I'm not working in the IT industry and this is the first time I have some idea about what the desi companies are doing in US. Yes, I think these desi companies and people who conducted those fraudulent behaviors are partly responsible for our situation here. I believe most H1B holders are decent people while some like those mentioned in the article are nuts. Bad purges good. Now all H1b holders have to pay the price.
Besides, I think those who conducted these fraudulent behavior do not deserve to be called "high-skilled workers".
H1B problems have nothing to do with retrogression.
If H1B employees are being mistreated by a certain class of employers, then what does that have to do with shortage of visa numbers?

Misuse and abuse of H1B program did not cause retrogression. And if the abuse ends, its not going to end retrogression. The H1B program does provide ammunition to anti-immigrants to use that paint-brush and paint the entire program of H1B and Employment based GC as bad. Fortune 500 companies dont engage in unethical behavior. The TCS, Wipro etc maybe do that. Small bodyshops certainly do that. I am yet to see a small body-shop, operated by a citizen of foriegn origin, working by the book and treating employees well.
But all said and done, these things make our life more difficult and exacerbate the situation that arose from retrogression. However, these things didnt cause retrogression.
At the most, these issues of H1B abuse may have provided support to some groups in keeping the H1B quota down. However, it has nothing to do with EB quota. In fact, IEEE-USA advocates bringing down H1B quota and RAISING the employment based GC quota, in order to remove factors that encourage employer abuse.

I have talked to IMG sales rep, he said they won't cover for pre existing conditions. He also said that as far as his knowledge is concerned there is no company out there that covers pre existing conditions when I asked him about it.
My final assumption is that any insurance we buy anywhere, just covers illnesses that are developed after the coverage starts.

Just out of curiosity, why "shred" photocopies, except maybe for better document management and not drowning in paper?
Is there some ramification towards citizenship?
Better documentation is the reason why I got rid of those photocopies (I had crate-loads of them piled up over time). I guess you can just throw this junk in your recycle bin too. But because these are immigration-related papers, and all sorts of shady ID thieves are snooping around these days, I permitted myself a little paranoia and shoved them down my office shredder.
Insane list ...I lost 50% of my head hair staying in US since last 10 yrs and now loose the rest doing the book keeping...no wonder stone age was fun ;-)

I won't be a member at all...because if we make anything mandatory and don't let people realize what we are doing...i think people won't become member...

Came to USA on H1B, paid for the H1B fees(at that time didn't know it was illegal to do so)
however after coming here , Paid for my own ticket and landed here on start of january 2011.
I am a little doubtful...if this was illegal.

Being a foreign national you may not be expected to know every law here.
How much did you pay? was it more than what the fee was?
Did the employer processes your visa or did they use the services of an attorney?
if you...then you have a case to sue the employer for scamming you in civil court...as he may have used this trick to eat your money knowing fully well what would happen to you once you landed here.
Talk to an attorney here before you leave.

Hope is ok. But IV core has more access than normal members like lawyers, lobbyists. So their view is important. Atleast interpretation of Memo need to known to the members. Also feasiblity of succcess, amount of effort and money need to be known to the members. I am seeing silent in most lawyer sites like immigration-law, shusterman, ILW. Everyone posted memo but no one really that much bothered

As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

1) did you talk to your lawyer?
2) if # 1 is ruled out or of no use, I would personally draft a letter showing that she is travellling right now and with kids and it would be extremely difficult to get her TB test done as you cant get it done by that RFE due date. add some more stuff telling your situation as to why she cant come right away due to the stuff you mentioned (kids/babies ). IAm sure you WILL get it exteneded.

Hello guys please let me know if i am eligible for filing WoM.
My case details are:
EB2, PD 02/12/2002.
I-485 RD: 06/06/2007 and ND: 06/15/2007
I have converted my EB3 PD to EB2. Last month i applied for EAD renewal thinking that it might trigger my GC approval(some people still believe in this)
Today i received my EAD with 2 yrs extension. I consider this as a bad sign because USCIS clearly states that if the visa is unavailable then they will issue 2 yr EAD.
In my case my PD has been current since i filed 485 except two months in this year when EB2 was U.
I have opened 3SRs(on march, april, june 08), went for infopass once, written letters to 3 senators and 2 representatives on july 7th, 2008, sent fax to NSC, also sent letters to NSC and NSC director twice, called NSC several times. I could not get any status update other than the regular response(case is pending and waiting to be assigned)
After taking all these efforts i recently received response for one of the SRs(for june 08) stating these type of cases taking time for approval and i need to wait patiently.
I dont know if i can wait anymore because i have been waiting for close to 7 yrs.
Now in this situation can you guys please let me know what i should do and what should be my next move?
Do you guys think i am eligible to file WoM? if yes please guide me on how to do it.

