Don't bother to ask anything about CP for people just don't care to respond!

I have tried enough on every forum including this (even whe we need a genuine information and not just predictions).

No one to be blamed! But relax, there will be a time for CP guys too!

Maybe people are not responding on the basis that they do not have any knowledge of consular processing.

I think majority of people on this forum are in the US and are adjusting status. Surely you would not want answers that were wrong or misleading.

Quite possibly, provided the I-485 remains in pending (unadjudicated) status for at least 180 days. It is the I-485 processing time that is important, not when the beneficiary changes positions. This is because the "green card" (GC) is based upon a future job offer. The person is not required to have worked for the GC-sponsoring employer prior to filing or obtaining the GC. Accordingly, it appears the AC21 law did not intend to change the prior law, which only requires a future job offer with respect to the GC sponsorship in employment-based cases. Please refer to the disclaimer at the end of this page, since, at the time of this writing, the regulations have not been published.



Question 3 : I never worked for my sponsoring employer. It was a future job offer. Can I use AC21 portability? TOP

I had bought a house 2 years back thinking that i will sell it after couple of years and make money. I know many people might have done that. I didnt knwo that having a house will become a burden for me wrt moving to a different place in search of a job. I do see jobs in cities outside my state and was thinking of applying for those jobs. My problem is that if i sell my house, i will have to pay from my own pocket.
Having a house in this market has become a pain as it has made me immobile with respect to good job offers.
I was thinking that incase i find a job in a different state and cannot travel back home frequently and also renting is not a good option then should i leave the house to the bank for foreclosure?
Will this affect my GC process. I have no plans of buying a house in coming years.
What might be an outcome of foreclosure, keeping in mind that i am wiating for my GC process.
If anyone had an experiecne like this or may know someone, please share ur thought..

My I485 is pending since October of 2006. I had a RFE for medical in april of 2007 and replied quickly. Since then there is no movement in my case. I contacted USCIS several times and they told me that my name check is pending...

dude, how many immigrants/H1/L1/GC/Gc->US citizens work for google/Msoft/Yahoo. And if you are naming these corporations as the benchmark of success/technical excellence why do you not listen to what they say about visa programs?

In addition why have these companies set up big shops in India. Although the innovations didn't happen there and there are several valid reasons for that, but just the fact that they have big footprints there means that they are able to find talent there.

Hi,
This thread (forum as well)seems to be really enthusiatic abt the immigration reforms.
Keep it up! I am a new member to this forum who had been passively following the S1932 disaster on immigration.com forums.

Hopefully things may look better with the new bill sponsored by Arlen Specter.
The bill looks good but how do we know that it is this bill which will be discussed and not the other bills sponsored by senator hagel,mccain etc..
Question is even though this bill seems to be a consolidated effort of all the previous bills how can we be sure if this is the bill which will be discussed as part of immigration reforms in feb?
Also this does not have any clause for applying for I-485 before cut off date?
So the people who benefit through this bill are probably the Masters/Phd who can automatically adjust their status and the people who have not even applied for a GC ( since no labor cert required).

But for people who are stuck at their 1-140 waiting to apply for I-485 the only thing this bill helps is increasing the EB quota.
I am a EB-2 applicant (masters) and would strongly support this bill but i don't see how it helps EB-3 applicants as much unless we have the clause for applying for I-485 before cut off date.

Even though there is a draft available about this bill, what gets included and what does not, is all up for debate yet. So no one really knows how this bill will look like, come Feb. That is why we are in the effort to have as many proosals that benefit us , be included in the bill.

I agree with you on this, there is some truth to this that there could be delays when there are multiple filings. In fact this is the first time when USCIS has to deal with so many multiple filings, a very few lawyers have any direct experience with it. From USCIS Standard Operating Procedure, there is a mention of "second filing" (not duplicate filing) in the following places:
1. Procedural Overview (Page 4)
2. File Review (Page 46)
3. Interview Waiver Criteria (Page 185)

From the link above:
In (1) and (2) above it says second filing should be handled under the normal process. Although if different A# are assigned case goes to CRU (case resolution unit). But if A# assigned are same, you are more or less processed like a normal case. The last part (3) interview waiver criteria, multiple filing is mentioned as one of the deviations from interview waiver criteria but it NOT the interview criteria itself. In the end processing time for multiple filing is very much up to the discretion of adjudicating officer. Also, I didn't find any reason to believe that there could be issues with security check with multiple filings.
I think all of us multiple filers can breathe easy if our cases are filed clearly with full disclosure of information without any intended willful violation.

I am a multiple filer too, my I-485 application filed in early June was approved last week. I hope this gives some reason for optimism for us multiple filers. Good luck to everyone. BTW: I am still a contributing member and will continue to hang out at IV.

Where did I say that american's gave better advice than desis. I was just trying to compare mentality of two diff community for a same situation.
I m not asking for personal opinion as to how u feel when someone foreclose.I m asking for an advice as to what r the consequences

When you ask for advice, you need humility. Not call others stupid, when it looks like you made the same mistake. You bought a home which you were in no safe position to afford. There are people who didn't buy because they saw what was coming. Can these guys call you stupid because you didn't see what was coming? I don't know why my tax dollar should be used to bail out guys like you who are/were irresponsible, while I patiently rent out this mess caused by you guys? :mad::mad:

Why this is the news is good and relevant from the point of view EB provisions?

Because EB provisions (section 8001) were thrown out of S.1932 because of the differences between key players over the Patriot act. Now that this is out of the picture, at least there is one less thing to worry about.

No more 1 year multiple entry TV. I was issued only 2months multiple entry with visa expiring just after 15 days of my return.

With all due sympathies, this is one of the funniest posts I have read in a long time....It helps to lighten up a bit every now and then considering we are all in this for a long haul...

Anyway, just wanted to let you know that I went through London back in 2004 and my experience was completely different. I went to the NYC consulate to get my TV for $50, yes just $50 and the whole paper work etc was done in less than 30min and I had to go back after 2 hours to collect my passport with a 1 year multiple entry stamped on it.

My point being, I think they have changed a lot of rules and made it more stringent after the recent security threats etc.

Getting a GC soon is our saviour

Can you add a dependent after your 485 is approved?

my lawyer said yes, the important things are that:
1. you must be married before teh I-485 is approved; otherwise the dependent needs to be sponsored under family petition etc. However note that in this case the dependent would be starting his/her I-485 at that point (when you are already approved) so will 'catch up' to approval later (and if dates retrogress, then the dependent is 'stuck' longer, without GC, while you will have your GC and all related benefits (ability to stop working, change types of work etc))

2. the date needs to be current for the dependent to file, but the fact that you got approved means that your PD is current (as you can only get approved when your PD is current)


Also, if I become a beneficiary on my wife's application, will I be able to maintain my H-1 status, and keep on renewing it?


yes you can continue on your H1


My wife and I are now leaning towards independent filing, with no beneficiary for now.

we are still undecided, same boat. Warnings from some attorneys (as Pappu has pointed out above) are making us think of filing independently, with teh risk that one person gets GC first and the other would than tag along maybe an year or whatever late depending on how dates move/stay.

what do your lawyers say about multiple 485 filings?
