Hi,
Regarding A# on I 140, if you've missed that in your 485 application, it's no big deal as long as you've sent a copy of your I-140 approval notice that has the A# mentioned in it.

The employer has to always pay the H1B fees.
I know govt said anything regarding labor certifications etc are now only to be paid by employer...
what about fees related to extensions of h1 b? can i still pay for it or it's employer who has to pay...cause knowing my employer i know they won't want to pay and i wonder what options i have.

Have a question related to that:
If job / EB2 stipulates Bachelors + 5 years criteria, does it imply 5 years after obtaining the degree or can the experience be cumulative ?
From what I know the 5 yrs are after obtaining the degree. Your job responsibilities should increase in those 5 yrs. That is why when people try to apply under EB2 with Bachelors + 5 years criteria the experience letters play a big role. On the other hand when people substitute the Bachelors + 5 years criteria with MS and a few yrs experience all they need is the degree and a letter from the co-worker that they worked there without having to spell out the job responsibilities.
Having said all this, I might be wrong as I'm not a lawyer.

Even if they do issue an update today..so what? It means nothing. NSC issued an update it finished receipting July2nd filers 2 weeks back, and even today July 2nd filers get checks cashed.....

Hello All,
My wife's AP was sent out on NOV13th according to online status and we didnt receive it till now and I called the USCIS today and the rep we didnt receive it back as undelivereable & once its once out of our office its not their concern & told re-applying is the only option.
Issue?: My wife went to INDIA and she is on L1 and I was wondering when I re-apply her AP here, can she enter while her AP is pending approval ?
her L1 is valid till June 2010.
What are our options, please advise.

Since EB-1 does not need labor certification, the process is completely independent of EB-2. As such you cannot "port" your EB-2 application the way people transition from EB-3 to EB-2. You will have to apply directly to USCIS with evidence of your "extraordinary ability" in your field, such as honorable membership of professional bodies, research track record, letters from well-known people in your field etc. The first stepto convince USCIS about exceptional ability is very involved, but there on I-140 and I-485 should proceed far more smoothly than EB-2.

But my lawyer chose this. and I already signed the form. Does it really matter? As he stated " Spose has an approved I-140"
I'm sure you'll be okay. All they want to know is the basis of your eligibility for filing I-485 and choosing (h) and adding this explanation should be fine.

You need to have PT license to work. Every state has different rules, there is lot of paper work involved to sit for license exam. For Indians, mostly it was easy for Michigan, New york. For present scenario better check physicaltherapyforum.com, very good info avaliable

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.
The H1B/L1 fees is designed to hit the body shopping business model. It is nothing but a
legal/labor cost arbitrage that most indian IT service shops follow.
The fees is not the last but the beginning and more will be piled on as they will come back again in a year or so to fund more "secure the mexican border" initiatives. It is a beast that can never be satisfied. The American It companies are not impacted by the 50% rules and they care less about it. So it the resistance effort will be very minimal...like it happened this time.

Political scene and policy making is mostly based on vote and voice more then TRUE reform. Always, be it India or USA.
Immigration-Voice is primarily for legal immigrants. Even though we input substantial economic value to the society, and to the fate of all of us the small legal/skilled people immigration reform is tied to the big CIR.
What I want to propose is to talking to other lobbing groups and immigrant associations.
Irish, Spanish etc... Today in the news the Irish Lobby for Immigration Reform (ILIR) made a big show and seems like they have got lot attention. Form senator Clinton to one time Irish Kennedy all spoke for Irish and CIR.
Also, Immigration voice is primarily supported by Indians and few other people from other nationalities.
In addition, I being an Indian like to propose bringing more attention and contributions to the situation by talking to local and north American Indian associations both professional and cultural.
To name a few...

Telugu Association of North America
American Telugu Association
FOGANA - Federation of Gujarati Associations of North America
Federation of Tamil Sangams of North America etc..
