    As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.

    Currently, USCIS has limited capability to produce reports detailing the status of long-pending FBI name check cases. In addition, USCIS systems do not automatically indicate when a delayed name check is complete and the case can be adjudicated.     Mr. GC_Rip,

    Your are definitely a EB2 worth candidate. A company willing to support you and a good attorney is all you want. There are plenty who have qualified for EB2 with these qualifications.

    Instead of MS, look for a good consultancy or a perm job which will do the trick for you. I do know/understand that it is hard to get consulting jobs and maintaining visa's for family members but look at the bright side, labor nowadays takes only about 3 weeks and 140 if you apply through PP, then you are talking 2 weeks again. You have a possibility to get out of this mess.

    If kids from college gets into EB2 and gets GC in two years, You sure do sir...

    OK now to members who think I am wrong can bash me but this is what I believe in, if a system can tie you down with stupid rules and no accountability on its workers, I am ok with a deserving candidate cutting the line ahead and getting his GC. Hail common sense.

    But here is the one that turns me off everytime I visit the contribute section of the IV site..     I used the provisions of AC21 and changed jobs in early 2005. FOIA requests will work for your I-140. I-140 is filed by the employer on your behalf and is therefore your paperwork.
    It took approximately two and half months to come through.

    Hi,

    I have 3 yrs degree + 1 yr PG diploma. I have been working in industry for past 17 years, and don't think any degree or even doctorate would add much to my qualification for the job that I am doing.

    I am currently filed in EB3 category, and new company I am changing job to are ready to refile my GC. But they won't file my GC in EB2 category, as I don't meet the 4 yr BS requirement.

    My son will be in the highschool in 4 years, and I don't want to spend a lot of money on getting MS to myself. But for the GC I am looking for fastest and cheapest way to get MS program. I have no idea how it works, what qualifies me for a degree, what can I get credits for. Any inputs would be appreciated.

    I am as well in the similar situation as you are in. I am looking to do MS from Aspen University. Its is full online program and it costs approximately $4000 to complete masters program. I have been trying to know more about that university and until now I did not hear anything bad about the university except that the univerisity is Nationally accredited university. I am trying to know whether USCIS accepts Masters from Aspen University. Please let me know if you have got any information regarding this.

    Sunday June 6th, Training will start from 10:30 am. (Venue will be announced later)
    Monday June 7th, Meeting with the legislative offices
    Tuesday June 8th, Press conference in the morning; meeting with legislative offices and a congressional reception that will run to around 10/11 pm. So please book your flights back home on red eye flights Tuesday night or early morning flights on Wednesday.

    I have confirmed my travel plan. I will attend all events on Jun 6, 7 and 8. I have already paid for my airfare. I can bear all the local trasportation and incidental expenses. I don't have a place to stay, though. I would appreciate if someone can sponsor a 3 night hotel stay for me in Washington DC.

    Incorrect.

    You have to register the birth with the consulate (to get an Indian birth certificate) within a year using this form (see part II) (http://www.cgisf.org/visa/misc.pdf), following which you should be able to get an Indian passport. The USA will not issue a visa on this passport since it considers the child to be a US citizen. However, US policy in this regard does not matter if the child never travels to the US.

    WTF? US will decide which country's citizen is our biological child?

    Like the other guy you said, I have an equity of 200,000 in one house and 50,000 in other house. I still don't have green card. I have around 300,000 in
    401k and 150,000 in brokerage accounts. My net worth is around 800k, most of my money is in this country. If I want to continue my lifestyle, I need my GC, that will secure my right to live in this country. AFter 9 years of tax paying and law abiding life, I think i have a right to live in this country, but with this stupid laws don't know when i will get my GC.

    That is exactly the reason why I purchased my 3rd house (additional $125000 in equity) overseas in my home country. So that I don't have to live with the feeling of having all my eggs in this country.

    For now, it servers the purpose of giving me that secure feeling of not having all eggs here. Later on, it can become a retirement house.

    Again, its all about planning...

    Does it really matter who the messenger is as long as the message gets through?

    It probably doesnt seem to be a big issue as it is right now, but I am into Health care and education. In my experience, I have seen issues like this grow beyond proportion and have seen undeserved people dragging away credit from the deserved. I didnt intend to make a post even though I saw they were taking credit for it. When I saw Emigration voice, I felt that they do have more malicious intentions. If it is really a typo, they should be willing to issue a press release that the credit goes to IV and the non existing EV.

    Must an H-1B alien be working at all times?

    As long as the employer/employee relationship exists, an H-1B alien is still in status. An H-1B alien may work in full or part-time employment and remain in status. An H-1B alien may also be on vacation, sick/maternity/paternity leave, on strike, or otherwise inactive without affecting his or her status.

    No, but he must be an employee. H-1 employee can avail vacation, sick days off, unpaid vacation days as are available to ALL OTHER employees. Employer needs to document such policies. There are complex issues involved here.

    Like you said in post As long as the employer/employee relationship exists this is the key part. How to prove employee relation - mostly by pay stubs and employment letter. Also, I-9 Form date determines when employee really reported to start the employment.

    I have read Gandhi's autobiography. He clearly explains that he first tried and succeeded using his manthra of passive resistance in South Africa against appalling treatment of Indian workers. They were on 'H1B' in South Africa and were treated worse than stray dogs. Gandhi fought against that and had some success.

    So the idea of passive resistance DOES work in a foreign land. We are fighting against injustice. Even H1B folks have some fundamental human rights, whether we are in a foreign country or not.
