My Scenario
-> I entered country on B1 and I applied for H1 through other employer. H1 got approved but change of status is denied as i left the country while petition was with USCIS.
-> I entered country on B1 again with new employer who applied my H1. My I94 validity ended on October 24th and we applied for extension due to some show stopper. Application is still in process.
Here are my questions -
1. Can i apply for change of status now or do i need to go back to India?
2. Now that i applied for extension, if i go for stamping at India immediately, will it be positive? Just because, i stayed for almost around 8 months in US this year. I was just wondering, will they reject it raising doubts on my intent? No one can decide on it, but what are the chances?
3. Staying in Canada on work permit for 6 months and then leaving to India for 3 months and then go for stamping, is this a better option?

When E-Filed my EAD Reniewal , I didn't filled these fields (14. Manner of Last Entry & 15.Current Immigration Status) as they are not mandatory fields.Will there be any problem with my application?Anybody on the same boat?If so can you share your experiances?

Hello Gurus,
I am on a big confusion and dilemma, need your assistance and guidance. Here is my situation.
I am on H1B and recently terminated (July 21st), I am given 2 weeks of reverberation which ends on 4th Aug, and my last pay stub (from 1st -4th aug) comes on Aug 15th.
Now as the market is really bad, I am unable to find anyone to sponsor my H1 transfer. My wife is on F1 and I am willing to change my status from H1 to F2. Now my concerns are:
a) Is my H1B status still valid (after termination) and can I apply for change of Status to F2 now? I have read somewhere, I can apply for change of status to F2 only if I am currently on a valid status.
b) After applying for F2, before my approval of 'Change of status' if I get a job, do i need to apply another change of status application 'F2- H1B'?
c) In case i get a job after 3 months, transfer my status from F2 to H1, will i require pay stubs as one of the documents? But at this point i will not have any pay stubs as I was not working? How will the transfer go? Will there be an issue?
Please let me what are my best options right now...I appreciate all your help...

I have renewed my DL in VA while my H1B was pending last year (Oct 07) . All you need is your H1-B application receipt and they will extend it by 1 Year.

I have a question. Our files are stuck in the Chicago local office (after our interview last year) and the only thing pending is the Namecheck, which has been pending for more than 180 days. Our PD is current. Is anyone in the same position?
It is frustrating because you do not get any LUDs when your files are in the local office and I have no indication whether the Chicago officeis processing cases with NC pending > 180 days. Anyone knows?
You should send a letter to local office and demand adjudication. Attach Feb 4th memo.

It is a part truthful. For easy explanation, I would say PD does not matter
for EAD/AP/FP /Namecheck all processes but it matters at teh final stage of 485 and that is approval. So say you pass through all processes and that time USCIS will see whether your PD is current or not. If it is current than you will get your approval soon and if not than your file will be out on a rack to wait for your PD becoming current.

Did you get an answer from your attorney?
Attorney confirmed that correction was made before final filing.
Also said that the Labor Certification was tied to my I-140 which also got approved.

My 485 filled on July 2nd @ NSC Received at 11:11 AM - No check cashed and no info.
140 Approved from TSC last year.
EAD is self-filed later on Aug 14th @ NSC with USPS tracking# proof.
But EAD check cashed today from NSC (LIN#)
It's crazy. What I can say more.

Samething happened to me. On 11/25/2007 i saw a LUD on my approved I-140 (which was approved in Dec, 2006). And then LUD on 12/06/2007 and 12/07/2007 on I-485 for both self and spouse.
Not sure what it could be?? I filed I-485/EAD/AP in late July, 2007. Have received EAD and have done finger printing. Have not received AP yet. Filing Center in Nebraska. My PD is October, 2005, EB3 ROW.

Hello,
Last week i received RFE for my wife's father's name. The name on birth certificate is different from school leaving & other docs. I'm trying to get it corrected from Mumbai.
I beleive if i get a correct one matching with other docs, i should be ok.
Another issue, i have is i have rented an apartment under my name close to my work in the same state. All my docs have my home address, my question is will it affect my case if they find another address under my name?? I still have official address as my home everywhere...
Yes you need to make sure that all documents have consistency in names and dates. As far as your second question goes USCIS has space for just one address which should be your current address. So as long as you can prove that the address listed in CIS system is the most current address then you are fine. There is no law or no way to provide multiple address. Just make sure you can prove that address on file is your primary residence.

I dont think that holds true. If you follow you'll see they have been approving cases even in December for 2003 when the PD has been retrogressed to 2002 for December.

But you may be able to apply for transfer and 3 year extension with the new employer after you get your I-140 approval. Pls check with your lawyer.

I am applying for UK visitor visa. My wife is accompanying me in the trip. Do I need to fill up the electronic form separately for my wife also.

I don't understand when all these new questions pop-up with new user ID's, I wonder if they really tried to research at least a bit before posting here. Why do they need to be spoon fed for simple questions whose answers are just a 'google' away.
