    First of all learn to "conduct" yourself in public before working for the semi conductor industry. What is gulti mentality pls explain? Second of all you chose to come here with the constraints that were imposed on you, did you have the balls to question the immigration officer as to why your wife could not work? If you think this is hell my friend you are in for a rude surprise.
    When you want answers for your question there is a method for asking it, pls follow that method and you will get your answers, there are more people willing to help here than you will find anywhere. Ranting about communities will get you no where, now apologize and ask your question, someone will answer.

    Malibuguy007 , you seem to me a guy who could save 2-3000 dollars per month and think you are in heaven(Typical GULTI mentality) . These are the points on basis of which i called life of H1 hell

    1. Your spouse can't work . Think about their self esteem and self respect they are loosing.

    2. You don't know about your future if tomorrow you loose your job , you will be kicked from this country.

    Tell me what is hell then ? Don't think its just about counting dollars , think about your life stability and about your family members too. Try to come out of Sambhar-Rice world(thats the way you save money here and call US heaven). Live with pride ,ok . Fight for being treated like H1 ( HIGHLY SKILLED PROFESSIONAL) not slaves.

    I do not believe original employer was involved in any Fraud but he did have financial trouble ( paying salary after 2 months , check bounce etc - that is the main reason I left) .
    That company is MSU software based in Iowa ( just in case if anyone knows about it ) .

    I tried several times approaching USCIS as well as Congressman's office to find the details of delay / extended review status etc but all I got was we need to wait until the review is complete.

    I had switched attorney as soon as I joined company B and they AC21 and I have copy of the all the docs including the letter requesting to remove the old company A attorney . Also last my company B changed the attorney firm to a different one and they did sent a new G28 for that .

    I am kind of stressed until I see the letter which is going to be delayed because of the snow Storm :( .

    I know what you're going through. My own case got denied by someone who'd only been in the job for 2 weeks and she denied it because she said I didn't provide a document which was not only provided, but they had two copies! AND I saw it while she was fiddling with my file at the interview. Sometimes, it's just sheer back luck. So if you know you have everything you should have in your file, just chill. It's another bump in the road and it'll mean more waiting for you, but it's not the end of the world.

    Don't worry about this bill being rejected. I am pretty sure one way or the other they need to increase the EB visa number soon, else definetely USCIS will be in big trouble with thousands of applications sitting there for them, now having said that USCIS will find a way to get some bill which will have EB visa count increased passed in congress, so untill then cheer up and complete your filing.:) :) :)

    She also made a statement that she will try for more benefits for permanent residents.

    She does not want to support only the people who are in the process of immigration???

    I have been interviewing for couple of companies ...the first question they ask is ...Are you US citizen 2nd question r u Permanent resident ..no..

    Companies do not prefer US citizens over Immigrants...I don't know where this misconception comes in to play...
    There was a guy in our office who used to complain about Chineese and Indians stealing jobs...Believe he is a big slacker ..he recently got fired...people like him form these programmers guilds.

    We do not work for less and we are not paid less...may be they deduct our Gc expenses but not much

    Why is there a misconception about us?

    Lets get this thought out of these bone heads

    What Raj is saying is get your GC first and process your wife's through family based which would take a very loong time...10 years!!!

    Now to my views..Your wife will be able to piggyback on your 485 application irrespective of her status H1-B or H-4 or F-1..She's your wife PERIOD...no problems there!!what i don't understand is this bangwagon "lets apply ours first and include our wife's petition later when PD becomes current"...Instead y not apply both petitions together when PD becomes current again!!Atleast you wouldn't have to worry what if my petition gets approved b4 my PD becomes current!!!And god knows how many years of H1-B extensions they would give you once you have your applied 485 receipt!!!At the end of the day it is your choice!!!

    I personally think that 6 month rule-of-thumb is nonsense.

    AC21 clearly states you can switch employers 6 months after your green card application has been pending. On what legal basis could USCIS then come back and deny citizenship to anyone for switching employers too soon after getting their green card?

    I'd really be interested to hear if someone has specific knowledge of a case where someone had their citizenship denied due to switching companies too soon after getting their green card.

    I'm just curious as to how many postings you see on these boards where a persons case has been denied; DOL/USCIS has visited their home; their visa got cancelled by consultate when h-4 went for stamping; got caught in interview lying; DOL investigating companies, etc...

    People do not post these types of issues on immigration forums.

    This whole discussion is really silly... I'm glad IV leadership is not self centered, atleast from what i see they think about the community on the whole.

    Lets put all these fruitless arguments to rest... the ROW vs India/China, Nurses vs Others, EB1 vs EB2 vs EB3!

    I'm EB3 India and I have no one to blame but me for being in EB3 (I'm certainly qualified to be in EB2 but I chose to stick around with the same company for the very reason we all are here on this forum... i.e GC)

    For those who think its unfair... rather then sulking about it... do something and move to EB2 if you cant wait any longer... or at least support IV in their efforts.

    Well Said! Being someone else stuck in EB3India despite having a US masters, I have come to the same conclusion, and after July Fiasco, was convinced that IV is indeed the only organization that is doing something for us. I have supported IV in whatever I could since then.

    Guys, I do believe IV is the only fighting chance we have, debating on this forum and demanding "justice" or whatever from USCIS is not going to get us anything.

    I respectfully disagree, he is the president of USA and to its citizens, you might morally/personally declare him to be your president, but as long as your passport is not from USA you my friend are an alien (not extraterrestrial) living in the US of A :), please dont take this personally I am in the US too, and I got my passport recently renewed, and I had to pledge my allegiance in order to get my passport.     Is there any way to know whether our case is already preadjudicated or not? Is it OK to call USCIS customer service number or taking an infopass appointment for just checking that?

