Not quite, as I understand it, if your PD is not current, your AOS will continue processing and will eventually get to a "approved, pending visa number" state. You can pretty much be in this state for some time, and then when PD does become current (as happened from May through July this year with the significant shift in PDs in the bulletins) there will be a massive approval rate of all those pending applications.

This is how USCIS got through 60k unused visas in a staggeringly short time. There were a LOT of applications that were ready to go, they were just waiting for those numbers. USCIS didn't all of a suddenly quadruple their efficiency in processing :)

i've had an NRE account and the only way to put money is in $. you can then withdraw the money in $ or Rs, but i haven't heard of being able to fund it with Rs to start with.
i believe that students can also bring a much bigger chunk nowadays, maybe try that track.
also, if the $100K can be brought to the US each yr, why can't parents send it here as a gift, what is the deal with 30%, does someone know?

So just open the account and have them deposit the monies India, you can draw it here. This kind of account is for NRI's who earn an income in India and want to access it here.

Agree 100%. Atleast when Bush was in office there were bills introduced that encouraged skilled immigration Eg: Those who have been around for a while would remember the Cornyn-Kyl bill from 2005.

So we may see good things happen after the November 2010 elections if dems lose majority in both house and senate. Best way to get more immigrants to participate in advocacy efforts by immigrationvoice.org for legal immigration is by communicating to international student organizations of various universities around virginia, maryland, washingtondc,west virginia north and south carolina. Arranging busses for the students is not a bad idea. Oregon DMV is little lenient on this matter, but they see only the expiry date on Passport visa stamp. Oregon will issue license till one year after expiry date on the Visa stamped on passport in conjunction with the H1 extension approval notice. So all these original H1 extension approval will not be considered if passport visa stamp expired more than a year. We have to go to Vancouver, B.C to get visa stamped and come back.
California accepts the I-94 extensions in the H1 extension approval notices (That's 3 years back, but they keep on changing rules every month and the California DMV services are not fast enough). Also some times the information from USCIS will be hanging if you have extensions. But if you go out of country and come back with fresh I-94, the information is validated within 5 minutes electronically. DMV staff are more considerate in California.

Why not? Although I have applied for GC, I have no desire to take US citizenship, just to let you know. The majority does not mean the whole world and also does not mean everyone. There are Indian citizens that love India. Parents should be able to make decisions for their kids until they are 18. The kid can take US citizenship when he is 18 if parents have opted for Indian citizenship.

No, they count MS REQUIREMENT FOR POSITION as 4 yrs toward total SVP time according to that doc link I posted. These 4 yrs include 2 for BS plus 2 additional for MS. It is how they count. Nobody knows or cares how long it actually took you to get MS.

You do not need a lawyer, I can guide you thru the process :) Yes, I know a few cases where plaintiff requested court to force the USCIS to issue EAD. Some people were waiting more than a year! Those cases were usually bundled with I-485 WoM. One case is well-known class action lawsuit Ngwanyia v.Ashcroft, No.02-CV-502 (D.Minn.). Government promised to issue EAD within 100 days for the class.

i am in the 3.a. situation. what does part time mean? can you really be working part time when you are a CEO, CFO, COO, CMO of a company? not that i am raising this questions... I want to continue to be in the 3.a. situation, but can the IO ask these questions? if i make revenue of $20000 (twenty thou) and profit of $2000 a year will that be considered enough for IO to think that my intention is to switch to my company after green card and hence no intention of continuing permanent employment? or is that number higher (or lower)...

those who were at the advocacy day saw the amount of behind the scenes efforts IV core and coalition partners are putting in. We are lucky to have folks who have a deep understanding of the politics in DC as well as public policy. So I am sure that from a lobbying and advocacy viewpoint with lawmakers in DC...the best is being done.
It is up to our members to meet with local lawmaker offices and push our/IV provisions so that the DC offices get pushed from the local offices as well and there is a more well rounded awareness/understanding of what we need.
It is not a question of whether lawmakers know what we need..it is a question of making enough noise and frequent noise so that our provisions are constantly on their mind.
Reading the article that a member posted a link for the other day...where there was mention of how thousands of FAIR and NumbersUSA members clogged DC lawmaker office phone lines against CIR when it was brought up in 2007, shows the reality of the situation and on the other hand how naive our EB community is.
I don't know if IV is already doing it...but we need to meet all these lawmakers who are considering immigration reform....get the details of the bills they are proposing....see what the common benefits are...and help them to converge toward a unified bill that will help all.
A difficult task ....but it needs to be done if we have to have any hope in passing some meaningful legislation.

I agree with jonty and nixtor...that was the point I put out as a counter during our discussion. But the underlying sense is similar to what is there for illegal immigration: border fence. Humanitarian grounds is not an excuse you could use it with Congress men and women. Revamping Maths and Science in US schools is the exact justification against highskilled_immigration. Just like the border fence for illegal immigration, I wonder the issue in waiting against our efforts for fixing retrogression of highskilled immigration would be 'Show US born could start their training and educaction first' ...
