People have given me reds for asking the dad to go to the cops and reminding this dad his duties.
I think these people who have given me reds only know how to produce many babies but do not know that it comes with a responsibility. Shame on you and to all those who live a life of fear and teach the same on this forum.
Tell me something, if you have an illegal gardener/cleaning guy/moving helper/carpenter/plumber/handyman/male babysitter etc in your house and you have employed him for his servicesand he rapes your wife. Will you not go to the cops? Or will you sit tight at home and just post on the forum saying that you are an H1B and you fear that your H1 and greencard application will be revoked. If you still feel that not going to the cops is a better option, then I do not think your wife deserves a Man like you and certainly not a impotent person like you.
I find posts on this thread very repulsive and cannot hold back these strong words.
Great Internet.
Without knowing whether such an insident happened or not, you can talk this much.
1. There have been no evidences so far.
2. Don't know whether the thread creator is the parent or nanny.
3. Don't know whether it could be someone just want us to engagge in some sensitive arguments.
I support you on going to cops, but prepare in advance to handle the backfire.

Yes,, they did...
Our forefathers travelled to the promised land in ships that were full of rats, without food or water. Several of them died while trying to reach here.
Once here on the promised land, we had to fight our way to create a free society that you are dying to be part of. America is land of entrepreneurs.
And any one that don't have an entrepreneurial spirit is not welcomed here.
What do you have to bring to the table?
If you know so much about US then you must know this -
"immigrants were one of the key founders in more than a quarter of all the engineering and technology companies set up in the U.S. between 1995 and 2005. Further, it counted $52 billion in annual sales by these immigrant-founded companies, which employed 450,000 workers in 2005. "

Read what industry leaders from Microsoft, Google, Intel and Sun are talking about. Why they look to India and China. You dont want to understand this. Thats fine too. You did not have proper education to know this. Ask your parents why they neglected you while finding their soulmates (or ****buddies).
You "dumb and dumber" people just used this country and thought no one will ever challenge you. Now that you know very well your good old days are over you're talking all garbage. Go and hide where you can. You're not lucky enough to enjoy this country like your grandfathers did!! Bad luck buddy.
Keep talking rubbish if you wish as you've nothing better to do.

I would say if you are getting a good opportunity, do not loose it for the sake of September Visa bulletin. Do not send the AC21 documents to USCIS. If RFE comes, you can respond quickly by hoping that they will approve your case at the same time. In case, if you don't get RFE (chances are more), you might get GC right away.
absolutley true........ AC21 is not mandatory........respond only if RFE is generated....
just my 2 cents

Dude if u didnt have I94 how did u you work all these days?
u should have got your I94 in chennai if u went for chennai
let me make it clear
as per my under standing if u didnt apply for change of status, then your h1 papers didnt have i94 attached with them when they were first released, they might have asked you to go for chennai for stamping
which u didnt am i right?
make your self clear buddy
Maco,
As i said earlier, i relied too much on my employer as istated to him in the first place to do a change of status Visa. They didn't do it, and as i was under the impression that i didn't have to go to India to get it stamped, i didn't leave the country so far and worked all these days. The ugly thing is that even my employer didn't ask me to go to India and get my Visa stamped in India, but he did find projects for me and produced pay slips all the time so far. Now, i found out the mess i am in, that too because i was ready to apply for I-140 and I-485 together. The immigration attorney who is preparing my I-140 caught my out of status situation and all the hell broke lose. Is there a way to seek an adjustment n my status from INS based on the fact that i was eligible for Chnage of Status from L-1 to H-1 in 2005, but mistakenly, i got a H-1 that was supposed to be stamped? Would they consider any such cases? Is there any example of anybody whoever did it???
And even if i leave the country now, would i face any problem in next three years, if i attempt to come to USA on a new H1 next year, with a new Visa?
Please provide me some advice if anyone knew any situation like this before?
Thanks !!

it goes deeper than that. first let me point out that this is philosophical- you argument is not about law, it's about a point of view.
so if i ask you why EB2 filers should spend extra years getting educated and never getting this all important magic "PD" and then get in line behind someone who got a job the day they entered the country- and got a PD soon enough- what would you say?
ask me. it took me 11 years to get a PD. why? for 7 of those years i was getting my advanced education. so why should i suffer behind the 3 year Indian degree person (against my 7 years there as well) who came in 5 years after me and filed right away?
there are reasons why the EB priorities were set up. by simply extending your logic EB1 should also wait for a turn and not have priority. what's good for the goose....
having said that, it is absolutely insane to ask people to wait indefinitely and we must do something about it.
today the EB3 folks (and I have nothing against them, their waits are insane- and it's absolutely not right) are porting to EB2 with those bachelors degrees and 5 years experience. and just because they could APPLY for a GC earlier and all their years get counted in the PD, they keep lining up ahead of me. why do all my years count for NOTHING?
please spare us "fortunate" EB2s a thought too. think of when in life our careers are finally freed from waiting for a GC.
and now please concentrate on ways to end retrogression and stop the EB2 vs EB3 crap. we all have our problems.
I should clarify few points here:
1. Let EB2 be wonder kids. All I am saying is their GC shouldn't be at the cost of EB3. Have a separate quota which is twice as much as EB3. But, when the left overs are up in the air, EB2 shouldn't grab everything.
2. Not all EB3 are with 3 years Indian degree. Most of them are 4 years and above. Please prove me wrong. There are several Master degree holders in EB3 queue just because of their employer decision (not even job requirements).
4. Most people filed under EB3 way back in 2001/2002 because they didn't antici pate such a mess 5-6 years down the road.
5. Today most applications are EB2? How? does it mean that the '3 years' Indian degree holders are not coming to US anymore? Nope. These days people just ', manage' to file under EB2.
6. Finally, EB2 would understand what we (EB3) are saying if the EB1 queue was retrogressed and EB2 was stuck in 2001.
There is no separate quota while applying for H1B but at the final stage of GC! Ridiculous!!
Bottom line, a VISA that could impact an individual's life so much should not be dragged for 7-8 years. And, thank you for your concern for EB3.

Anybody please comment. I have done some hard work here. Do you like the idea ? should we go for it ?
Hi bsbawa10,
You have put some good effort here and I think the posters make a point. But like you said, we need a substantial letter to accompany these.
We might need to take a bit of time to re-organize and pull this effort together. The Oct. VB news has been quite a damper - I came very close to not logging into IV today - I needed some time away from all this to collect my thoughts. It is likely that several people are doing the same.
IV core, in addition to the letters and calls to Congress persons to support HR5882, what else can we do? Several small efforts will likely not cut it for us. We need to pull our efforts together towards one single powerful protest. Any ideas from our advisors?

We have taken an infopass appointment for the coming Monday and was wondering what to ask the immigration officer apart from the obvious,
"when can we expect our application processing?"
"Did we clear our FBI Name check process?
Please suggest us questions that are helpful to determine and help our application status.