    I just want to have some peace of mind as USCIS is not require (hopefully :)) any documents from our side, if they already preadjudicated us.

    Please share your experience....

    Thanks to everyone who has contributed so far. You contribution not only helps the efforts, it is also an indication of the magnitude of the problem.

    Please remember to ask your other H1B friends to sign up and convince them to contribute. One person can only contribute so much but one can always ask co-workers and friends to sign up. Even those who are in their 2nd or 3rd year of H1 and have just started GC should be considered as people who will benefit from this effort. They may not realize it now, but sooner or later they would.

    Download the flyer from "Resources" menu and spend an afternoon outside local indian temple or indian grocery store. Ask people to take a copy and politely say "this is for information...I am not selling you anything" -- so that they dont discard it away and at least read it. Many of people either dont know about retrogression or dont know about immigration voice that is acting to curb retrogression and labor backlogs. Out of 500,000, if we can reach 10%, its still 50,000. With 50,000 members, the possibilites of what we can achieve is sending 10,000 volts thru my spine.

    MS - Fast and Cheap.

    Fast - Typically MS degree requires 30 to 36. credits or more. Typical full time student takes 9 credits per semester. Assuming you are going to take Course Only option.

    Maximizing your Study Plan - 12 (Fall) + 12 (spring) + 9 (Summer). There you have it the Fastest way. I don't see a way to get MS faster that 1 year.

    Cheap - Cheap can be in the form of Scholarship, Financial Aid or atleast In-State Fees. If you plan to work full time and study 12 credits, get ready for a bumpy ride for 1 year.

    These days, you get RA/TA only if you work for a professor and that will take you into Thesis Option. Completing Thesis + Course work in 12 months is no simple task, when schools generally require 2 semester of Thesis work in addition to course work.

    Online MS is another option, but its not cheap. Find a nearby school where you have established residency. Talk to schools Admission office to see if you qualify for In-state Fees based on your resident status.

    The main goal of IV is to bring an end to labor processing delay in the backlog center and I-485 retrogression. We have consistently mentioned this in all possible forums. This has been clearly mentioned on home page. And if there is anybody who has any doubt, we would request you to please call us at (281) 576-7185.

    I am beginning to realize that for some people who do not want to contribute, there will always be plenty of reasons and plenty of excuses not to participate & contribute. I think these people are the ones who are actually responsible for the problems of all of us. Our problems do not originate in the slow GC process or the existing bad legislation. Our problems originate due to the people who are always looking for reasons to not participate or do anything or these people who are always looking for reasons to feel offended. And these people are sure doing a wonderful job because there will always be plenty of reasons to feel offended or not feel part of the group or not find enough motivation to feel part of the bigger community.

    Asking questions or requesting a specific item in the goals is one thing. People beating the drum of transparency …. That is no big deal either. Everybody is entitled for their opinion. But people watching from the sidelines or for the people who want to include agenda as Goals of the IV or for the people putting conditions to their contributions, here is what I have to say to you. I would sincerely request you to never visit Immigration Voice or any other immigration related forum or website. You guys are the real problem because you are the once helping to foster the current system by not participating in brining the change. At the end of the day, know that you are the real culprits not the system which will be shaped by the contribution of each of us.

    In last 2 weeks the contributions has really come down drastically. Everybody please note that we are running very low on the funds collection. All of us have two choices. One, contribute for this cause generously and lead the friends and acquaintances by example and tell them to do the same. Secondly, find reasons to not participate or not to contribute due to this, that or whatever …. The choice is entirely yours. But with your choice also understand whether you are being part of the solution or part of the problem. And whatever you do (including posting negative messages), I would sincerely request everybody to ask yourself one question, whether you (or your post) are strengthening or weakening this effort.

    I would like to request all the members who have not yet contributed to please contribute generously. Please put your money where your mouth is. This effort or any similar effort for that matter cannot do much without the necessary funds that only come in the form of contributions from its members. And for those of us who have already contributed in the past, its time to please contribute more and help to fuel this effort.

    This is not just about the life of the people who started this effort or the core/active members who have taken the initiative and responsibility. This is about all of us whether or not you feel part of it or not. It doesn’t make any difference how you feel about the situation or state of affairs. Why? Because this will be over very soon. And for the people who want to continue to ponder over this idea of whether or not they have a sense of belonging to IV, I would sincerely request you to please understand and know that by any contribution to this effort, you are strengthening your own voices. Know that this is not about anybody else but you.

    I think with 17 years of Experience you can easily be filed in EB2. You need better Education evaluation certificate.

    Try talk to these guys and see.......they are wonderfull and best i know.

    As I understand that the Tri State area is very big and has a huge population and everyone would love to make it to the events, a lot of events are being planned.

    Now for those who cannot make it to NYC, please arrange your own MEET AND GREET events in a local Starbucks or meet up in a local mall food court or any other place you think is best - conference rooms in apartment complexes are very ideal places for meetings.

    We want volunteers from the following areas

    (1) Long Island, farther east - till Riverhead
    (2) South Jersey, West Jersey
    (3) Connecticut (Northern)
    (4) Upstate NY (Albany and Poughkeepsie)
    (5) Upstate NY - Syracuse, Rochester and Buffalo

    Those of you who are now thinking that being able to file 485 will give you freedom - just read through the list to see how many 485 filers (mainly Indians and Chinese) are stuck in the name check russian roullette.

    This is one of the biggest bottleneck to 485 and naturalization processing. Most would think it would catch moslems - in reality it catches anyone in "hi-tech" and more often than not Indians, Chinese and Russians. And ofcourse Koreans too. One of the person's stuck in name check commented on the above link - if the FBI knew that a fifth of the nation shares the last name Kim! I guess the same would go for Wu, Yu, Zhou, Singh, Kumar etc.

    Different problems at different stages in the path to GC !