4 Year Bachelors in India + 5 years of Exp (excluding sponsoring emp)
3 Year Bachelors in India + 2 Yrs(Msc) /3 Years(MCA) + 5 years of Exp (excluding sponsoring emp)
4 Year Bachelors in India + US Masters + 2 years of Exp (excluding sponsoring emp)
All these qualify for EB2. Just make sure you Job Description requires eb2.
Also, consult with a leading attorney and show you employer, that this is doable.

This protest march is being organized to oppose the enormous visas backlogs in the employment based immigration system. This protest march is also intended to oppose the recent decision of USCIS to block the adjustment of status petitions in July resulting from an unprecedented out-of-order reversal on the part of DOS and USCIS.
Please join this rally in huge numbers to create more awareness in the Media, Congress and the Administration. We are already getting attention of Congress and the Administration due to recently published articles on the flower campaign in New York Times and Washington Post on July 11th. If you cannot join but if you know someone who lives in San Jose area and who doesn’t know about this effort, please ask him or her to join this rally. More numbers will get us more media coverage and more attention to this issue.
This rally has the potential to bring our issue to the attention of everyone, including the Silicon Valley tech employers who have a stake in the morale and productivity of the hi-tech foreign employees in their companies and their backlogged immigration.

1) 11:30 AM: Go to the square in front of Dr. Martin Luther King, Jr. Library (150 E San Fernando St).
2) 12:30 PM: Walk towards 635 N 1st St through S 4th St, E San Carlos St, Market Street and N 1st Street.
3) 1:15 PM: Arrive at 635 N 1st St and stay till 2:00 PM
4) 2:30 PM: back to City Hall
IMPORTANT THINGS TO REMEMBER:
1) Abide by the laws.
2) Stay on sidewalks.
3) Follow traffic rules, show courtesy to other pedestrians.
4) Do not block building entrances.
5) Dress Professionally. No shorts or Bermudas. Wear formal dress clothes, semi-casual or business-casual.

i am with you. we should request that USCIS recapture unused visas!
Guys , I think this issue has been discussed lot of times.
1) USCIS do not allot immigrant visas, It is alloted by DOS.
2) DOS needs a fix in the current EB laws to capture unused visa.
3) I am not sure if we can push any change in law, given the current Iraq war quagmire.
But I hope they speed up the overall application processing times, with all the increased Fee money they will get from July 30th (by investing money on IT).

A very sensible post. You dont need to have ur life around the GC and Priority dates. You need to do what u want to as much as within ur limits.. But one thing is USCIS can be staright forward and say EB-I wont move for such and such time and people can still plan better... :)
I agree. On an average, it seems, one spends just about 6 yrs to get his/her GC. That's nearly 20% of our productive "employment" life. At some point in the process, one starts to wonder if he/she can lay their roots in this country.
It is not an easy or trivial task to "just move on" and pursue plan B or plan C.
With passage of time, the priorities and the drive of people change.
So, the immigration system should be quick and transparent.
If you notice in daily life, there is always a "good-faith" disclosure of terms and conditions before signing up for anything. And both parties strive to keep their end of the deal.
That's all we are really asking from the SYSTEM - "If you are willing to open the gates for immigrants, please process their applications to the best extent possible and don't hold up our lives"
What is missing in this system is "empathy". Rules are fine and we also understand the over-subscription in certain categories. But at the end of day, the controlling or executive authorities have to show some empathy to those that are left hanging. Rules are made to help people and they should not become an excuse to punish [PR process delayed is justice denied, truly] the common folks instead.
President Obama has stated he would like have an empathetic judge on the supreme court. Likewise, we need someone heading the immigration system that empathizes with the lives of prospective PR lot.
What can we do to seek such a leader or change?

Hi Folks,
I know that with a deluge of applications, the question I am asking might not be relevent in the current scenario (July filers), but what is the historical EAD processing time? I know they say that USCIS will issue one within 90 days, but does it always take 90 days or is lot lesser?
I remember when I got EAD during OPT, it took like 30-40 days on average. Does the same hold for the EAD for EB too?

Hello everyone,
I was just thinking about this the past couple of months and maybe we dont even need to ask for Green cards. MAYBE our approach should be "Let the H4s work". Once husband and wife can both work, the green card can take its time. Right now the Biggest problem with most people is that "my spouse cannot work!". Maybe if we lobby for h4s to be eligible to work that may solve the problem.
Now before this suggestion creates a HUGE "Dhoom", this is JUST a suggestion. The current political climate does not look like it is going to be easy in any way to put any provisions for Green card increases. Besides if the logic is "Let temporary workers be temporary", this approach fits in with that logic, coz we are not asking for GCs (permanent residency), just more temporary EADs.
