Hi,
My priority date is Dec 05 (EB2 India) and my case is with TSC. I got approval emails for myself and my son (we both are derivative of the I-485 application filed by my wife) two days back but my wife's I-485 application is still pending.
Is it normal that derivative applications are approved while that of the primary applicant is pending? Should I follow-up or wait for couple of more days? Anyone in the same situation?
Any input will be appreciated.

Well, if there were preadjudicated cases, which is very very likely, getting ready for September approvals, with VB published weeks ago, should be very routine and simple task. It is quite possible that a lot of approvals should be coming out withint the first few days in September. Best wishes to all waiting, particularly to those wth senior PD's left out last year.

I need answers to following questions.
1) Can i apply for mY wife's H4-B renewal while her H1-B application is pending?
2) What will happen, if here H1-B is approved after H4-B renewal is applied and before her Renewal of H4-B is approved?
3) What will happen, if my wife's H1-B is approved before H4-B renewal is applied. On what status will she stay untill Oct 2007. Does she have to go back to India and come back with a visa stamp?
Any other matrix?

Just checked USCIS.gov. Both mine and my wife's I-485 were approved.
"On May 5, 2011, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283."

No one knows dick about PD movement. EB3 filers think that somehow EB2 PD gets stuck or even retrogress and EB3 PDs race forward to 2003/2004, through some delusional logic. Those who filed under EB2 think, EB2 PD moves to 2005/2006. These predictions are mostly prejudicial. USCIS may have some idea after entering all June/July/Aug applications, that is if they can find someone who can add :D.

I have applied for labor certification in Dec 2006. In may 2007 I got a denail stating that the company is not "bonafide". It is a new company and I am the 1st applicant for labor. We sent all the supporting documents and requested for review/appleal in May 2007. Since then we did not get any status from them. My attorney called them last week and made an inquiry. DOL Atlanta said that they need to do the "central check" of teh company. They do this for every new company. Does anybody aware of this "central check". How long it will take?

Called all offices and left voice messages - read this action item too late in the day to be able to speak to the staff themselves.
Rep. Ciro's office did not put me to voice mail of immigration staff. Asked me if I belonged to IV - when I said yes, he said they have been receiving quite a few calls about 'those two bills' from ImmigrationVoice. He also said that since they receive a large volume of calls from their constituents as well, they have to be prioratized over us. He however promised to convey the 'ImmigrationVoice's' request to the Rep.

Hi,
I have entered US on H4 and then I got my H1. I wanted to go to Mexico for my H1 stamping as I have to go to my home country and come back. When I saw my paystubs I found that the SSN number on my paystubs was not correct. I verified with my employer and he says it was his mistake.
Can we correct and regenrate the paystubs with correct SSN. Will these paystubs cause a problem for me during my stamping in mexico. I started working only 7 months ago and I do not have W2 till now. Please advice on how to deal with this.
Its not a big deal. I am surprised, why they even print SSN on your pay-stub. That practice is long gone, because of all the identity theft issues. I dont have my SSN on my paystubs.
Just ignore it....and if they ask, just say "Oh!! I didn't realize that...i'll have to ask the company HR to rectify the error..."

I thought IV core is supposed to come out with action items (or lead - all they need to do is come out with an action thread and people will follow).
if people were to follow all calls from ordinary members then 2 things would have happened ..one IV would have been more dynamic (Since everyone is calling for action items) and people would be running in all directions.
this is probably my last post ..what is frustrating is that whenever anyone asks genuine questions ..people just jump and attack.
as for lobbying ...the maths is simple ..if IV is collecting around 10k (or less) every month ..then it will take 5 plus years to collect the money for any sensible lobbying ...
You are talking as if you follow IV core to their word. People like you criticize IV but never do any useful contribution. You didn't even fill your profile. You haven't contributed even for FOIA and now saying the IV is collecting very less money. Are you insane??

Wow, I am in exactly same boat, So , basically FP results are blocking EAD card production!!... next renewal, It will paper based EAD.!!

Per the guy at the InfoPass counter, the FP report was received on July 24th (which probably explains the July 25th LUD). He said EAD will not be printed or sent out before FP check is complete. In 2007, they did not run FP checks to issue the first EAD after July fiasco.
So could this explain the delay that folks here are seeing? FP Code 2 was done for EAD, so not sure why this should take so long :mad: Maybe I am mistaken, but I thought that only FP Code 3 that's done for I-485 can take a long, long time. Can someone post info on EAD FP checks?

At that time EB3 I used to get around ~15K-20K, from other countries. Then all of a sudden USCIS started vertical spillover, i.e. any remaining numbers from other countries no matter what EBx, will go to EB1 I/C/M and then fall to EB2 I/C/M and then to EB3 I/C/M.
This way EB3-I gets nothing as everything is consumed at EB2-I level.
If there is a way to get USCIS to start horizontal spillover again, then things can get OK, as USCIS does not need any law change, or any legislation change for this policy.
How can we confirm the spillover interpretation. I am not familiar with the spillover rules but my understanding was that only if there in an excess in EB2 then the spillover gets down to EB3. Am I wrong or as per rules should spillover be distribued equally? If it has to be distributed equally then we need to do a mass mail or something and ask USCIS to explain. But I am still not clear if I can apply in EB2 (PERM) as the job requirement says
Minimum of 5 years programming experience
But is really important to SAY THAT’S MASTERS DEGREE PREFERRED,
Because I have Masters in computer science but the job requirement does not need it.
To apply in EB2? Or just BS+5 years of experience is good enough
