Why the bloody hell are you guys judging him for what he has done? He only asked for some advise regarding immigration implications of his situation.
I do not think any of you who is beating him down like this has any right in doing so. I bet that each and every one of you have done more mistakes than Mr.Sahaayam did. You just were never caught. You must have done more filthy things than 'shop lifting'. I'm sure you have all lusted after women, watched porn, frequented strip clubs and drank a lot of filth. Some of you might have slept with more than one woman.

Nancy Pelosi has long talked about her first 100 hour agenda and immigration is not on it. It would be amazing to see any immigration talk in lame-duck session.
Although, it would be a good start because both parties agree on it but I don't think the strategic think-tank in either party will rush to do that before seizing each other's deeper 2008 Presidential agenda.

I think this has been discussed on some other thread.. would it be a good idea to make the contributions public.. may be, this encourages others to contribute, when they realize how much more is needed to reach the monetary goal.
I attended recent meeting arranged by IV in Virginia and they discussed about all this info you are asking. I don't think core team can publicly disclose all this info. They even showed us the recent bill they got to pay the lobbying firm. So next time there is IV meeting please attend it and your questions will be answered in private but not in a public forum.

Look, the H1 quota was not sufficient even when it was set at 115,000 pre-2000. It was only when it was set to 195,000 in 2001 that the quota exceeded demand. Now thanks to the report by USCIS last year, we know that about 20% of the H applications had fraud or technical violations. Even if you assume that the USCIS does a perfect job and catches this 20%, the quota that will be freed up won't be enough for the rest of the applicants.
The issues we face have less to do with fraud and more to do with the anti-immigration forces who dislike the 1965 immigration law. Claiming fraud, cheap labor, harm to the environment from increased population are just convenient means to couch opposition to permanent immigration in.

You really cannot ask for more EB3 numbers or 'treat EB-3 fairly'...Laws are made by the congress and they provided certain numbers to each country & category. USCIS has to follow these norms and apply those numbers and USCIS has followed the rule and have applied the allocatd numbers to EB-3. Problem is not that they are treating us differently or we are getting an unfair treatment. The problem we are facing is because we are just too many in number and the problem is Congress didn't make any laws to provide relief to people if one country or a category becomes hugely backlogged...unfortunately, the Last time they did any law for EB immigrats, it was in 1999 or 2000 when they brought AC21. Since then there has been huge surge in immigration but everytime anything immigration related legislation was brought in congress, it has been shot down..In my opinion we can get relief only if congress acts upon it, USCIS is working the way there were tld by the congress

I have EAD approved and 485 pending over 180 days. But 140 is still in process. My company decided to lay me off. What options do I have ?
1. The company is not mean to revoke my 140 unless it is required by law to revoke 140 for all lay offs, Please advise.

I have heard and seen far too many such "stunts" and public displays to be excited just yet.
But it would be disastrous in terms of PR if even this fails. But like you, I would not hold my breath for this but am cautiously optimistic at the same time.
Also, please realize that any changes to the bill will meet absolute resistance from both sides. We will have to wait and see how many amendments are they planning on allowing.....

Please note that the Form I140 is no longer valid for porting purpose under section 106� of AC21 if the I140 was revoked due to the fact that you did not meet the minimum requirements for the labor certificate at the time of filing. Due to the fact that beneficiary of the For I140 was found to be �unqualified� at the time of filing you are not eligible for relied under section 106� of AC21.

I am not very sure of the details, a person I used to know was forced to join his previous company because they threatened him in similar lines.

If nothing works go kick the ass of the person who is responsible for your predicament. Interpret kick ass to more severe alternatives. Some companies are anyway taking advantage of people stuck in GC queue. On top of that if they harm us they need to pay a heavy price.

Same with me too. My application was moved from NSC to TSC and has been lying there since then. Hasn't been assigned to an officer yet:mad:
I never had any RFE, but my case has been bounced around for no reason. From TSC->CSC->TSC and I am told that it is not even pre-adjudicated not even assigned to any officer as yet. I have yet to see any more illogical organization other than USCIS. :mad:

