Your good fight on the retrogression issue kind of kept us going without giving up. In just a few days what some of you have done with www.immigrationvoice.org is amazing and it truly deserves a lot better than the faint response they have got so far from all of us in this legal black hole. Honestly, I do not care if we are not able to raise 100K dollars for the lobbying efforts for the next immigration bill on February. I don not care if this money is finally lost. It will be money well spent if we all realize that we have to do something instead of waiting years and years and years� Any money is worth the effort regarding our goals, even if our present intention does not succeed. Is worth it!!. Lets move on, hoping for the best� It is worth to try this next immigration bill. Any money spent on this is worth it� Can not you guys see it? More and more years on this black hole!! More years paying our lawyers for H1B renewal, more years for renewal of our driving licenses, more years for our wives to wait, more years for our employers exploiting us� This next immigration bill could be our last chance in many years to get our unfair and sad situation known and probably solved. We would at least raise enough concern about the absurd situation of the legal immigrants� It could be a new Quixote tale, I do not care� A good part of my next paycheck will go to immigrationvoice� Whatever� Keep America growing� America is not just them�. If they get continus apps from Eb1 in each quater how can they set up cutoff date ? ( I mean their demand with in range of supply ) .. isn't that illegal ?
Most recently, the cutoff dates for EB3-India was set on Jan 05 bulletin and for EB2-India on October 05. Not sure about the other categories, but it seems to me that they either do it at the start of a quarter or at the beginning of a fiscal year. Based on their comments, it does seem like demand is starting to exceed supply for those EB1 categories.

I have a feeling that they will not restore 140 PP at least until retrogression hits again i.e. the influx of various AOS applications slow down.
I think those currently waiting for 140 approval will get screwed and those who were hoping to 3 yr H1 extension will be the most impacted.
See what the last para of the memo says....
During this timeframe the USCIS will determine whether
it is able to process these cases with in 15 calendar days of reciept.

First it wasn't 1000, we had over 2000 people registered and many joined after or did not register. So please don't say 1000, it is extremely painful for everyone who attended to be considered as "not counted".
1. Politically having a rally in D.C makes it more visible for all the law makers there. Laws/amendments and all the political activity happens there. Rallies else where would make it to one or two news cycle but won't be remembered after wards.
2. Meeting lawmakers, staff from various constituents wrapped around an event like a rally helps a lot in getting the message across. It raises a lot of awareness.
3. I would have agreed with you that numbers like 100,000 matters, but after being there and seeing the amazing capabilities of IV to organize meetings and having members meet over 100+ meetings with law makers, staff, talking to to them, sharing personal stories, advertisement and media campaigns around D.C has convinced me that it has and will make a difference! Personally for me, it was an eye opener on how the system works and I totally understood exactly why IV leaders set it up this way just by being around and them for a few days!

and the lawmaker wonders over a cup of decaf latte - what should i focus on......??? to him/ her - the choice is obvious.....and if it is not obvious to us........we should take a reality check.....
It would be a different thing - if 100,000 people do a silent lunch time gathering within the campuses of a revered american company like Cisco or Msoft.......with organizational blessings......people would sit up and listen.....
Personally, I did not attend the DC event because I was travelling on business and to me my perceived benefit (maybe wrong) of rally was not worth postponing an important business trip.......on the other hand if one day it so transpires that this rally was the historic starting point of major immigration reforms triggered by a group of pioneering individuals - i would have no choice but to eat my words and hang my head in shame that i did not attend.............

I think Wah Wah is confused by the differences between 'retrogression' and 'backlog'. Of course, you are right that the PDs are not likely to go much further back (I think USCIS took a conservative approach after July - note they are still issuing visas to those with non-current PDs but are using the bulletin to limit incoming new filings). However, if 20 million applied in July the coming backlogs would be horrendous, even though priority dates would not necessarily need to go back further.
However, in a sense, if the backlog is perpetual, and let's say the PD never really moves forward by more than, for example, one month, in the next 10 years (I'm picking extremes to make my point) then the effective retrogression at that point would be greater than say todays.

She will be in AOS Pending status after Oct 1st, 2007 due to pending I-485 application. EAD does not provide any status.
What is your status? I assume H1-B. You can file for H1 and H4 extensions.

This article will also be published online and thus read by Indians in India, and NRI indians online.
The article should talk about the EB greencard problems and how it affect the lives of people who come to this country on H1B visas. Indian media it seems is confused on H1b visas and greencard process. They have on various occasions reported incorrect news on immigration legislation. Getting an H1B visa seems to be the be all and end all solution to come as a permananent resident of this country. While H1B visa is a non-immigrant visa, Greencard is the immigrant visa.
We want this article to solely focus on Greencards. The title can be like --"In Search of the Green Card". The article can be such that general public in India is educated and made aware of the struggles to achieve the coveted GC.
Make sure to write it as if you are a representative (member) of Immigration Voice and mention ImmigrationVoice name a few times in the article. Write aboout what immigration voice is doing to solve this problem and how this grassroots movement has grown nationwide and will enable a change in the broken immigrationsystem for high-skilled immigrants.

Time of signing the contract also is very important. If you signed the contract after H1 transfer or joining the assignment will not have much impact. Because you signed that contract under pressure or without any option. Also any unpaid time (bench) is plus point for you. You can extract that money from them easily after leaving the company. Recently there was such case in NJ.
I think before joining any of these companies, as an employee we should ask these questions with out any hesitation. Before joining, these employers will talk very friendly. That point we can not ask below questions because employer looks like a friend.
1) Conditions leaving the company.
We should also agree for reasonable conditions. I think 6 months is reasonable. By that time they make their expenses.
We should make it very clear that we are not going to stay with the company as bonded labor.
2) GC Process. Attorney. Documentation.
We should be very clear on what happens if you leave the company before getting GC.
Will you get the paper work (Labor, I 140 copies) as soon they are approved?
Transparency. Control over the process
Can you have your own lawyer?
3) Joining the client where you are working?
most of us finding projects/clients on our own. There is nothing employer is doing to find these clients. What are the terms. In these difficult situations clients may not be ready to pay head hunting fee to middle company and your employer.
4) Payment.

As you all know, they ask me to sign their contract in which its mention that if i leave their company before 1 year then i need to pay them 15k. Thy also charge me 3k for my H1-B which i am still paying everymonth from my paycheck and we have 70/30. In just six months i am so much fed up with them. These people are so rude...always show their arrogance over phone. I have no libarity to find job by myself. They always looking for higher pay rate sp that their big money tummy get filled up.and i also feel that they didnt told me the right pay rate for the project i am working on right now.
I really want to leave them, Even before 12 months. Is there any importance of that contract letter i signed with them?. Can they Sue me? What are my options? Please suggest me.....i am in stress.
