    Hi All,
    MY LC (PD May 2003) is still stuck in DBEC. So I may or may not be able to file withing Aug17th.
    My question is regarding the procedure used by USCIS to process AOS applications. It would be great if someone could explain this to me.
    These are my questions:
    1. Is the AOS application processed by RD or PD?
    2. Once USCIS starts processing the I485, do they check PD at any stage, or is it just used as the initail "gate " for allowing I485 application submission?
    3. Suppose Tom with a PD of July 2006 applied in July 2007. Then Harry's case gets approved by BEC in August 2007 and he applies in October 2007. Who will get the GC first?

    let me try to answer your question the best I can. Answers in order:

    For all purposes: lets assume 2 examples. Person A PD July 2006 and RD of July2, 2007 and Person B PD April 2006 and RD of July 2, 2007.

    1. AOS is processed by a "combination" of RD and PD. As per the current Bulletin BOTH A and B can apply. The Service centres are currently processing September 2006 applications. When they reach July 2, 2007 processing dates, both applications will be picked up and then "thoeretically" they should ask for Visa number for A BEFORE asking a visa number for B as A has an earlier PD.
    2. Answered in same question 1 above.
    3. If Harry's case gets approved in August 2007 by BEC he WILL NOT be able to apply for I-485 as the July Bulleting is valid only for applicants VALID in july. Just beacuse they are accepting till AUg 17, does not mean people whose LC got approved between Aug 1-17 can apply, becuase they were technically NOT eligible to apply in July.

    I am having hard time procuring a Non-availability of Birth record certificate(NAC) from my home city of Delhi. Is there a way around this? I do have affidavits from my parents.

    This NAC is holding up my application. Can we submit the document that you get in 10th grade with date of birth instead of the NAC. The NAC process takes a month or so, Police check...local magistrate orders the local municipal corporation et al.

    Any suggestion will be greatly appreciates. Sorry if this post is in the wrong thread.

    Get a new BC made, and attach 2 affidatvits. I was able to get the new BC in 2 days. Though 'coz I was bon in a Hospital in Delhi, they could locate my records and the new BC specifies that Date registered was 28 years ago. It costed my parents about Rs2000, they got hold of a dalal in from of the NDMC office and he was able to get everything done. According to them there are tons of people standing there getting these things done.

    Jus tnow got CPO Email for me Also, I think the SR for Expediate process requested by wife did work.

    I am glad to see the Email finally.

    We had opened SR by going to the option of Address Change and then to the CR rep, and the rep had actually initiated Expediate process on finding that we have not received the EAD card, Rep had asked allt he options like Military Service, govt service and financial hardship, we told we loose job is we do not get EAD before the expiry date and Rep choose the option of Financial hardship as cause for Expediate request and it worked for us.

    I hope others can try this option to initiate Expediate Process

    Hi,

    I have an California EB2 RIR LC app pending with backlog center with PD of March 2005. My 6 years of H1B are over and am an Indian citizen.
    Is it a good idea to convert this application to PERM - my company lawyers say that there is a risk in that if the application is rejected, there is no back-up + it can take upto 8 months to process under PERM due to the conversion.

    It is very true that it might take a long time for the conversion cases to get approved. Mine took 6 months with audit. Your PERM application must be identical (not similar, it should be 100% identical) to your RIR case. They will take months to pull your RIR out from the BEC and compare it with the new PERM and if 100% identical they will approve. It is possible. It can be done. I got mine done. It will take time. It is risky especially when your 6 year limit is over. There are ways to stay in status even if it gets rejected. But are you willing to take the risk?

    I am not sure if you still need people call to the CHC. I think you need to make Hispanic call a lot. I will be glad to transmit this information but I am not sure if this bill already passes yesterday. You probably know the philosophy about why they do not want support this bill but if they realized that besides non legal residents, there are a lot of Hispanic people looking for GC throug H1Bs, and they are suffering as many of us, they can change their minds......You should contact other members of IV go are Hispanic and make them to spread the voice.....Let me know if we need more calls.......

    I agree. Thats a fantastic point. The Hispanic Caucus is already listening but if they probably hear about actual legal immigrants from Latin and South America also suffering because of their obstinance, it will definitely help the cause. I suggest you should definitely make the calls, tell them you are a legal immigrant from Peru and need them to support the bills.

    We are spinning in circles here and it is like reinventing the wheel. This is THE grassroots org �THAT you want to set-up. already set up to achieve exactly that � YES, YES �We want Congress to introduce a bill to reduce backlogs. The core goal of IV is to have a bill that has our provisions. That is exactly what this organization was set up to achieve. You seem to be a newcomer to this struggle. Have you followed IV from 2005 Dec when a buch of members got together on some other forums and watched helplessly as good provisions (that were meant to allievate our troubles) were taken out at the last minute from a bill during debate.
    Since then we have tried and tried and frankly have matured enough to understand that the politics of the immigration issue is complex and any standalone bill �just for us- has no chance.