Thanks for clarification. I still disagree with you. Media outlets do measure the intensity of the issue but not by amount of SPAM they receive in e-mails. From my personal experince in talking to a journalist, if you send them an e-mail regarding the issue they have published they will definitely defend their point or refute yours and may even look at the issue from your point of view but in all cases they will reply. Now if you want to bring an issue to their attention all you need is take their article and simply put your perspective on it. It will have a far greater impact if it comes as a collective voice of an Organisation such as IV. That's why I originally questioned our approach of spaming them by sending 1000's of e-mail with the same issue. It doesn't bring much to the table. Right ? That's precisely the reason why all organisations have a media relations person who represents the collective view of the entire organization and manage the press releases and all contacts with media.
Tell me about getting a response from reporters. It all depends on their whims and fancies. If they want to write, they are after you. If they dont want to they evade your emails. You have already considered our emails SPAM :) Thats what it would be considered if a bunch of people send the exact same email body. If we do send different message, it might still occur to them or a click to these forums will make them feel that we are trying to get more media exposure. What if the reporter you are writing to has an opinion similar to that of Tancredo on H1B? You are talking about taking an article and putting a perspective on it. Can you be more elaborate? If you are talking about articles being written on us, I believe there are not a lot. How ever there are talk shows that go into every home in the country that do propaganda work. I fall into the group that believes that this is one of the siliest competitions around today. When I say sily it is not in the sense that the game itself is sily but rather in the importance it is being given. Particulalry have you seen any other competition where the parents are also on display this much? By the way are any of these kids good writers? Has any of these winers ever produced a great novel/poem? if so they should tell us about that. Moreover, how many of the greatest inventors/scientists are great spellers? This is the only country where this type of competition is given such national prominence. I would say let them have maths/science/quiz competitions on such a national scale and media and that would be a great stimulation for others. This almost makes Indians and Chinese look silly!:D:D

I have lived in Nevada before. I think in that state and many other western states (where guns laws are more liberal) you have to have passport, I-94 and utility bills proving you have lived in NV for 6 months. That's it. You don't need hunting license to get a gun license.
Here is the biggest irony:
IN order to own a gun, FBI needs only 2 days to check your background.
IN order to get 485 approved, FBI takes months or years to do a background check.
I guess green-card is a more lethal weapon than a handgun.
There are federal firearm laws and then there are local (state) firearm laws.
State laws can be more restrictive than federal laws (atleast when it comes to firearms), but never less restrictive.
Federal law states that non-immigrants (even AOS) are prohibited from owning firearms unless they fall under one of 4 exceptions, the easiest one being the hunting license exception.
If you have a valid hunting license, issued anywhere in the United States (you could live in NV and have a hunting license from NY) you are okay on the Federal level.
After you have met that exception, you have to check and see if your state has additional restrictions.
Some states don't discriminate between citizens/non citizens when it comes to firearms, some do.
e.g. in MA, non-citizens (even GC holders) are only allowed to own non large capacity rifles and shotguns, which means no handguns, and no large capacity rifles (ARs, AKs and the like).
Logiclife, yes, there are some cases where a non-immigrant accidentally manages to bypass the hunting license requirement. This can happen in states which issue their own non-citizen permits. The applicant gets the 'non-citizen' permit and thinks that he/she has done their part and is now okay to purchase/possess a firearm. This is somewhat of a loophole that every non-immigrant buyer should be wary of and absolutely avoid. Sometimes the NICS background people can also approve the transaction without realizing the non-immigrant situation, but that doesn't mean its okay, I have confirmed this with the ATF on the phone.
Getting a hunting license is not difficult though, passing a simple hunter safety course is all that is required.
That being said, I am very pleased to find responsible and safe firearms enthusiasts on this forum.

The applicant gets the 'non-citizen' permit and thinks that he/she has done their part and is now okay to purchase/possess a firearm. This is somewhat of a loophole that every non-immigrant buyer should be wary of and absolutely avoid. Sometimes the NICS background people can also approve the transaction without realizing the non-immigrant situation, but that doesn't mean its okay, I have confirmed this with the ATF on the phone.
Getting a hunting license is not difficult though, passing a simple hunter safety course is all that is required.
That being said, I am very pleased to find responsible and safe firearms enthusiasts on this forum.

Yesterday, I was told by the client that my project is going to end by this month end i.e Apr 30. Actually it was supposed to go for the next 2 years. I am currently in the project working for the project. They said the lay off was becoz of budget

Sorry to hear this however you can go for COBRA. these days u can avail Obama discount as well which brings your insurance down by 60 percent so u will be pretty much paying the same what u are paying now.
Employer has every right to terminate employee so we can't go gainst the emploer.

Just talked to my lawyer..he said even if we win the case...eligibility is based on the court order...court order may allow every one or only limited people who are in the class action...and in murthy.com they clearly mentioned that, USCIS MAY look at the apllications very closely who are in the class action....who wants that..
