I graduated in Dec 2008 from USA and then returned back India. My F1 visa is valid till dec 2011 and am planning to come back USA for pursuing my phd. I got I20 from a different university. Do I need to attend for f1 visa stamping again ? . Please help .

Can i travel on my H1B and Advance parole (EAD) and maintain the same H1B when i come back to the US? I've heard rumors that I will be forced to use the EAD on arriving at the airport. Hence I will lose my H1B (They have been serving as backups to each other)
Here are some additional details:
- Currently working for a company as an employee on my H1B
- H1b doesn't have valid stamping (should i go that route and get that??)
- My 485 Pending. Priority date is Aug 2005 on EB3
- Indian Citizen but born in Africa (EB3 is Rest of the World)
- Have had my EAD for the past two years (havent used it).
- i switched over companies last year and ported the greencard process - AC21
- I have an expired Advance Parole i filed over an 1 1/2 years ago (never used it) and was planning on re-applying for it
- I've lived in the US for the past 15 years and have at no point been illegal.
- Planning to travel to Europe in June.

Hello,
I work for a very small company. Only 2 employees in the company - Me and my employer. We both do IT consulting.
The annual income of my company is less than $160K but this year it could reach upto $300K.
My question is - given the size of my company, if I file for Green Card, will my case stand for GC processing or probably will get rejected?
I am new to GC, so would appreciate any helpful suggestions.

Yes it is pretty much recognised for h1b purpose or for any other purpose whatsoever. I got my first h1b approval on the basis of my MBA from IGNOU.

i recently got H1 Extension stamping ( Till 2011 ) and also have AP Expires in Nov 2008 .
I am working on H1 and not interested to use EAD .Do i still need to renew my EAD and AP?

just a tip not cool to hijack someone else' thread. on your question: If you are planning on being with the H1 sponsoring employer for the next few years no point renewing your EAD or AP. However they are two seperate filings. You don't need to have a valid EAD in order to apply for an AP renewal or vice versa. Hope this helps.

I had a question about using using AC21.
Here is the scenario: Let us say I work for XYZ Brothers who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved what happens to my 485 application?
Wouldnt USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?
Please advice!

I am thinking of starting a company in partnership with an American Citizen. I currently hold H1B visa sponsored by my employer. If i start the company in partnership, can my partner/ my firm sponsor my concurrent H1B once the company is setup? My job will be quite similar to the job profile on my primary H1B.
I know the easiest is to be a silent partner, but in my case i might have to be involved 5-10 hours a week. So i understand concurrent H1B in my case would be the best. Any advise or feedback is greatly apprecaited.