    Our provisions have to be clubbed with all the rest of the minor and major groups � that want reform. There is the nurses lobby, the doctors, the illegal lobby, the dream activists, and many other fringe groups, they all want their issues to be addressed. The anti-immigrants are a big opposition to any small relief that comes up in debate. NOW- We have learnt that we need to work with all these groups, form alliances and lobby hard to get a bill that has more support.

    If you go meet with your lawmakers you will understand that our issue is a miniscule little piece of a bigger issue of Immigration. And different varying and sometimes opposing groups have to be accommodated. The politics of immigration is convulted with different factions of the society wanting different things � Our little issue is straightforward and we enjoy a lot more support for our provisions, unfortunately we were clearly told that we have to be clubbed with these other groups when it comes to seeking a bill for reform. We are being held hostage also by the Hispanic lobbyists, that feel that if smaller bills come up and are passed, there will be no apetite for their bigger issue of legalizing a big core of mostly Hispanic illegal immigrants.

    FOR A RECAP- after this administration came into office �Jan 09- We had hopes and were promised that CIR (Comprehensive Immigration Reform) will be taken up, if that fails then smaller bills will be allowed to be taken up. If you have watched the developments carefully �There was never a time and a lot of groups including IV lobbied and lobbied hard to be heard and to get a bill but- the legislative calendar with so much other priorities had no space for any immigration bill this year. After the healthcare bill, Nobody has had any energy for a big controversial bill.

    Long story-short is YES, we want a bill (either clubbed with others) or amendments inserted into a bill- But have not been able to get it done.

    The reason for this failure is us- IV Members. We have not met our lawmakers in the numbers that are important to make an impact. We have to do it every month- building pressure to get a positive sympathetic response. Now some members (including yours truly) have gone and met our respective lawmakers more than 6-8 times in the last year, but that is again not enough, that is just 20-25 odd members compared to total IV Strength of 40,000members. It has to be an ongoing effort, just like the dream activisits have done, they meet with lawmakers regularly, highlight their frustrations and are open to media �giving interviews and keeping their issue alive in the limelight.

    IV has come up with specific recommendations for what we would like to see in a bill/s for our community. IV actively analyses any bill that comes up or has a chance to come up for debate. If you want to get your hands on that document, contact Anu or Pappu and ask for the IV_Advocacy package.

    We do have a paid lobbying firm that represent our interests and educates lawmakers. This is not enough, because during debates lawmakers behave as if they do not have highly skilled immigrants in their constituency and so do not have to pay attention. This is mainly IV members fault, since we have not been able to visit lawmakers offices in the numbers that we should. Our members need to show up at lawmakers offices and educate them. Tell them you live in their constituency and represent IV so that when the lobbying firm does their work, they are paying attention and our voices are not ignored or drowned.

    Individual members need to be open, honest, and courageous enough to talk to their lawmakers and media about issues we face. Just crying and debating on IV's website does not help. Talk about introducing a bill for us to your lawmakers � not here on IV.

    We salute your efforts in supporting IV, coming to advocacy days in DC this year, monthly contributions, volunteering and going for lawmaker meetings regularly in your state. If each one of us does this, things will be much different for our advocacy efforts.

    Sent my PP for renewal few weeks back and I got it back in 2 weeks.

    For me it looked like SFO is pretty good.
    I applied for my renewal in SFO and got it back in 2 weeks. I also applied for my daugther's PIO card around the same time. Got it back in 3 weeks. SFO seems to be the best

    I will elaborate. EB2 was current untill September 30th 2005. So where does the 2003 "screeching blah blah" come into effect?

    Besides ike I have posted countless times...there were only 2000+ approvals for Labor certifications for India between march2005 and october 2005

    and only 7000 labor certifications for India between march 2005 and december 2005.

    These include a number of labor certifications for other worker categories. I myself saw at least 500 pipefitters and welders and joiners whose labor certification had been approved from Louisiana (maybe cos of katrina)

    so if the priority dates have to move for EB2 they will move to jan 2006 (like the chinese have) or remain at 2004

    there are also a TON of filers who filed in first quarter of 2005, mainly to stay in the old system, as people were scated of the new one (PERM). maybe 300-400 of those are from where I work (they also incidentally started processing GCs again from Q4 2004 after layoffs in 2001-2003. So expect a bump before we get into PERM, but as you say after March 2005 things should be smooth till 2006 Jan

    I came to the congressional reception early with all the name tags and some one asked me what is in the box, I TOLD them what is your name I got the GC for you :)

    It was great to meet each and everyone of you... had so much fun and a big shout out to the Marshals, I kept finding Marshals in the rally pics but since we were at the periphery we were not in pics... but the rally was contained and safe thats the good part, hope it went well at the end, sorry I had to leave to catch a flight back to SJ :)

    H4-B renewal end of April 2007, H1-B applied in April 2007

    I need answers to following questions.

    1) Can i apply for mY wife's H4-B renewal while her H1-B application is pending?

