    As I see it, hiring a lawyer is still cheaper than losing 20K per year because you are working for a exploitative consulting company. But if the company is treating you well, there is no reason to leave.

    I never understood this "exploitation thing". This is America...

    If someone is exploiting we all have a choice. We can change employers; go back home, etc.

    Spouse working - Yes, in theory they could allow H4 to work. However would that be any job? If so then the H4 would actually be far better off than the H-1B who is restricted by job category and employer qualification

    Long term - Yes, in theory, a 20 year H-1B takes some of the stress off. But what of Citizenship? If you stay 20 years you'd want to at least have the option of becoming a US citizen. At present I believe only a GC holder has the option to progress to citizenship.

    Employer based - This is the key. Unless an H-1B is no longer employer sponsored but self-sposored then the H-1B holder is still living on a knife-edge and can be sent back home at any moment if their employer fires them or goes under and they cannot secure another similar job quickly enough.

    So yes, they could make H-1B 20 years, allow spouse to work, allow application for citizenship and make it self-sponsored and not employer dependant. But why do that? They already have this kind of Visa. It's called a Green Card.

    Your intentions are good - but the approach you took needs to be refined further. None of what I wrote above is personally against you - I appreciate your efforts but feel that we need to approach it differently - probably equating updates with money is not a good approach given that once someone gives money , they may start having a feeling of entitlement and we may not be ready to handle it.

    Thanks for the appreciation. Without a doubt, the poll I have posted is clearly focused on a single dimension i.e. whether receiving more regular updates will help people get more involved and contribute more (whatever be that amount, it would be in addition to current status). While there could be several other ideas to increase participation level, this is what I felt was important to me and was looking to gauge if others felt similalry. However, I clearly don't have a patent on ideas - if you have a different approach or idea I would assume you wouldn't hesitate to pursue that to achieve our goals.

    As far as as the notion that someone who gives money feels entitled to receive information - so, what's wrong with that? After all no one gives without any expectations and based on this poll, there are at least some of us for whom being informed along the process is one of those expectations, especially since none of our goals will be achieved overnight. I do not mean generic updates of the nature you have cited, but more specific status reports of who is/has been doing what and what action, if any, is expected of the rest of us in order to support. If the organization is not prepared to handle that, I think it needs our help to be able to achieve that goal! Being ready to provide these updates will only improve our organization's efficiency and effectiveness.

    AT JFK.
    Submitted two copies of AP and passport. I had three copies from USCIS.
    Went through US citizen/resident queue and the CBP officer took me to another verification counter.
    There were only one other person (Russian). No questions asked. NONE. Verified address and very very informative and friendly CBP officer. Handed both AP with one of them stamped. I have all three copies of AP with me with one stamped.
    He advised that every time I travel make sure there is no NOID on my case and my AP is current.

    You may have an alternate option without taking the MS...

    In the case of H1 it says: "....An accredited United States evaluation company can provide an evaluation whereby three years of progressive work experience are considered equivalent to one year of college education in the event the foreign national has only a three year bachelors degree....".

    So, I think it is really worthy to explore whether it is possible to convert 3 years of experience into 1 year equivalent of education.

    I do not think, you really need to take an MS to be considered for EB2. Contact Murthy law firm, I think they will definitely be able to handle difficult cases like this.

    Or else, you just take a 20 minute appointment with one of their experienced lawyers and they will be able to give you a firm answer. It costs somewhere between $150 and $250 for a 20 mt appointment.

    If I use my AP , what documents I need to carry? original 485 reciept? my original receipt is with lawer, he send me photocopy.

    Its a good idea to have an original 485 receipt, but in my case, they did not ask for it and didnt see it. Not even photocopy.

    Nonetheless ask your lawyer for 485 receipt and they should give you that. There is no reason for them to keep the original with themselves, they can keep the copy and give you original.

    You mean to say sell US real estate for GC/citizenship? I don't see this going very far. I can see anti immigrants waiting for this one. Best is to lobby using aides of big corporations, developing relationship with lobbyists who already have connections, hiring lawyers, developing strong case, donations in election campaigns etc. All of this needs loads and loads of money. Are we ready to donate to IV and build strong lobbying group for our cause? That is the only way to change our current situation.

