Recently, one of my co-worker who was on L1A, requested an extension of his Visa. His employer filed for an L1B instead and did not inform him until after filing it. Now USCIS has sent an RFE. Does anyone know if this can be grounds for rejection of his Visa? Is the employer legally correct in filing a changed Visa category at will without informing the holder? His wife is unable to obtain a driver's license since the Visa approval is pending. Does anyone know if this can be addressed? If so, how?

169000 out of estimated 12 million is actually more than 100 times what you show it as 0.01%. It is close to 1.4%.
He got his quotient right but forgot to multiply it by 100 to convert that into a percentage!

There are two sides to the issue : strengthening the domestic workforce through education, research investment etc and then there is skilled immigration. The first half no doubt enjoys unanimous support ... however, when it comes to promoting skilled immigration, it is a pretty safe bet that the anti-immigrant lobby is going to play hard ball (already evident from the SF gate article). Overcoming this lobby is the whole challenge ..

FYI...Anybody who has an appointment for a Visa stamping on Oct 1st at the U.S Consulate in Chennai, India, please contact the VFS office (91-44-4231-6767) to find out your new date of appointment (which the Consulate says, will be in the same week), if they have not intimated you by email already.

I went to local office yesterday. She sent mail to service center about the change in the name to have full first name for my 485 and 131.She also asked me to send letter to service center before they approve my 131 application.

I'm with Michael on the lizard shot ... maybe it's the disconnected rear foot that makes it look odd.
I REALLY like the water lily shot, Josh. The composition is beautiful, with the other lily pads forming a "circle of circles" counterbalance to the flower. Very, very nice ... in fact, probably my favorite of all your posted photos. (not that I have anything against the others)

Hello, I've been offered a job and have less than 180 days since applied for I485. I have EAD document thourgh my wife as well.
In case I accept the job offer do I need to withdraw my pending I485?. If will work part time with my current employer will my application be affected in any way?

You can change the job peacefully using AC21 since your 485 is pending for more than 6months. Your labor position/location etc doesnt mater. Your current employer cannot do anything but you need to get a copy of labor and I140 from him to use AC21. Also your next job should be same or similar to the one in the labor certification. Hope this helps.

I don't think anybody ask for an EVL at POE! And even if they ask, there are no 'format' requirements. If you want, you can just take a standard EVL mentioning your salary, duration of work and title - that should be it.

I have completed 3.5 years of my H1B and am looking at the possibility of applying for GC either under EB2/3.
After my 12th, I did a 2 year Diploma in Business from Australia and then did a 2 year MA(History) in correspondence (open uni) from India and also a 1 year PGDCA by correspondence.
I have more than 10 years of IT experience to go with my 12+2(fulltime)+3(correspondence)years of education.
Questions:

The challenging thing here for your attorney is to provide proof that you have ABET 4-yer bachelor or equivalent degree before filing i-140. Even EB3 is going to be challenging task. Remember H1B requirements are different from EB green card.:(

The USCIS provided further clarification and instructions on I-140 premium processing following the initial announcement. They listed three types of cases that are not eligible for premium processing, even if they are within the EB3 preference category. These are:

I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.
Short answer is NO.
You have to file a new PERM and it will be processed in the existing processing times unless its a special handling case (University profs, etc) which currently is taking around 4 months to get a PERM approval.
