i upgraded on 6/19.no news yet. saw 2 times lud...
One of my friends who converted his I-140 to PP recently has got a response from USCIS saying that they will take 60 days instead of 15 days to reach to any conclusion. I am not sure whehter they av changed the rules under the hood but ready to announce it.
My I140 is stuck for almost a month now w/o any updates.

First of all learn to "conduct" yourself in public before working for the semi conductor industry. What is gulti mentality pls explain? Second of all you chose to come here with the constraints that were imposed on you, did you have the balls to question the immigration officer as to why your wife could not work? If you think this is hell my friend you are in for a rude surprise.
When you want answers for your question there is a method for asking it, pls follow that method and you will get your answers, there are more people willing to help here than you will find anywhere. Ranting about communities will get you no where, now apologize and ask your question, someone will answer.

There is no such thing as "invoking" AC21. Its a law. Most important thing is, your I-140 must have been approved and I-485 is pending for more then 180 days....you are Free to sail in the same or similar field.
Forget about option 2.

How about if I send in Ac 21 paperwork and still be on leave of absence from my present company which sponsored my GC. It only gives me peace of mind because in case the new job does not work out I can still come back...

If CIR is passed, many in the backlog will move to new merit system because their labor is still pending and no new GC application after May 21st 2007 also.
So, you have lot less people picthcing against 10% of 90,000 visas vs the case now where there are lot more people for 7% of 140K.
I still don't get why it is bad for everybody?
It is definitely little better for those who can use older GC process/system with 10% of 90K visa numbers.

Lets not hope for results just act. If Gandhi could drive Britishers out of India using this approach, USCIS is also made of human people and sure they will do something to lessen our pains.

My wife's EAD was applied on July 30th. She didnot recieve her EAD for 90 days, hence we took a infopass appointment and went to the local office on 92 nd day. They have informed us that they had sent a RFE on 88th day of filing and we need to wait for another 90 days after we send a response to the RFE.
Strangely the RFE that she got is for Birth Certificate which is not a required document for EAD.
I did not read anywhere that 90day count starts from the day when a response to the RFE is sent.

So gc101 would be safe if his PD becomes current before his file is pre-adj or get's stuck (!) in something like FBI namecheck after pre-adj. which might allow him time to add his wife's name.
So, what you mean is, I would be better off to hope that my name gets stuck somewhere in the namecheck or RFE or something for me to have enough time to get my spouse added in time BEFORE my I-485 gets approved. Did I understand it right?

The reason why most people end up with such situations is that the employers don’t file for H1 extensions on time. Though the law allows filing of H1 extensions upto 6 months before its expiry, most employers file for extensions only at the last moment. It’s advisable to go for premium processing in such cases, so as to get the approvals on time.

My PD has been current quite a few times since 06/2007. Last time when I called TSC, my NC was still pending. My FP was done during 07/07 and I heard from some one in this thread that FP is valid for 15 months only. So what should I do now. Should I go for an infopass and take an FP appointment ? Guys please advise.

You mean to say sell US real estate for GC/citizenship? I don't see this going very far. I can see anti immigrants waiting for this one. Best is to lobby using aides of big corporations, developing relationship with lobbyists who already have connections, hiring lawyers, developing strong case, donations in election campaigns etc. All of this needs loads and loads of money. Are we ready to donate to IV and build strong lobbying group for our cause? That is the only way to change our current situation.
Sending flowers, sending pizzas, sending all these proposals will only fall on deaf ears. Congress understands language of money to pass laws, Rest of the country/orgranizations understand language of laws/court.
For those who think assisting US economy by buy houses (for pending GC applicants) is like selling a GC are just plain dumb! No wonder why we dont have a resolution to the 10 yr waiting that's been killing EB immigrants, is because ppl like you, who love to take pain want others to live through this for the lifetime.
People have been waiting for 10+ years here waiting to get GC, waiting patiently, waiting so patiently that we are getting mentally sick waiting and waiting. How do u think the quota system is ..its not fair in the first place for EB immigrants when we are already here on H/L visas... . We the prospective, EB immigrants want to settle here. Its more than a home here already if you are living and paying taxes for 10+ years.. We just want to buy a house and a permanent visa status is only going to help. Its a win-win situation for both sides....

Most of us have good credit score and can afford to buy houses, this will only help the very thing that the govt. is trying to stabilize.
I'm surprised, how come IV is not aggressively pursuing this. What better way to help everyone here. If they want to address the fundamental issues they certainly can, but this the immediate focus and like quota recapture, will provide immediate relief to decades long wait for applicants!
So pls stop disparaging the effort. Its a good cause for both sides.
We want to be a permanent resident and contribute to US economy. So help us god!

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

my wife was out of status from mar 2006, her visa got approved on mar 2006. till mar 2006 she was on a valid f2 visa since i was then on a f1visa...i will try to catch hold of the employer...but i 'm not sure this will work out well..i want to know more about fresh visa stamping at chennai, india. i will give all my docs and i have been on valid status, while filing form ds 156 in the visa type column, i will have to mention her visa types, however they are not asking details or duration of the visa types...., i do not want to lie abt it. i want to know if they would ask her paystubs to prove her status here..this is my question,anybody has any Experience regarding the stamping please share...anybody who knows a nice immigration lawyer, please let me know, you can email me at s_7911@yahoo.com
