EB1 is more qualified than other categories and is seen as someone who is in a better position to contribute to the national welfare of the country. EB3 is the least qualified of the three and is also the most likely candidate to displace an American.

For such people, there is a provision to upgrade to EB2 through interfiling - as option that is being heavily used even as we speak. So where is the problem? I am talking about a person (like 485mbe - the one who has posted next to yr post) who has a PD of 2001 ..I am not saying that they should give Eb2's quota to EB3 ..but they should try to pull the category that is worst affected..or atleast give EB3 something ..
my question to you is ..say in the year 2010, would u support a situation where all categories are current or at 1 year difference ...while a particular category (eb3 I in this case) is at 2001 ??.. even if you do ..my feeling is that USCIS will try to pull EB3 - I (if something like above happens)..but then they are just a govt agency ..and in the end they are similar to govt agency in India ..only difference is that maybe little better

When I applied for my labor , Even though , Ad is given for B.S and 7+ years of experience, My employer told me that My labor is applied on Eb3.
After my labor was cleared, when applying for I-140 , we had to change the attorney.The new attorney applied I-140 in EB2 category.
when I asked the new attorney about this , she informed me that , since I have got B.S and 10+ years of experience, I am eligible for EB2.
since I did not get to see the Labor clearance certificate, I dont know on what basis Labor is cleared.
Now I am confused whether I am in EB2 or EB3.

this is my 10th year in the US & never had a single incident along the racial lines.. probably I lucked out.. However, I don't subscribe to this opinion of removing moustache..... Disagree, the reason you see lot of cases with (older PDs but later RDs) still awaiting approval is because when the PDs were current these cases were still not ripe (e.g: they were waiting name check clearance)....

My argument was on when your file will be looked at the first time. Of course, to get visa number numerous conditions, such as PD Currency, name-check, various documents, etc., have to be met. What I meant is that your file will be looked at the first time, only after cases physically received at the center reviewing your case (no matter what RD is shown on your receipt) before your case was recieved, have been looked at.
Thus, even if you name check is cleared, your PD is Current, and you provided all required documents, if there are cases physically received before your case was received (no matter what RD is shown on your receipt) which are still to be looked at (at least once), your file will not be looked at.
Note that when you call Customer Support, they recognize Receive Date what you see in your online status as "...your case was received on...", which may be quite different than RD on your receipt.
Processing Dates published in monthly reports for each center are manually entered by their staff, and do not tell whether those dates mean "no case is pending older than this date", or "at least one case has been dealt with past this date", as the truth is something in between.
Of course, internal processing and handling of physical files could be anything but known to the outside world. For example, it is possible that an officer was given a bundle of cases to look at, but then he/she proceeds on leave for 4 weeks, leaving them on desk to work on his/her return.

Need your valuable advice on this serious issue. Involved in shoplifting case, got arrested and plead guilty. Served the community service, and paid fine. Got the �Court Disposition Document� which states that I am all clear. My status is I-485 pending and have EAD, AP documents.
1. Is it safe to travel to India and come back on AP?

This will be a class action lawsuit which means that all the people who are in the same class as the plaintiff will get the benefit of the favourable decision. Now on whether to file or not, it is an individual decision but most of us have already prepared for the filling so there is no harm in going ahead with the filling. The worst will be to file again but nothing more than that can happen and as I have heard most of the attorney will not be charging again when people will be refiling their cases. So better to file your case and let USCIS reject rather than feel sorry later on if the judge rules in favour of the lawsuit.

Last year when I converted my out of state DL to a NYS DL, the DMV gave me a 5 year valid license (expiring on my DOB on 5th year i.e. in 2011) but on the fornt of the DL mentioned in BOLD RED the epriery of my I-797 date as 'TEMP VISITOR EXP.'.

I recently got an RFE to prove that my Master's degree is a three year course (and not a two year program) because the degree and the combined three year transcript don�t specifically state that it was a three year program.
I have three year of Bachelor�s (BSc) and three year of Master�s (MCA) education, which was used to qualify for EB-2. I also have more than 10 years of experience in a related field.
Unfortunately, I only have a combined three year transcript with a list of all the courses completed as part of program (Year 01, 02 and 03) and not three separate transcripts for each year of the program.
I also have an education evaluation to prove that it is equivalent to MS in USA, which was submitted with the original application.
I recently obtained a letter from the University stating that it was three year degree program with year of joining and completing the exam but my attorney strongly recommends on getting transcripts for all the years individually, which may not be feasible to obtain in a timely manner. She is not willing to do a fresh education evaluation and to respond the RFE without transcripts of each session/year.
I know lot of my friends have successfully got their I-140 approved with a combined three year transcript from same University.
What are my options? I need a second opinion and a possible representation, if required.
