I completely agree with Logiclife and the goals IV has setforth to solve our problems. There is only so much one can achieve with limited resources under which IV operates.
We need to have a set of priorities and work on that one step at time. Though I have not been to DC, I can understand what IV is going through to get us some relief. The least I can do is contribute for our cause and thats what I am doing right now.
I wish people had some common sense and better understanding of the bigger picture(& issues) before they get involved in finger pointing and asking for more.
Everyone, please be patient and support IV whole heartedly and financially so that we can atleast attempt to fix the broken immigration system. Though I am VERY optimistic that we will achieve our goals in the near future, but I would not regret even once, if we failed. It is better to try and fail than not give it a shot at all.

Lou is talking about H1 badly. Does he know how schools are facing problems without H1. Thousands of schools have no math and science teachers in rural areas. Why cant he make the americans to work in that area. Most of the schools are using teachers over 75 to 80 years old. Most of them didnt know how to use computers. Then how they teach good to students. Principals are struggling to run the schools with out teachers. Parents are disappointed without proper teachers. With this level, how can America make best future.My kids are struggling without proper teachers. When we ask the schools, they are saying they couldnt get proper teachers. If Lou's grand kids face this trouble, then he wont talk. With this situation, how schools can make AYP(adequate Yearly Progress) according to No Child Left Behind Law. First the Govenment must take necessary steps to solve this issue

My PERM got approved on 07/23/2007 and my attorney is planning to file I-140 and I-485 concurrently by Aug 15, 2007.
I was offered a wage less than the proffered wage till pay period 07/15/2007 and my employer revised my wage to match the proffered wage from pay period 07/31/2007. Hence I would be able to submit 2 paystubs for payperiods 07/31/2007 and 08/15/2007 with I-140 application, which shows that I am currently getting paid the proffered wage.
Please let me know if these 2 paystubs alone are sufficient to demonstrate ability to pay.
We wouldn't be able to submit the employers Quarterly Wage reports with the revised wage as the current quarter ends only on Sep 07.
I understand that USCIS will issue a direct denial without an RFE if the employer is unable to prove atleast one of the following
(1) Net income - The initial evidence reflects that the petitioner�s net income is equal to or greater than the proffered wage
- (Supporting Evidence : Tax Returns).
(2) Net current assets - The initial evidence reflects that the petitioner�s net current assets are equal to or greater than the proffered wage.
- (Supporting Evidence : Audited Financial statement)
(3) Employment of the beneficiary - The record contains credible verifiable evidence that the petitioner not only is employing the beneficiary but also has paid or currently is paying the proffered wage.
- (Supporting Evidence : Annual/Quarterly Wage reports, paystubs)

I think this is good news, but I am not sure if this will affect me. I have PERM approved labor on my name. I didn't apply for I-140 because I wanted my wife to get F1 visa before doing that. This is because F1 application for my wife can have problem if there is immigration petition and she is beneficiary. I don't know how much time its going to take me to get greencard or work authorization for my wife and I want her to get the advantage of OPT after completing her studies so that she can make her career.
So I guess if this rule comes, I have to apply I-140 immediately? Is this true? Please advice me.

Why do they come on wife's account ? Is it legal if spouse makes mistake in any case ?
Wife or child account is considered a 'FAMILY' account and they can impound that account. Unless you divorce your wife and then transfer the money into that account you cannot expect that the money in your wife's (or ex-wife's) account is safe if a judgement is passed against you.

How do you know that all the unused visas go to EB3 before go to EB2?
That is the way the USCIS is interpreting the laws and actually doing it that way...There are two different caps applied to you....The EB2 cap of wharever numbers available and the country cap of 7% for all of china EB+FB combined together.......It is true that there are more EB2 numbers available...But as the country quota for CHINA/India is over they are flowing to EB3 ROW instead of flowing horizontally to EB2 china....There is a big discussion about how this flow occurs and if it is fair or not...The title of that thread is 'Unused visas' Reading that would be helpful to you...
Even if the immigration reform happens, will it take effect next year or sometime later?
Frankly donot know....Last year when they passed 2611 they had put conditions in it to delay the implementation..They can put delay again...That is possible....

If we do not get this problem resovled who will ? All the members in this forum please start taking active part in determining your future your families future and your kids futures.. please do not be short sighted or procrastinate. Take Action NOW, we can do this, please encourage one more person to join in and contribute, talk to other people who are not aware of our plight and educate them, contact your local lawmakers, be active on the forums, support the core members and each others, come on now guys.. may be all of us cant do every thing but try some things at some of the times and some other things some other times :) -- does that make sense .. I wish I was very rich I would have made a HUGE donation to IV to fight for their cause... I really respect the core members for their tenacity, dedication and inner strength to carry on this effort.. admist so much uncertainity and so many obstacles .. and the best part is .. most of the people who will benifit from it dont want to do much about it ..... ok .. We all are in this together...we must solve it together including those that did not contribute a penny so far. All we can do is to convince those people to donate for the cause. You know our folks are not the best ...when it comes to donations:).(Not the religious)

Read the article on today's washington post. I had to email the writer to get the website (email) information. He/She was nice enough to email me the website link. It would've been better if the website link was provided on the article itself, I think that would've directed few more folks to this site. This is a great effort indeed and I am glad I got to be part of it.
