Techically, you can't use Employer A stamping as you never worked in US.
You can give a try but not before october 2010 as the employer B petition is valid only from october 1 2010.

Thank you for your time and I appreciate your effort.
Scenario:
I have two Approved I-140s (both filed by same company).
• Filed I-140 & I-485 concurrently with a PD of Nov 2007 (Original Labor) - I-140 Approved and I-485 Pending
• Filed I-140 with PD March 2005 (Substitution Labor) - I-140 Approved.
Questions:
1. I would greatly appreciate if you can let me know what are my options and any relative information (Letter formats etc.)
2. Can Info-Pass work instead of writing to USCIS?
1) Send letters to the service center explaining your situation and the priority dates + 140 approval LIN#(NSC) or WAC# or whichever approval numbers you have. You need to stress that your dates are current and that your AOS applications have to be approved based on the current 140 (irrespective of which approved 140, the 485 apps were filed).
2) Send faxes same as the letter.
3) Call the NSC/TSC IOs. (If you reach the national customer service center, no luck).
4) Take Infopass.
One of the above options will work.

If you are already in US, you don't need DS-230, you need to file I-485 instead.
I-130 is an alien relative petition filed by your spouse on your behalf. I-130 has a question if you want to "adjust status while in the U.S." or go through "consular processing at an American post abroad".
If you plan to "adjust your status while in the U.S." you use form I-485. I-130/I-485 can be filed and adjudicated concurrently.
If you want to enter the U.S. as an immigrant ("consular processing" you file form DS-230 Part I with the National Visa Center and later DS-230 Part II with a consular officer at a consulate/embassy outside of the U.S.

I think you guys are aware of unfair treatment of the Labor filer at the Atlanta Center. It is taking more than 100 days to approve labor while Chicago normal approval rate is less than 15 days. Core group..Do you have any feedback on this? Any plan to address this issue?

Hi,
My wife's 485 is rejected with the following reason "The application/petition was filed on the outdated version of this form". The rejection notice has a receive date of July 1st 2010 and a LIN number. Now the problem-
My 485 was approved on July 8th, 2010 and I received a "Welcome to USA" notice on July 12th. My H1 has expired on July 14th, 2010 along with wife's H4 and our I-94's. We applied for both the H extensions in may. Now if we resubmit the 485 with the new application will the USCIS honor the July 1st receive date?
My main concern is on her status, any input will be greatly appreciated.

My green card application is family based and my spouse is a primary applicant. I have a EAD as of now and I recently got laid off on January 15th 2010. My H1B VISA expired on January 23rd 2010.
Issue: I recently applied for Advance parole and got rejected. Reason was given that my I-485 is administratively closed.
My laywer has suggested that I should immediately apply for H4 to save my status. I am really not sure what to do here. I am sure I will find a job in about 2 weeks but not sure if I will be able to get my H1B renewed or will be able to get a new H1B as I have already been counted towards the quota once.
I also read that it depends on the approval of I-130 but in my case I couldn't find I-130 for myself, even though there is one for my spouse which was approved in 2007.
My questions are:
1: What steps should I take to save my immigration status?
2. My EAD is not denied yet, should I start working on EAD or apply for H1B right away?
3. Can my H1B be renewed as it has already expired?
4. I have had a EAD for over a year and all of a sudden it may get canceled. Is there a way I can appeal somewhere as a mistake was made my immigration itself?
5. Have you experienced any cases similiar to mine and what were the outcomes?

Hi guys,
I know this is Off Topic (OT), but I was wondering if ALL Tax payers including immigrants on H1B will be getting the proposed tax rebates. This had happened in 2001 as well and my citizen co-workers remember getting checks.
Does anyone who was on an H1B in 2001 remember getting a similar rebate check? I definitely dont remember getting one.
For tax purposes, you are considered a "US resident" and will get all the breaks or rebates that a US Resident will get.

Since the last few pay-rolls, my employer is giving everybody a photocopy of the Pay-check from Pay-chex Inc.To reduce costs of printing and mailing the Pay-checks, My employer is asking Pay-chex Inc to email the Bi-weekly pay-rolls of everybody.
Wondering if the US Embassy in India would create an issue by not bringing the original Pay-stubs.
