ICE officials have announced the break up of a major marriage fraud ring in Texas. According to ICE: A 72-year-old grandmother who operated a marriage fraud ring for decades was sentenced Sept. 23 to serve 44 months in federal prison. The sentence was announced by Acting U.S. Attorney James T. Jacks of the Northern District of Texas. Hi Guru's,
I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:
Back Ground:
1. My husband and myself are applying for H1 B.
2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.
Q & A:
1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.
Your valuable suggestions are greatly appreciated.

I think answer is NO if you want to come back of L1A from B employer.
To be eligible for L1A, You need to be on outside USA payroll from B employer for atleast 1 year (from past 3 years).
With H1B, you will be on USA's payroll for that period.
To be eligible for L1A, You need to be on outside USA payroll from B employer for atleast 1 year (from past 3 years).

You can only stay in the US if you can change to another lawful status. As a UK citizen, the only work-authorized status that might be available, though difficult, is O-1 for extraordinary ability aliens. If the company won't start the permanent residence process for you, unfortunately you have very limited options.

1. Create a page in Immigration voice that indicates clearly �retrogression issues�
2. Then we �users� can try to sort of �market� it so that this page becomes most hit page, and becomes first few pages that shows up on top in Google search.

I am on 6th year and need to extend my h1b. My lawyer informs me that 45day letter from Backlog center is enough for 7th year extension.
I thought we need to get the screen-shot of pending labor as a proof for 7th year extension.
Does anyone got extension based on 45day letter for the 7th year or beyond....???

I just filed for an H1B transfer in April. My current H1 is valid till April 2010. Just got an email from CRIS stating that my current I-129 case which was approved in April 2007 has been reopened at USCIS determination for review. Is there a problem or is it just normal procedure to look at the original H1B petition? Have transfered H1B before but have never had this happen. Is this something new that they are doing? Incidentally I am on the 10th year of my H1B and have a copy of the approved I-140 based on which we filed for a 3 year extension.

Hi,
I am being told by my employer that Prevailing wage applies for the hours from the start of an employment to the end of the year irrespective of any vacations.
I joined my current company in Feb 2010 and went to India for 1.5 months in Oct-Nov and came back, My prevailing wage hours is calculated from Feb 2010 till the end of the year ignoring the break I took when in India. So, even if I am paid for only the hours I worked here, I have to match the Prevailing wages based upon the hrs from Feb 10 till Dec end 2010.
They want me to pay them the difference as I had a low billing rate and my total earning is lower than the prevailing wage based upon this calculation.
I don't see sufficient information on the web for this clause.
Please help.