    Sending flowers, sending pizzas, sending all these proposals will only fall on deaf years. Congress understands language of money to pass laws, Rest of the country/orgranizations understand language of laws/court.

    Bulls eye. this is what I am thinking.

    I am looking for an answer in general for all.

    As Chandu pointed out, in general, AOS (pending 485) status gives some protection in terms of maintaining legal status in between jobs. 'Technically' once six months are completed at the employer on whose job the I-485 has been submitted - we should be good. But the issue is AC21 process is not a well streamlined one - no forms etc. Earlier the volume of these cases might be very low for USCIS; now after the July 2007 there are lot more people in the I-485 stage and recent economic conditions could have contributed to large number of people using/potentially using AC21 process to change jobs. Heard many issues - hope USCIS will streamline the process for AC21 job change issues.

    Thanks for all the inputs. I still have not received the letter ( probably because of winter strom - delay with traffic) .

    Now if the Deniel is because of AC21 and 140 revoke , when we reply with MTR, should I sent copy of the AC21 letter we sent before or do we need to sent a fresh one ( employment verification letter ) ? The reason I ask this is when we originaly filed AC21 docs ( in Feb 2008) I was with Company2 . Now I am with company 3 ( just 2 months ). And good part of is company3 is well aware about the "same or similar " letter and is ready to issue the letter .

    Its better to send as much documentation as possible in a systematic way. What I did with my friend's appeal was I created a document in a tabular format with each row referring to the points mentioned in the denial notice and providing a brief explanation and referring each point to an Appendix which contained detail explanation and corresponding evidence/documentation (W2, pay-stubs, exp letters etc) supporting the explanation. You can do the same. Infact, I encourage you to provide evidence of your AC21 filing with Company1 which affirms that you indeed followed the AC21 guidelines from your perspective. Do also provide evidence of continued employment in same or similar occupation till your most recent/current employment.

    One more thing you should keep in mind is the deadline for filing the appeal. No matter when you receive the denial notice, usually, you only have 33 days from the denial date to file the appeal. So, I would encourage you to do whatever possible from your side to know the reason/s for denial so you can start working on collecting the appropriate paperwork for the appeal. Maybe taking an InfoPass appointment might help. I am not sure of any other options.

    I agree with you on one thing though. Gandhis struggle was bigger than ours. Ours is nothing compared to it - You talk of no "background checks" in Gandhis time... when people used to be beaten on their head for marching peacefully. Many of them would bleed to death. Our struggle may be inspired by Gandhiji, but we will never be able to match the sacrifices made by othose martyrs. We may be inspired by Gandhis principles, but we can never be the Gandhi.

    But the least we can do to respect that great man, is to follow some of his principles (like those stated above) in to our daily lives. Is that too much to ask?





    Another take - if US can have an endless source of temporary workers coming in, paying into income tax and social security taxes and medicare taxes for a few years......and going back without claiming a single dime of social benefits......its the best possible situation for US....a forever young, qualified, minimum wages (i.e prevailing wages) earning tax paying transient population supporting/ subsidizing an archaic and otherwise struggling social security and healthcare system.


    Another of those arm-chair conspiracy theories. Knowledge retention is critical to companys success. A guy fresh out of college is never equivalent a guy with several years of experience in the same field. Dollar value is dropping, Rupee is rising, salaries in India are rising. If people cannot get GC in a short period of time, there would very little incentive in coming and working here. As you must be aware most H1s these days are used to outsource work to India (by Infy and others), and not to get people to work permanently here. I suggest you read the Kauffman report thoroughly to understand the situation.


    .....to create a nice "politically correct shield" for people's own private agendas (and the collective agenda of all of us) - to get a GC. Are we here to improve america's competitiveness (if that was the primary purpose of our coming here - shame on us for not staying back and improving our respective motherlands' competitiveness) or our own future - if the latter - lets call a spade a spade.........
