The situation is the same. In my case and of course in most of others too, what he/she said is correct. Waiting for Eb3 to cross 2001 has become a difficult thing. If I started an EB2 app rather than hoping positively, I would have finished my wait for GC.
Ever since retrogression started the dates have not crossed 2001. 245i or not, the backlog is a fact. Sad part, when there is action items from IV, trying to talk to my state members, I have realized and been told that IV does not cater to EB3 anymore. It is disheartening how much ever I try to explain, occasional members look at IV threads like EB2-EB3 predictions and say there is no hope for EB3 and also IV has no answer to it.
I tried my part...too bad I was not able to participate in the IV advocacy day due to family emergency. anyway, let us hope IV's persistence yields us the results. My heart goes for a lot of EB3s who may automatically qualify for EB2 just due to their experience.

These are people who actually took action to do something positive instead of just talking. I wish you were able to participate in the event - you would have known the facts instead of half truths.... Hope whatever the emergency was taken care of - maybe you can participate in the next event yourself......

I have a BC which is issued on 2004. Do I still need 2 affidivits? My Lawyer didn't ask me to gather affidivits. Any thoughts on that?
Did anybody filing through FDBL? Any idea how long they are taking to file once they have all the documents and papers?

This is just my lawyers opinion, If the BC was issued/date of birth registered is after 1 year of birth, 2 affidavits are required.
Also, getting a affidavit made is fairly simple as it does not involve any governmental agency. It is a good idea to notorize it and have it on a cheap stamp paper.

If you think any fraud is going on or there is a law being misused you must complain to USCIS and Ombudsman. Unless it is reported nobody in a position of power will know about it and nothing will be done to stop it.
And this should be done sooner than later. If we keep quiet about this like everyone did for labor substitution, we are the only ones who are going to suffer. I came here in 1998 and did my MS and have been working like dog all these years. Have faced layoffs, exploiting by DCC, had to refile my GC and now these fake EB1 guys come along and get GC in 6 months.
Trust me, I will be reporting the company that I have heard of the case to ombudsman and USCIS. And I think everyone who has heard of this should verify and then report it also.
Lets start this campaign also because in the long run, it will benefit both EB2 and EB3.
And genuine EB1 guys dont have to worry about this because if they really do have extra-ordinary capabilities they should not have hard time proving it (so called Multinational executives)

Nola - Do you have any recommendations for a fuel belt?. I need one of these really soon. I need one which does not bounce while running and has enough space for 20 oz of water, a cell phone, keys and something that is really light.

OUT OF THE 300,000 people stuck due to retrogression, only 8500 OR SO are IV members. Out of which not even a 1000 want to commit for minimum of $20/ month. Right now we only have some 120 people committed. That is really a shame!!. Then we find a few (5 or less people) asking what is IV doing with the funds?. What funds?

Now that we have the pending data from USCIS, we could create an persuasive and execellent presentation to show USCIS how EB3 I will never move even if more visas are re-captured, unless and until the spill over is used for EB3 I also

I think it will take almost a month before there is significant number of members who sign up for recurring payments. So, keep it up and spread the word.

We dont really have a month. The work on the bill is happening even now behind the scene. We wish to put in more resources and plan for more resources in the coming months. We are still getting a lot of bounced messages. people have given us email ids like abcd@abcd.com. Well, to such people we say that they will not be hearing any announcements from IV when we send a newsletter with announcements. And sometimes sensitive information will be given by phone or to contributing members only. So all must update their profile with full information and signup for recurring contributions. We may not make sensitive updates public on the forum. This will be an incentive for people to sign up for monthly contributions.
