. Make sure consulate don`t cancel the H4 visa and the time of H1 B visa interview.

Not only do you get SS but you also have to pay taxes to US irrespective of where you live for the rest of your life. So on a net it is still arguable depending on your long term residency plan. And my friend, Social Security is going away in the next 10 years. You think the USA can maintain this kind of a deficit for ever with people not willing to see an increase in taxes.
