Why Skilled Immigrants Are Leaving the U.S. – Business Week March 3, 2009
Earlier research by my team suggested that a crisis was brewing because of a burgeoning immigration backlog. At the end of 2006, more than 1 million skilled professionals (engineers, scientists, doctors, researchers) and their families were in line for a yearly allotment of only 120,000 permanent resident visas. The wait time for some people ran longer than a decade. In the meantime, these workers were trapped in "immigration limbo." If they changed jobs or even took a promotion, they risked being pushed to the back of the permanent residency queue. We predicted that skilled foreign workers would increasingly get fed up and return to countries like India and China where the economies were booming.
Why should we care? Because immigrants are critical to the country's long-term economic health. Despite the fact that they constitute only 12% of the U.S. population, immigrants have started 52% of Silicon Valley's technology companies and contributed to more than 25% of our global patents. They make up 24% of the U.S. science and engineering workforce holding bachelor's degrees and 47% of science and engineering workers who have PhDs. Immigrants have co-founded firms such as Google (NasdaqGS:GOOG - News), Intel (NasdaqGS:INTC - News), eBay (NasdaqGS:EBAY - News), and Yahoo! (NasdaqGS:YHOO - News).
Educated people leaving the US – Why?
More opportunities overseas
Economic disincentives – spouses and dependents prohibited from working
Institutionalized discrimination – hate groups like FAIR are given voice in congress (i.e. stimulus)
Extremely onerous bureaucracy – 10 years in US and no path to permanent residency (professionals, bankers, educators)
Indentured service
– workers cannot leave employer without facing deportation or illegal status
– including professionals
– employer holds too much power
– employees cannot complain or quit
– dependents must work illegally or leave the country to work
When people change jobs they often have to restart the process again from the beginning.
Solutions:
Canada example:
Permanent residency point system – points awarded for
- years legal residency (student, worker)
- family members in US
- education (more points for certain fields of study)
- proficiency in official language
- skill in high demand fields (petroleum engineers, medical doctors)
Work visas for dependents –
Eliminate restrictions on family members from working
Dependents of professionals are usually educated
Contribute more to US economy (example: work as substitute teacher)
Pay more taxes
Example of a skilled dependent who is not able to work.
“My family moved to the US in 2002. Before that, I and my wife were working in Malaysia. My wife has two Masters Degrees in Science. Once we moved in, I have been trying to get GC. All this time, my wife has been in H4. She has tried her best but could not land a job with H1 sponsorship as no company in her field that she tried is familiar with H1 process. All these years, she has been highly stressed due to this. People may think she must have known this before coming in. But, at that time, the average GC wait was 2 years.”
Other benefits of immigration reform to US economy
Stop reverse brain drain – US universities educate people who are often FORCED to take their skills out of the country
Support housing market – many immigrants hesitate to buy a house because of their uncertain status, but skilled immigrants tend to have healthy incomes that support home ownership.
Scrap diversity visa lottery
– does not attract skilled people
– Already have country limits for green cards
Why bring more people to US and then force people who are already here and have shown a dedication to the US to leave?
To prevent employers from abusing workers: Allow people who have work visas to change jobs without having to reapply for a new visa (up to the original expiration date) and restart green card process.
Bureaucratic Issues
Backlogs in processing going back as far as 7 years or more: some have suggested that they would rather be denied a visa than wait so long. That way they can at least plan for the future.
Immigrants from most countries need to leave the US to get their visa stamped even when their visa has been approved and they are already legally in the U.S. The reason for this is unclear, but it causes economic hardship to immigrants who are delayed and risk losing their jobs.
Every year visas are unclaimed, often because of processing delays. Employment based immigrants have been asking for these unclaimed visas to be reissued to people who have been waiting years for their applications to be processed. The issue is reducing processing time, and they see visa recapture as a way to reduce the backlog.
Many immigrants have complained about the long time processing their applications for a green card. They would like to see automatic qualification for professionals who have lived in the US for a certain period of time (5 or 6 years).
Clearing the GC backlog and making it easier for skilled professionals to get permanent residency will encourage investment in US whether in the form of buying a house or setting up a business etc, because it allows immigrants to plan for the future.
Having no time limit for processing applications is inefficient and does not ensure accountability. Business projects and other processes need time frames to ensure they remain on track and that employees are productive. Government agencies need to be held to the same standards.
Applicants need to be able to access information about their status, which should have clear timelines for each step and show clearly where they are in the process. This is the only way they can plan effectively for the future.
Many people who have been in the US legally for more than 10 years but can’t get permanent residency. They are eligible for SS, but may be forced to leave the US with their US savings, assets and SS benefits. These people would like consideration of a fast track application.

