    USCIS record shows my entry year 2003 but actual year is 2005, so they came back saying 6 years is complete. Lawyer provided all the documents to prove I am here only from 2005...

    Still waiting...

    All, My employer who filed my eb2 application for green card was not giving me labor certification copy and 140 approval notice copy, he is a desi consulting company and as usual with desi company they were giving me tough time to get this documents. (You all know reason.. they think that i will quite). So what i did is requested USCIS to get my I-485 petition copy (remember that if you request 140 or labor copy directly they will not give because it seems that is employer's documents, i discussed this with couple of lawyers as well). since 485 is your application and these documents are mandatory you will get them.

    It took about 10 months to get the document with FOIA request (there is a queue as well).
    This is what i did

    1. Download FOIA form from uscis website.

    2. Fill up form and don�t forgot it get notary ( mention to send each and every page of petition).

    3. Wait for document...

    I will be happy to help anybody who is in same boat.

    Thanks. So if I-485 is approved, then all OK.

    What happens when there is a problem with I-485: Denial or NOID ?
    If denial, and in US, MTR can be filed and if MTR accepted, the period (from Denial) is considered as legal stay (even if not maintaining H1b status).
    But if denial, and outside US, you can NOT enter on AP. Correct ? Here only option to enter US is H1b ? Can MTR be filed ?

    Not really. If you see the late June submitters thread, many of us who applied in the June 20th timeframe have got their receipts. It took us 5 weeks to get the receipts from the date of filing.

    hello,
    Under certain circumstances, your International Student Advisor can grant a leave of absence for one semester for you. You need to get some paperwork from a doctor which will state that you can't attend college and why and for what reasons. However, this is not an easy case. Secondly, once you husband applies for I-130 based on marriage, this may violate your F-1 status as F-1 has purely non-immigrant intent and by filing I130 you show you intend to immigrate to the U.S.

    I tried to help my friend to transfer to another school when he was on F-1. A month after he transferred to the new school, the IS Advisor told him that his F-1 status has been canceled in the SEVIS system. Later, through FOIA he learned it was due to I-130 petition filed by his wife on his behalf a few months earlier. Conicidently, they canceled his F-1 just after the I130 approval. Luckily, his wife became a US citizen just few months later and he adjusted status due to that.

    I always advise to speak to an immigration attorney before taking any action. Thank you.

    Hello,
    I am working for a company A with whome I have gone ahead and resigned with them i also filed my GC and 485 is still pending with them and also have EAD through them, recently i got offer from Company B which i accepted and they have gone ahead and filed my H1 Tranfer but recently i got one more offer from Company C which is much better.
    What should be done in this scenario,should i again file for H1 Transfer through Company C or will it mess up my case even more

    Your parents can visit you for short trips as often as they like (within reason). But if they stay for an extended period (ie. the full 6 months stamped on the I94), then there is an implicit time gap requirement. In other words if your parents stay with you for 6 months then go back to their country and return to the US after 1 month, most likely they will not get a 6 month stamp the second time. In this scenario they might have plan their trip back to the US after 9 month or so. On the other hand if your parent stay with you for 1 month in the US, then leave for an other country and come back in 15 days, they should not have a problem with re-entry.

    you can enter the country even a day before your visa expires, but the main thing here is the i-94 stamp where the immigration officer puts the duration of your stay...it will be till your visa expiry date. so it is better for you to have an approval for the extension so that you can get to stay till the expiry of your visa. do premium processing or something, you still have time...

    In an interview on David Letterman (http://www.youtube.com/watch?v=xpvNXPPOMr8), actor Robert Downey, Jr., talked about a problem he had last year in Japan, when upon entering he was detained and questioned about his past criminal record. Downey said: I probably should have seen there was a sign that said 'No Felons Allowed' in English and Japanese and I haven't had that expunged yet," he said. "You can actually get things expunged but I've been pretty busy. So I was detained, I was interrogated. It was a blast.


    Haven't you settled up? Haven't you paid your debts? Letterman asked.

    Clearly I haven't paid my debts to Japan, said Downey.


    While I certainly feel somewhat bad for Mr. Downey, this short exchange gave the impression that nothing similar would ever happen in America! Hah!


    U.S. Immigration Law contains restrictions that bar entry to people forever, for virtually any youthful indiscretion they have ever had, e.g. simple possession of a marijuana 20 years ago, without regard to whether or not you were actually convicted of the crime! You do not even need to have been convicted; the fact that you admit you did it will also get you barred from entry. Heck you will even be bounced (http://www.markshuttleworth.com/archives/43) from the United States after overstaying your visa for one day, leaving one day late, and then trying to come back in on that visa. Or, you will be detained and returned because the officer thinks you MIGHT be working (http://addxorrol.blogspot.com/2007/07/ive-been-denied-entry-to-us-essentially.html).




    So, if you were watching David Letterman and thanking your lucky stars that America is far nicer to arriving tourists than Japan--think again!

    Remember in a marriage case....it is a 2 step process...Initially they get a temporary Gc and then after 2 years they get a permanent GC. So, she needs to see which GC is she getting before making any decisions.

    Also ask them to go for counselling....if they can reconcile...

    On June 9, 2009, U.S. Department of Homeland Security (DHS) Secretary Janet Napolitano granted deferred action for two years to widows and widowers of U.S. citizens (and their unmarried children under 18 years old) who reside in the United States, and who were married for less than two years before their spouse’s death. Deferred action is a short-term act of prosecutorial discretion that suspends removal proceedings against an individual or group of individuals for a specific timeframe. The action is temporary and it will not resolve an individual’s underlying immigration status.

    In addition to the deferred action, U.S. Citizenship and Immigration Services (USCIS) will suspend all adjudications of visa petitions and adjustment applications filed by widow(er)s where the only reason for reassessment of immigration status was the death of a U.S. citizen spouse before the second anniversary of the marriage. Further, U.S. Immigration and Customs Enforcement (ICE) will now defer initiating or continuing removal proceedings, or executing final orders of removal against qualified widow(er)s and their eligible children.

    Secretary Napolitano states that the deferred action is a “common-sense and practical” solution that will grant “these individuals and their children an opportunity to stay in the country that has become their home while their legal status is resolved.”

    Hi,

    Need advice from an attorney:

    My I-94 expires in december 2010. I have an approved Advance parole till Dec 2011(I485 is pending). Is it required to travel outside the country and get a new I-94 ?

    2. Is there a source on the Net that I can refer to that explains this?

    You don't have to travel outside. it is still legal to stay in the country.
