Hi ALL,
I'm a newbie in the forum and i need help from all regarding the below issue i have.
I'm a F1 student and presently working as a Software Engineer.I have been on OPT from January 2010 and i have recently got an extension for another 17 months which is a total of 29 months of OPT from January 2010 till June 2012, My main question was when do i need to apply for H1 and are there different types of H1?
What are the dates for applying for H1 and the start date for H1?
I will be done with my OPT by June 2012, so when should i start my H1 filling and is there any way that i can extend my status?
what are the ways of applying for H1?

Do it as soon as you can. You have a lot of time though. This year's quota started from April 1 which will come into affect on oct 01. You have nothing to worry.

Had an Infopass appointment today VA, Washington Field Office, just wanted to share the experience here.
Had appiled I-485 last year August, and case was transferred to Vermont and then back to Texas, had
never received my FP notice. Received EAD and AP from Vermont last year.
It was a really nice experience as first lady confirmed/checked my Priority date is current, and was very helpful, she immediatly scheduled an FP appointment for my wife and myself for Sep.4th, though I did not
inquire much about my case, she provided me with all the details. My wife's name check got cleared last year and mine got cleared just this July 31st, she also said that recently tsc centre worked on my case, and probably did not do much as FP is missing, she said that currently my case in the records room and not in examination room. When asked after FP on Sep 4. any chances me getting approved, for follow-up she said call TSC after two weeks they should able give u all the details.

I am happy to read this. My observation is that Indian-American US citizens generally don't care about the Indians who are going through the process of immigration. In November 2005 when some one approached IAFPE with retorgression problem, their NC chapter conducted a seminar in Raleigh and some 100+ members did sign a petition. But they handed over petition to Bobby Jindal and it looks like from what is reported elsewhere on this site, he belongs to anti immigrant camp. But except this seminar even this organization did not take more interest in this issue. But I hope India Community Center has shown way and more Indian-American as well as Chinese associations would come forward to support the issue. Can some one approach Asia Society in DC who last week organised a speech by President Bush?

Several reasons, some of which were mentioned. You need Adobe Acrobat to edit the document. PDF format is cross platform. To view the pdf output all you need is the free plug-in. In other words, if I created the document in Illustrator and "printed it" to a pdf file, you would not need Illustrator to view the contents.

In a recent decision, RUIZ-DIAZ v. UNITED STATES OF AMERICA, the court ruled that Petitioners who filed or will file a Petition for Special Immigrant Religious Worker Visa (Form I-360) with United States Citizenship and Immigration Services (�USCIS�) on behalf of individual beneficiaries are hereby notified that you or your beneficiary may now file an Application for Adjustment of Status (Form I-485) and, if your beneficiary seeks employment status as an adjustment applicant, an Application for Employment Authorization (Form I-765) even if USCIS has not yet issued a final administrative decision regarding the I- 360 petition. Previously, the I-360 had to be adjudicated before the adjustment package could be filed.
The Court has invalidated USCIS� bar against concurrent filings as an unreasonable
interpretation of the governing statute. Pursuant to an order dated June 11, 2009, USCIS is required to accept as properly filed adjustment of status applications (Form I-485) and employment authorization applications (Form I-765) from individuals who are beneficiaries of petitions for special immigrant visas (Form I-360 (http://www.h1b.biz/lawyer-attorney-1137192.html)), whether submitted concurrently with or subsequent to the visa petition, provided the applications meet USCIS� valid filing requirements.

U.S. Citizenship and Immigration Services (USCIS) announced today that it will begin accepting H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) subject to the fiscal year (FY) 2011 cap on April 1, 2010. Cases will be considered accepted on the date that USCIS takes possession of a properly filed petition with the correct fee; not the date that the petition is postmarked.
The fiscal year cap (numerical limitation on H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html)) for FY 2011 is 65,000. Additionally, the first 20,000 H-1B petitions filed on behalf of individuals who have earned a U.S. master�s degree or higher are exempt from the H-1B cap.
USCIS will monitor the number of petitions received and will notify the public of the date on which USCIS received the necessary number of petitions to meet the H-1B cap. If needed, USCIS will randomly select the number of petitions required to reach the numerical limit from the petitions received on the final receipt date. USCIS will reject cap-subject petitions that are not selected, as well as those received after the final receipt date.
We recommend employers to hurry up and get all the necessary documents in order to meet the April 1, 2010 deadline.

You don't say when the change of status (COS) to H-1B took effect. I assume it was 10/1/09, if you were subject to the H-1B cap. If you have not worked for the H-1B employer, then you are unfortunately out of status now and any COS would probably be denied. If you have a valid H-4 visa, you could leave the US and re-enter showing the H-4 visa to return to H-4 status.

It will be subjective of the examining officer...he could choose to deny the 140, issue an RFE or may even just ignore it...
I understand is a grey area but i was wondering if anybody here had some issues like that. Hopefuly, whatever he does is not going to be denying it...