I have an infopass appt on Aug 19 as I pass my 90 days .Can you please tell us your Infopass experince ? Hopefully this would help me and others in similar situation.
Hey indian111, see my previous posts for the infopass exp. Just to give you a gist, it was a useless appointment. They did not offer me any kind of help. After reading through different forums, I have noticed that there were quite a few CPO emails yesterday for people filed within the same time frame. So I think the infopass appointment did not in any way impact the decision. This is just my assumption.
But I would definitely have the infopass done and then go to the local congressman or senator office to get things resolved.
That was my original plan too. I never expected miracles to happen with the infopass appointment. That would have just given me an additional proof on my part to show that I was diligent in getting the issue resolved

No. It was changed in the middle of 2008. The DOS consulted with the Congress on this and came to the conclusion that there should be horizontal spillover before vertical. I don't want to go into whether this was right or wrong, fair or not. This is the current policy.
You can see ample evidence in the annual visa allocation once you compare 2005/2006/2007/2008 allocations. EB3-ROW and EB3-ICMP benefited till 2007 because of vertical spillover and EB2-I & EB2-C have been the beneficiaries of the horizontal spillover policy since 2008.

I don't know that much about immigration and what I do know, is blurred by the amount of information out there - that said, I do think that a bill that represents the people contributing to the betterment of this county by working in their specific fields is a good thing. And it gives way to a cleaner system to evaluate immigrants. I would rather have heard a no in the beginning than be approved and sit around waiting for the forseeable future.

Anyone received payment processing errors in the last couple of days on the E-File website? For some reason, while trying to complete payment for my AP e-file, when I try to use the credit card option, I keep getting an error that the e-filing payment processing server is unable to process payments at this time. I have been trying every hour for the last 2 days...and the stupid USCIS Customer Service number has no options to report this error...

EAD has nothing to do with travel. your AP is your travel document. make sure BEFORE you leave the country you have the AP in hand that is valid on the day you re-enter the country. if you currently have an AP that expires after your return date, then you are good to go. even if you file for AP revewal now you must have received the approval BEFORE you fly.

I have applied for birth certificate at Indian Consulate, SFO and received from them. They simply attested the information on my Passport on their letter head..will that be sufficient or I should get it from MRO/etc from India?
Per my attorney- Date of birth info provided my anyone but the local municipality is insufficient and won't be entertained by the USCIS. Unless you and your attorney are willing to try your luk with the RFE, I'd suggest that you get the birth cert from the local authorities.

I think Kerry(i think it is actually Kennedy E who introduced it - SA180 , SA 187 did not have anyhting to do with us it was for Women centers) di dnot have any good intentions for us in troducing this.If you see on Thomas(or congress.gov and search for HR2, see the fourth version, and check out amendments), SA180 was amendment to SA143 (this is by our friend Jeff Sessions). So most probably it was part of politics. Also this status says both these amendments wer eintroduced in Senate but thats it, they did not pass.

Got current twice after that but no luck with GC
Finally greened on 5/4/2011
Did not get any RFE. Last SLUD was Sept. 2010. No activity after that. And today got the CPO emails and SMS messages.

My Husband and daughter appeared for the interview on Dec 6th 2006 but they were given 221(g) blue form and were asked to drop the papers in Hyderabad VFS office and it was clearly mentioned not to attend personally
As per The 221(g) form , they dropped passports and my original I797,I129 and all supporting documents including my original H1 papers and marriage certificates on Feb 20th 2007 , After 4 months on July 3rd 2007 we got a mail from ChennaiAF@state.gov to appear for interview on any Monday before 9 am with Passports and all other supporting documents but we have already dropped all the documents including passports in Hyderabad VFS drop box and it have been couriered to Chennai US Consulate through them.
I mailed to US consulate to suggest whether they can appear for the interview only with this mail printout but I haven’t got any reply and also my husband talked to customer representative they said he can come with the mail print out as they already dropped their passports . My husband and daughter reappeared for the to US Consulate Yesterday July 23rd 2007.The security people didn’t allow him inside since they don’t have their passports my husband showed his Identification card and printout of the mail from ChennaiAF@state.gov and they allowed my husband but not my daughter as she doesn’t have the mail or identification card. She is 4 yrs old and we already dropped her date of certificate and passports in drop box along with my Husband papers.
Finally after a long conversation they were sent inside accompanied by an Indian officer. But when he explained his case to the Indian officers they said that they were not aware of the mail from ChennaiAF@state.gov and finally he was sent to interview and US consulate officer said that his case is still under process and they were sent back again

May I know in what respect multi-national execs are inferior to researchers?
What classifies as a multi-national executive? Is there a set criteria like they have for researchers i.e. quality of papers published, cited and reviewed by peers, impact of research etc.
To answer the question : Does a person with a BS + 6 yrs of experience (the quality of which is questionable at best) equate to a person with several years of quality research (yes the quality of research is a determining factor), I think you might want to ask yourself: If you had your own company who would you hire? Unless you are running a Ponzi scam show of course.
What classifies as a multi-national executive? Is there a set criteria like they have for researchers i.e. quality of papers published, cited and reviewed by peers, impact of research etc.
To answer the question : Does a person with a BS + 6 yrs of experience (the quality of which is questionable at best) equate to a person with several years of quality research (yes the quality of research is a determining factor), I think you might want to ask yourself: If you had your own company who would you hire? Unless you are running a Ponzi scam show of course.
