First of all, It is funny that the guy who knowingly broke the law want help of law when he is victim. Now all of us know why laws are made in first place and why everyone should follow it.

Secondly, Beating the dead horse again, Thunderbolt should go to cops and give evidence of child abuse asap.

In terms of risking the case of hiring illegal for a job by going to the cops in my mind is a non issue. Because, he is exposed to that risk with or without going to cops himself. What if Nanny gets caught working illegal in some other home and she gives all names she worked for including thunderbolt. He has done a mistake and he should hire best attorney to plead that case if it ever comes up either by him reporting child abuse or some other way.

    Hi longq,

Not sure why you are still fighting this. I am sure law-makers are aware of the way USCIS implements the law and they don't seem to have any objections.

From the 2006 "CRS Report for Congress" on "U.S. Immigration Policy on Permanent Admissions"

Prior to FY2001, employment-based preference immigrants were also held to percountry ceilings. The American Competitiveness in the Twenty-First Century Act of 2000 (P.L. 106-313) enabled the per-country ceilings for employment-based immigrants to be surpassed for individual countries that are oversubscribed as long as visas are available within the worldwide limit for employment-based preferences.

It might actually be counterproductive as you might inflect negative sentiments against increasing overall EB-immigration level demanding improportional increase for 'top immigrant-sending countries'.

As the State Department describes, the per-country level is not an entitlement but a barrier against monopolization.

Please try to read law carefully. The law will not have simple terms as you think. They have to draft the law in the language of the act. Any way the meaning is same.

The law explicitly say that the 7% country limit does not apply to the EB1, EB2, EB3, EB4, EB5 catagories, if excess visas available in those catagories.

Exactly, but because EB3 is oversubscribed, no 'excess visas' are available for oversubscribed countries. (But we had this discussion before, though).

    GCStatus,

We would like to pass the baton to you. Its not "my" website. You are free to take it. Kindly let us your a number to reach you and we will start the transition process.

    Thanks,

BTW, no one is telling you the credentials, just letting you know that your rude posting about Admins hiding in a secret place is not appreciated. You cut-past one post, what about your other posts. Do you want me to post them here? Now lets get back to "ownership" and "rudeness" debate because it always turns out that way. You can say anything and if Admin responds, all of a sudden Admin is showing attitude, Admin is rude, freedom of speech, Ist amendment, Admins is dictators, Admins are like Hitler etc etc . Nothing new, we have seen this story repeat countless times.

And one more thing, you are busy and others have all the free time in the world. Is that right?

B]Please post all my e-mails here and tell me where i am rude.[/B]. This is getting funnier.

Secret location - its like a joke coz i didnt get response for 4 or 5 e-mails.

I want to know my derogatory language here. Bring it on, bring all e-mails.

    Dude,
I just saw this post and I would like to understand a bit more about what you read. So, I have two questions for you:

    1. What is your EB category?
    2. What exactly did the memo say? Now be careful and think hard before you post.
For instance, you may cover the following in your post:
    - Who was it addressed to?
    - What was the subject?
    - Was it about about EB or FB?
    - Did it mention any dates?
    - Did it mention any country names?
    - Was there anything about what the adjudicators are supposed to do?
    - Which city/state was this?

Your response will be very helpful.

    Thanks.

I see he's logged in and reading this thread, but not respoding to your question. I am just wondering why ?

I am in the same boat as you are ... There is injustice everywhere? As explained, I feel unjustice becoz EB3 can port to EB2 , I feel unjustice becoz L1,L2 get it quickly .. list continues. FYI... I came well before most of you guys in queue. PPL who came after me got Labor very quickly and are ahead of me.. So is that not Injustice to me? Shouldnt USCIS be notified and Shouldnt IV followup on adminFix ? when ppl jump or port dates from EB3 to EB2 dates will no go beyond ( just with 3k numbers) shouldnt IV followup and do adminfix so that some set of ppl will stop discussing this issue ? We can keep discussing things that will never happen.

When USCIS stopped Labor SUBS it filed in federal register and many processes. As per Law it allowed to port dates as it does now between Eb3 to Eb2. how can they go back hich is non existing and change the dates just becoz some ppl feel injustice? look at practicality?

