I would suggest you file asap on June 1st at least by June 15th. Dates are going to retrogess - this is what my lawyer told me.
You can file anytime between June 1, 2007 and June 29, 2007 (June 30 is a Saturday) assuming the dates retrogress in the July visa bulletin. I will be surprised that the dates will retrogress in a month simply because all the people filling for 485 will not be necessarily counted towards 2007 quota.
The trick is to know the number of people who are already in 485 and simply waiting for adjudication.

That is exactly my point that Perm Audit is not focused on Nationality, Field or EB category. If most people are from India, China, Philippines then automatically most audit cases are going to be from these countries.

Well I really think this is reasonable suggestion to factor Priority Date to determine eligibility for citizenship. It could be 5 or 10 years past your priority and only after approval of green card. Currently many people wait for 8 to 10 years for green card and another 5 years to be eligible for citizenship and some lucky ones get green card in 2 to 3 years and citizenship in another 5 years. System should somehow be balanced to have close to uniform wait times towards citizenship for all.

You are right. But many people came here at the middle of their carrier and they are struck here with their children education etc., They are bound to be here and there is no way. Further, in my country, there are still reservation policies in everything, which may prevent the kids in going in for the education line they like. I donot want to explain this more as I may be degrading my own mother country. In a nutshell, everyone who wish to be a citizen of this country will have lot of valid reasons for getting a citizenship in this country.

dohko, The point of satishku_2000's post was that all companies follow the similar business practices. It doesn't make any difference if it is TCS or IBM, Anderson or Infosys. They are all same bunch of people, just different names. So your repeated rant about "indian companies" is not valid any more. We have someone who worked for IBM for 8 years and got 2 pay checks on bench. So now, lets not squabble without any reason.

Slumdog...I totally agree with your view point and in fact share the same. I believe you cannot put your life on hold waiting for GC or something unpredictable. I also agree with you that buying a house is a life style decision. You can live ur life hoarding cash living cheaply or you can live your life well. Also each has its advantages and its a personal choice.

Still there are others who were screwed by employers and had to reapply labor and restart the GC process. When i talk to my congressman, all they say is that the PD is not current and they cannot help.
It was not a hearing, just a meeting with some of the people I worked with over the past year on the stimulus issue.
Anyway, I went to the meeting and presented the issues raised by people here and emphasized that the first priority is recapture. Of course I raised the other issues as well, presenting the argument that America will lose its competitive edge if its highly skilled immigrants return to their home countries or other more welcoming countries like Canada, the UK, and Australia.

I understand your frustration since I am in the same boat but I feel it is wrong to say that the IV efforts are hurting EB3 folks. Not sure if there is basis to support that. Several IV proposals helped all EB categories and failed mainly due to anti-immigrant lobby.
EB3 situation is completely hopeless and only piecemeal reform can help EB3. I am sorry but I do not understand this discussion since this bill (if it ever comes to debate) impacts across all EB (advanced degrees).
Now why would i sue IV. It is the organization which is making an effort. Sadly that effort is hurting EB3 folks. The whole idea is that we are a community and as a community we need to discuss all issues. Now when i talk about EB3 issues a EB2 volunteer (I commend you for doing what you are doing w.r.t. advocacy) asks me how many law makers did i meet. I went through the same frustration in 2008 when many 2006 got approved even when my date was current.
Looks like the same thing is going to happen again -- most of the approvals are from 2006 and I am still stuck forever..what the *&%^ing going on....

Just see the old threads of EAD delays. All these people with EADs were sobbing on those threads pleading to IV to help them. Most did not have a donor status or had contributed a dime. They were on the verge of losing their jobs when IV helped them get their EADs on time. Now where are all those hundreds of people. Are they contributing a dime for the lobby day? I bet after 2 years, they will come again to IV and sob about EADs delays and ask IV to help them.
This is the part I am not agreeing with IV and don�t like very much. Why would IV ever need to help people who never bothered to contribute time or money?
If they can get it for free why would anyone wants to contribute ?

My labor process started in June 2003 and filed on Dec. 2003; Yew York EB2 -INDIA. It was cleared from BEC 2006 October. Like me many from NY/NJ/CA stuck in BEC, so we are able to apply I-485 in june 2007. I think EB2 2001-2004 April from NOv. VB is right. These people will take 2008 quota. So people after 2004 period need to wait for 2009 quota.
When Jun-July 2004 PD will be current? Any guess?

What do I make out of this? U think once assigned to an officer thgs shud start moving? Or...even after getting assigned to an IO thgs can go bad? Has any thing of that sort also happened? Just curious so I can be prepared...

I don't think so. The only thing that could have happened is that a RFE on any further information. But becuase of the pre-adjudication the chances of an RFE is very very minimal, I will say down to ZERO.
So be happy and just keep your fingers crossed to hear the good news!!!

I just returned from an INFOPASS appointment for checking up on my case status.
Their systems were down! They could not access any records, and the IO kept saying that it's down and you should get a decision in a few months.
I was adamant, and asked her if it's possible to reach someone else at NSC - she called asked about my status - she kept saying, "good, good", and then she turns around and says that my case is approved :D:D:D, and that if I don't get my card in the next 30 days, (the usual stuff!). She then made a remark to the person from NSC that these guys know more about their cases than we do - as we go to the IO with all sorts of information about the VB.
I made sure that they verified my current address, as I had bought a house and moved about a year back, but wanted to make sure that the address was updated after filing the AR-11 back then.
So, the important lesson learnt was that cases are being approved, but the online systems are not being updated.
Just hold on... It's on it's way. Will provide an update once I get the cards.
