I called congressman Hinjosa's office.
The staffer asked me where I am calling from. Then said you are not a constituent of the congressman and was not willing to transfer to the person who handles immigration issues. I insisted on leaving a message and he took the message, but was surprised, did anybody else encounter this? How do we handle this if it happens with other congressmen?

I think we should make a list of things we lost and found in D.C :)
The amazing thing is We Found all the things we lost. I found the same pair of glasses Twice! The owner managed to lose it again in the situation room and I found it again - I think he didn't like the glasses :)
Chargers and ties were lost and found. I think after working 3 days straight, without much food/sleep and thousand and one things on our mind - we too were lost :)

there is a third option. After 140 is approved, you may change employers (assuming 180 days since 485 filing are up) but still maintain H1 status by doing an H1 transfer. AC21 does not require the use of EAD. It is equally possible to invoke AC21 while still maintaining H1 status. Of course, it may be easier to use EAD for employers that do not want to sponsor H1 since you already have an EAD.

I think spillover method has not been changed since years. The only puzzle is that whether it is horizontal or vertical or combination of both that USCIS works with we exactly do not know.
Do you guys agree ?
In my opinion equal share of spillover count to oversubscribed EB categories for a particular year would be the final and legitimate solution.

I talked with my lawyer yesterday, was informed that American immigration lawyers association (AILA) is filing for a class action lawsuit against DOL. There has been about 40% cases that are getting audited in Atlanta center. But after replying to queries, the center is not responding on a timely basis. There is light at the end of the tunnel.:)

Sorry to hear about your husband susie. Inspite of your grief, you have the courage to take up this issue which will benefit a lot of people. My son aged out before my labor was approved. I filed for labor in april 2001. It was approved in 2007. My I-140 was approved under PERM and I filed for I/485 in May 2007. My son aged out in August 2006 Thanks

Look my friend, there is no logic like RD vs PD. If there were I would have had my green card before most here even filed their 485s. My 485 is pending for over 4 yrs now.
I have had people with PDs after me, RDs after me, all sorts approved and I am waiting.
This is a game of luck and chance.
The USCIS process is chaotic and disorganised in the way they do things. If you are lucky you get your approval earlier, if you are not, your application languishes in some salt mine in Utah or wherever else NSC stores their pending applications.
I think I saw this in one of the ombudsman's reports to congress. A certain percentage of files are misplaced/lost every year. I have a sinking feeling - mine could be one of these. If so, I will have to wait until someone at USCIS stumbles on it :-). I agree completely with you and there is really no way to predict how USCIS processes GC's. USCIS incompetence is boundless.

For me the agony is endless. My deshi employer did not provide me the EVL in time though I was able to file in JUNE. They gave it to me after JULY 20th when I stopped sending timesheets.
I am personally not a big supporter of elimination of country quota. Don’t get me wrong. I fully share and understand the endless pain is being gone through by EB3 Indians/Chinese community. Increasing # of EB visa will ease some of their pain.
For an example there are 1000 IT processionals from India wants to come to US with H1/L1/B1. There are ample companies (say 50) owned by Indian and those 1000 IT professionals have enough opportunities to come to US.
On the other hand, for an example, from Ukraine, there are 100 IT professionals are trying to migrate to US with H1/L1/B1 but there are few to none companies (say 1 ) owned by Ukrainians and those 100 IT professionals have few to none opportunity to come to US.
My point is, there are more IT Indians in US do not validate removal of country quota.
Others should get a fair chance – NO MONOPOLY is desirable.
Also New Jersey has too may Indians living, may be one day, there can be revolution, and they might ask for a separate country. I am kidding here.

I sympathize though with non-IT retrogressed people, there isn't such a monopoly outside IT, so them getting delayed because of the presense of large number of IT people from their country may not be fair.. Then again what's fair about indian born in india being retrogressed while indian born in kuwait is not.. We all acceped to start applications within certain rules, saying "not fair" and adjusting the rules at others' expense should only apply to future applications.

I was wondering if any one in the core or other members think about the next step towards getting citizenship after passing the hurdles of getting the green card. If a person is here for 10 years and then get his green card (average period), then he need to wait for another 5 years to get the citizenship. 15 years for this process in a person's life is too much.
IV Core can push or lobby for a law which can make the person a US citizen, if he is living in US for 10 years legally without any issues and paying taxes for the entire period. It is just my idea.
Further to this, the eligibility criteria can also include that we should have the full social security points (40 points) and a minimum contribution of $25,000 towards social security fund.

My wife is eligible for fling for AOS right now , however she has already accepted a position with different salary and designation with the same employer and asked the employer to file a new H1 b, I dont believe its been filed yet. We never thought the dates would be current in our life time
We are thinking of refusiong the promotion offer, however the boss is willing to helo keep the new job waiting for her and continue her green card processing in the current designation
1. I know you can change jobs after 6 months of I-485 filing.at that point can she use the EAD to work at this new job or she can only port the EAD to a similar occupation?
2. Other scenario is then have to a future job offer for the category that she has applied to green card through either from the same employer or a different one.. and asking for a H-1 B for the job with a higher salary?
3. If the spouse derivative uses the EAD can the primary applicant stay on H-1 b Status without using her EAD or is it going to be considered as though she used her EAD and hence no longer in H-1B?