As i said just google it and you wil know whether USCIS alredy know about it. again why 2007 is that becoz you call could apply then? When USCIS did admin fix did it change the validity of existing EAD's or said will apply for new ones only?

Those who came between 2000 and 2005 are not getting GC approved , because of some loop holes , those who came in 2007 are getting 485 approved. Is it not unjustince to people who applied earlier? This issue is not similar from EB3 to EB2 etc.
I hope IV will bring this to the notice of USCIS ASAP.

What is the need of any sublabor demand ( per direction of this thread?) if they just retain 140 date ? There would no need in first place for any one to use it.

The intent of a subst labor was to save the company time and money for obtaining another labor for the same position in case the original beneficiary drops out. Remember, labor was a company petition, not employee petition. The companies still would have wanted it even if it does not retain its original PD.

The basic thrust behind the idea of changing the rules of PD allocation for subst cases is to push forward PD to july 07 level. Most of the subst happened in that month. we are not asking subst labor folks to quit the queue, just asking them to move behind.

This is a totally wrong message someone out there put out to make people nervous. Application support centers do no have IO's. The only IO's you will meet would be at a different USCIS facility where you take appointment and stand before the counter and ask the questions.

There will be no reason why someone would meet a IO at the fingerprinting place which generally have technicians and security to monitor the process. You sit in a waiting room alongwith 100 other people, then once your name is called, you do the fingerprinting and get out of the door.

There is no time to mingle with IOs nor there will be IOs(friendly or not) who would be willing to disclose any information to you.

Some people online gloat at having pleasure to spread disinformation. this seems to be the case...

    Guys take it easy...

    1) Since the letter refers to "we" (the legal immigrants), should we be individually signing the letter?
    individal sign should be fine

    2) Are we going to provide our mailing address as well as email IN THE EVENT that there will be a response to our questions?
e-mail address and name is fine

    3) What happens if there is no response?
nothing. We just registered our protest.

    4) In the letter, I said action must be taken in the remaining 15 days .. BUT HOW CAN ANYTHING BE DONE AS THE STANDARD RESPONSE IS "the annual quota is exhausted" ??? i.e., there are no more visas to allocate!!
this is just to give them some sense of the timeline.

First, deecha, and VZLAN you are brave men..hope you get through. When the immigration system is so arcane, you cannot blame yourselves
    ===============

next, I am in a similar 'somewhat out of status' position myself. i am filing for i-140/i485

I have been with the same employer since Jan 2004, and have every pay stub since then. However during some time in 2006, the company was in deep trouble, management takeover etc. and we were only paid for time spent on a major project (which was the cash cow). Because i was not directly involved in it, I was paid at about 50%, but every week, which lead my final W2 for 2006 to be around 76% of the total on the LCA. I looked at my paystubs and the total weeks at less than 100% is 5 months.

For 2004, 2005 and 2007 (on course) I am on course for my full salary. Also I got a bonus and stock options as the project took off and we are all in a better shape and my 2007 W2 should be higher.

Before 2004, I was a student on a F1 (MS degree) with one h1 in the bad days of 2002. However, my change of status was on the dot.. i.e. i got laid off on a friday and i filed my change of status to f1 the same day. My h1 visa was stamped in 2004 in India. My H1 was extended in early 2007

I am filing a self-sponsored I140. So, my question is:

    1) Should I wait for 2008/whenever to file my i485 and hopefully show one year w2 and try to see if that goes through?

    2) Try to convince my employer to pay me the back wages for 2006 (they may agree) in lieu of some future pay cut or paid out vacation or trade my stock options. File an amended return with a new 2006 W2 (what are the risks of an audit??)

    3) Try to wait till 2008, stamp my visa extension and then file for i-485 showing only 2007 w2.
    -=====-=-=-====-

    Please send me your perspectives.

IV core team did an outstanding job for achieving this.
    I really appreciate their efforts.
This is a big success for us. As a small token of appreciation, I am donation 100 dollars now.

Once we cross Aug 17, IV should seriously think of how to resolve the backlogs of I-485 and also should think of new people who need to file I-485.
I appreciate the goals of IV and I extent my continous support for IV in getting the goals achieved.