    2) What will happen, if here H1-B is approved after H4-B renewal is applied and before her Renewal of H4-B is approved?

    3) What will happen, if my wife's H1-B is approved before H4-B renewal is applied. On what status will she stay untill Oct 2007. Does she have to go back to India and come back with a visa stamp?

    Letting all this Indian Consulting Firms taking ALMOST all the H-1B visas is very unfair for everyone of us that we are working hard to get a job in the US. In my opinion, they are trying to monopolize all the H-1B so no other company can be able to hire foreign professionals by themself. In this way their only way to get professionals is thru them.

    It is very UNFAIR that this consulting companies takes a large number, getting almost everything, of H-1B visas without having a real job for them. This companies will offer this H-1Bs to other companies, making it a big business. Additionally, I believe that indians also pays to this consulting companies for the H-1B.

    Even if the congress raise the cap without making changes in the system, it will never be enough. It will just increase the profit of this consulting companies. I only hope that the changes going to be introduced to fix the system will not screw us and complicate more the immigration process. But realistics and effectives changes are needed.

    Good luck for everyone who are in the H-1B lottery and really need it.

    How do you know that this year quota finished on first day because of “Indian Companies”? Do you have any proof to support your blame? And what is ‘Indian consulting firms”? Why is it ok for one group of companies to file for H1 and not ok for another group of companies to file H1? Why is it “UNFAIR” for consulting companies to take large number of H1 quota? Isn’t H1 considered to be for the “best and the brightest”? Wouldn’t it make more useful for the “best and the brightest” to provide solutions to many companies at the same time by working for consulting companies? Why discriminate against consulting industry?

    Here is some information that may help you gauge the reality. There is lot of companies in US that would not fit into your definition of ‘Indian Companies”. These companies have filed for large number of H1s that too would have finished the H1 quota. If it is ok for an H1 employee to work for a shoe making company, then why is it “UNFAIR” for H1 employee to work for a consulting company?


    Bottom line is:
    1.) There is green card backlog for 6-10 yr. Any company would love to get an insurance policy that an employee will work for them for that long period. So one reason for this quest for H1 is due to delays in green card processing. If someone gets their greencard in 1-2 yrs., H1 visa approval will not get the employers any insurance policy for long term employee. And the demand for H1 due to this factor would subside.

    2.) More importantly, even if demand for H1 would subside due to green card processing in 1-2 yr, the fact that unemployment rate is very low will still exist. Unemployment rate is making it hard for companies to find the right people at the right time at the right place. So companies are looking for ways to recruit the necessary talent, wherever that talent is available. IEEE wants all foreign engineers out of the country so that their membership base of engineers here, who do not want to learn new technology, could get the taste of late 90s. So for you to first attack a set of consulting companies and then cheer around the bill hoping that “the changes going to be introduced to fix the system will not screw us and complicate more the immigration process.” is exactly how it is going to play out. Infact, anti-immigrants will come to this site and cut-paste comments like yours into their report to strengthen their argument when they would go out to lobby in favor of this bill. So Best of Luck for your ranting.

    For the sake of clarity, I do not work for a consulting company. But I realize that this bill could potentially effect everybody on this forum. Also, I see a racist attitude in this bill against the huge consulting industry. And this negative attitude against consulting industry will have a snow ball effect into rest of the economy and society. I don't think IEEE took that into consideration.

    Lets not get stuck in debating and talking all the new news about legislation being introduced, Skil/CIR. The most important thing is to create awareness about problems we are facing (EB immigrants).

    Time again we have seen that because of low awareness amongst all the peoples-reps (congressmen, senators, all others) our provisions have been dropped at the last minute.

    The need of the hour is to keep working together as a unified team, we all do a good job as a team. We have seen that during the lame duck and also before in May, 2006.

    IV core as a team exactly knows what is best for all of us. We have to trust them and help them do their thing, meanwhile we can all concentrate on
    1)raising awareness, writing op/eds. writing to editors
    2) Inviting other people who are stuck like us (to be IV members). Strength is in the numbers.
    3) Creating a huge fund to help lobby/or other such activity that we need it for.

    Some new members might doubt the intentions and the commitment of the core team. Also it is very easy to be skeptical of people asking for funds. When I was new to the IV team, I had the intitial skepticism about people on the forum asking for funds and contributing. It took me a good 2 weeks of being a guest on the site to register and then another 10-12 days to give my first contribution. So from that standpoint, I know that new people on the forum are going to take some time to trust IV and have faith in the core leadership. All we can do is to get new members (So many thousands stuck in retrogression). New members inturn will become active in a short time, Bigger and stronger IV with a 10,000+ membership will ensure being noticed and also will have the required funds to make it happen this year.

    I have pursuaded people ("friends") to join and contribute but all they say is I will .. never seen one do it .. ashamed of 'em ...I dont really understand why people are so hesitant to contribute. We need a group effort my 50 dollars a month will achieve nothing unless lot of people do the same.

    I contribute for my benifit you do it for yours.
