Hi All,
My Employer applied for Labor on Aug 11th 2010 and yesterday we got the audit notice saying :
The application indicates the foreign worker is required to live on employer's premises although the application does not indicate the position is for a Live-in domestic. Please provide a detailed explanation indicating the reason the foreign worker must reside with the employer.
In ETA-9089 for Section H-17 question we have checked "Yes" but i guess it should be No.
We miss understood the question and thought it was asking about working at location and maked it yes.
my question is :
1) Can we make correction and send while replying to Audit (RFE)?
Please help on this.

I am on H1 (Has EAD but never used it), my wife is on H4 and also she has H4 stamping till Feb 2010, She got EAD and and also got SSN. But she never worked on EAD. Now she want to travel to India
Can she travel on H4 stamping or she need to get AP

I would like to know if porting an EB3 Labor & 140 to EB2 with the priority date is possible?
I am currently on h1b, I am planning to join a new company and I qualify for EB2 category.
Is it possible to port priority date of my EB3 to EB2?? with my new employer?

I think approved I-140 is the right stage. Why do we have to live in uncertainty after an application for immigration has been approved. It also makes sense to request AOS for 5+ years of H1 as well.

As long as you return before the stamping expires on your passport, you are fine. Just carry the new H1B Approval with you and 2-3 recent paystub and a job reference letter from your employer. While entering US, show the new approval and make sure your I-94 has the correct employer name and expiry date. Sometimes the officer makes mistake :)

A thought about meeting the Senators/Congressmen.
Should we not meet the new senators and congressmen now, BEFORE they actually join office? I have a feeling that once they take office, they will become too busy with day to day stuff and immigration will DEFINITELY become a back-burner issue.
Is it possible to meet the new people moving in after January, now instead of after they take office?
Pls join your PA state chapter first in order to execute the action items. Meeting the lawmakers is one of the action items in the list. we cannot undertake such efforts without enough members in state chapters. pls also urge others you know from your state to join the chapter and get active.

Thank you for the response. I correct myself, I shouldn't say Visa. I mean Approval Notice. With the approval notice in hand which is effective May 2007, can I switch employers before that and get a transfer of H1 for the 3 years based on that or will I have to wait till May? Thanks!

First, your friends father needs to find an employer who is willing to sponsor him for H1B and later for GC. Usually, all legitimate employers will have a host of immigration lawyers and counselors who will take care of things from that time onwards.
That said - now may not be the best time to try and find a job in US. Finding a H1B job (i.e. one that cant be filled locally) - is even more of a challange. I wish him best of luck.
If the person has relatives in US (is your "friend" a US citizen?) - then he may be able to "quickly" (1/2 years for immidiate relative, much more for others) immigrate using the family based immigration.

Many threads here are on this, you've got to look for it and read. You've asked a question that has been asked and answered many times. That is why nobody has answered your questions.
In brief, you can use AP to come back, and work with H1B for the company who filed your H1B petition, and you can extend or transfer your H1B as well. You can also work on EAD for anyone you want, but you cannot come back to H1B.
There is more on other threads that will make you feel more positive about these answers, and helpful info on traval with AP.

Is there any way we can check our labor processing status as it is a genral fact that no employer would prefer to give his employee to access his status and at the same time they would not let employee to call attorney directly.So in this kind of scenario I was just wondering is there anyway we can track the status.

Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
Effective January 4, 2010, the U.S. Department of Health and Human Services, Center for Disease Control and Prevention (HHS/CDC) is removing HIV from the list of communicable diseases of public health significance and references to HIV from the scope of medical examinations for foreign nationals.
Until the rule goes into effect, non-citizens who are HIV-positive cannot be admitted into the U.S. unless the U.S. Department of Homeland Security (DHS) grants a waiver. Once the rule goes into effect on January 4, 2010, HIV infection will no longer be defined as a communicable disease of public health significance, immigrant visa applicants who are required to undergo a medical screening exam will no longer be tested for HIV, a waiver for entry into the U.S. will no longer be necessary, and HIV-positive visa applicants will not be found ineligible for visas under Section 212(a)(1)(A)(i) of the Immigration and Nationality Act (INA). Although foreign nationals with HIV who apply for visas will no longer be ineligible under INA Section 212(a)(1)(A)(i), they still must overcome the public charge under INA Section 212(a)(4) by demonstrating to the consular officers that they will have the means of support in the U.S. and that they will not need to seek public financial assistance. My Lawyer said that the Premium Processing for I-140 will be again available from 08/16/2007, he said he knows that 100%. Did someone have some information about this ??. Can this be true??
If this is true then some of the concurrent filers will try to upgrade them to PP.I will be surprised if they do that. But crazier things have happened.
