Looking at the table in immigration-law.com, it appears that 33% have been certified and 33% have been closed/denied of the present 67% that have been processed. Those are absolute numbers (it is not 33% of 67% closed, it is 33% of the total 330K). Hence of the 220K cases processed, 110K have been certified and 110K closed/denied.
If the same trend holds, it will be 165K certified (out of a total of 330K). Add the 1.1 multiplying factor and we are looking at 346K total GCs. This is 2.5 years total. But USCIS seems to be sending off excess EB 1-2 visas to EB3 ROW so retrogression will continue for EB2 India and China.
There is some massive confusion here. The Immigration and Nationality Act also says the following for EB3

(3) Skilled workers, professionals, and other workers
(A) In general
Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), to the following classes of aliens who are not described in paragraph (2):

Read the term "Not to exceed 28.6 percent". So EB3 can't exceed 28.6 percent which means unused visas from EB2 cant all go to EB3. Since EB2 ROW is current, the unused EB2 visas should be coming to EB2 India & china as per AC21 law.. no?

maybe we should have a 'sounding board' section where such threads can be started where you can cirb all you want about desi companies/consultants and other issues you want to get out of your system. You do realize that many people read these threads. Spritied discussions are great but upto a certain point and if they help the cause.
We are a small community here and all of us are stuck in a problem we DID NOT create. we are a part of a system that is broken. Instead of crying about problems, lets try and figure out ways to solve one for a change.
if people cannot contribute financially, conrtibute your time and talk to people about IV. Try to meet sucessful/influential immigrants and see if they can help us out, see if they can help us with their contacts. Try to seek people who are stuck in this mess and educate them about it. Get leads on people who can help us out.
Start a thread that mentions what you have done to help IV maybe people will learn from that

Eb3Nepa is very much here from initial days of this organization and supported the cause alot, even more than main members(So called..) here.
That is how he knows the core team members names/handles, even lot of you do not know them...
Only 1 or 2 members are here from initial 12+ core members..That is another thing though.
Anyway, as others mentioned, people have to move on..and this movement is just not by core members but by all. Core members comes/goes, after their journey, unless they have some agendas. (In the +ve way)
Hope, you do not start another storm here...

This data is ambiguous from the USCIS. It very well could represent pending 140 petitions, in which case all the euphoria would turn to shock. We must try to get clarification about this before anything else.
One of the tables there mentions the NIW, that is determined at the 140 level, after that a 485 is a 485 and it goes into the EB2 queue. So when they list that in the breakdown, I suspect if they may be referring to 140s here. Additionally they list either no NIW140 or NIW-based 485s from the NSC. If they are referring to NIW based 485s, this is incorrect, since I am one of those with an approved NIW and pending 485 at the NSC. There are others like me on IV physician forum.

So the rule hasn't taken affect yet huh! I will definitely send my application out in premium processing this week. Just worried that I have passed the 45-day time period :( . Does my I-140 have to be approved before this rule is implemented, or just that my application needs to be filed ?

Meanwhile, I printed out AC21 IV campaign letters and went to each of my co-worker at my work-site and convinced them to send it. Hopefully atleast some of them will send it. Friends, I already have expressed the views regarding Recapturing/ temporarily increasing Employment Based Visa Numbers for Greencard, on change.gov website . I have been getting E-mails from Transition Team. I have pasted this recent E-mail which is about Meeting with Transition Team. I think, IV Core Team members or/and people living around Chicago area should arrange meeting with Transition Team, and express and suggest our ideas regarding Recapture/Temporary Increase EB greencard Numbers to clear the backlog.

Hi All,
You know my old H1B case was reopened on Sept. 28, and the USCIS Emailed me that they sent a notice. But I haven't received such notice, my employer/attorney also didn't receive any notice. I wonder the USCIS didn't send this notice at all!

Read again. I did not call the consultants sleazy. Also, I did not generalize them. My support is followed in the second line.
To me, this statement does not really deliver anything substantial or meaningful. Can you please reiterate?
Again, this statement does not serve as a counter-argument because this is a fictional scenario and does not hold importance here.
This is not an argument about accounting principles. Even if I tie your statement to my points, it does not compute. I am against labeling and generalizing EB-3 and I said that in my post. Please read my post again.

Everybody is trying to survive in this world ..diff people react differently to same situation..lying on resume/achievements is not illegal(reason y no body is prosecuted because of this fact..they are simply denied that benefit) however its unethical ..but iam not here to preach ethics.
A fictional scenario to check whether you are ready to take advantage of a loop hole if its in your favour.( A nice quote on this -Everybody likes discrimination when its in their favour and they dont raise their voice then)
My point to say all companies lie/manipulate things to certain extent..desi consultants atleast dont deprive lives like other BIG companies where shareholders are kept in dark until they realize that company is no more worth anything.
Iam not supporting any malpractises are anything anyways this is not a criminal thing its just immoral ..however if theres a loop hole and people want to chance it its upto them. They will be appropriately denied if they are caught, However its not like they are killing anybody.
Finally what do you think when even govt is planning to make illegals legals ..its respecting peoples wishes against legal things(ofcourse they get benifitted)Humanity/compassion is number one..rules are for our well being ..they are not hard and fast. Also it is really funny and I use to think it's just me, but I am glad someone else is also experinced the same,
Myself, I was able to file I-485 and renewed EAD 3 times, which means my wife is working from past three years, I have changed job using AC-21 twice and my salary is increased and have better job, which means I am not too much worried about getting GC, but I still contribute to IV and call lawmakers many times.
The FEAR I see among many people is really pathatic, I know couple of friends does not even want to talk to me on phone about this matter thinking that some one might be listening,

It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.

I have sent money using icicibank's M2I service . Usually they take 5 working days to remit the money(atleast 8 days to transfer). I made four transactions last week(mon, tue, wed, thu) and they already remitted the money using low conversion rate.
It just took less than three days to remit the money this time. Bank deliberately did this just to steal money from me. I have lost more than 35 paise per dollar and it comes close to Rs 10,000. This is ridiculous and its a big robbery.
How do i get my money back? How do i make a compliant about this bank? They have no one to assist me over the phone.
What to do now?. Rs 10,000 may look too small for us. But how can we let banks to act like a criminals.
Any help/suggestion/comment?

What would you do if the opposite had happened and if you were in the money because the currency moved in the opposite direction after you initiated the transfer. Will you return the money to the bank?
So, stop whining. If you are so smart that you can predict currency movements, then hedge your money transfer with some other instrument.
