    Los Angeles � Reeves & Associates, A Professional Law Corporation filed a class action lawsuit today in the U.S. District Court, Central District CA, Case Number SACV08-688 JVX (SHx) on behalf of tens of thousands of immigrant families whose adult children have been wrongfully denied of visas. Attorneys for the families are seeking to compel the United States Citizenship and Immigration Service (�USCIS�) to act in accordance with the provision of Child Status Protection Act (CSPA) that enables children to reunite with their families more quickly.

    Prior to CSPA children who reached the age of 21 were no longer eligible to obtain an immigrant visa with the rest of their family. These children became known as �age-outs.� However, Congress enacted Section 3 of CSPA, codified as INA � 203(h)(3), to keep children together with their parents. Specifically, this provision allowed children to automatically convert the visa petition and retain the original filing date � known as the priority date � after the child had aged out. As such, an aged-out child, who is a derivative beneficiary of the visa petition of his parent, can reunite with their family faster by utilizing their parent�s earlier priority date. As of today, USCIS has not only failed to comply with INA � 203(h)(3), but has also failed to promulgate regulations or issue policy memorandum regarding this provision of law.

    �This case affects tens of thousands of immigrant families,� said Robert L. Reeves, founder and Managing Attorney of Reeves & Associates, APLC. �A child abroad who aged-out is eligible under CSPA for an immigrant visa, and if the child is in the United States, he or she will be able to adjust to legal resident status,� explained Mr. Reeves.

    The class action lawsuit presents two different classes of aggrieved individuals. Nancy Miller, a partner with Reeves & Associates and co-counsel, describes the two classes as �those who filed petitions with requests for retention of the parent�s original priority date whose petitions were denied and those who have received no response at all to their requests for retention of the original priority date.� In both cases parents remain separated from their children.

    Although USCIS has granted some visa petitions and permitted retention of the earlier priority dates pursuant to INA � 203(h)(3) to some, there appears to be no uniform policy from USCIS as a whole. Jeremiah Johnson, a partner with Reeves & Associates and co-counsel, said �the lack of any regulations or even policy memorandum has lead to arbitrary and inconsistent decision-making affecting thousands on a global level.� Joyce Komanapalli, an associate with Reeves & Associates and co-counsel, added �USCIS�s refusal to issue visa petitions with the original priority date is at odds with the language, structure, history and purpose of the Child Status Protection Act.�

    �It is incomprehensible why USCIS would deny these requests given the plain language of the statute and the Congressional history of CSPA.� said Mr. Reeves.

    The class action lawsuit is seeking to compel USCIS to properly adjudicate all cases filed under CSPA, or INA � 203(h)(3), and comply with the requirements of retaining the parent�s original priority date in subsequent petitions filed by the parent.

    It is surprising (rather shocking) to see how a discussion on an EB bill (which might never see the light of day anyway) has degenerated into an oft-repeated rant on how IV does not represent EB3.

    When I meet with my lawmaker's office (and when I again meet in Feb), I repeat the IV provisions which are for ALL EB and not any specific category/country. THe problem with EB3 is the with the way the EB system/inventory is set-up. It is stupid to convert a chronic issue into a "IV is not trying" debate. As always, we have lots of armchair critics and few grass-roots workers.

    By using the keyword oft-repeated (i will ignore the word rant because only an immature mind will call the other side of a discussion as rant) it would imply that many EB3 members have raised the same concern in this forum before and i am not the first and believe me when i say this i will not be the last also. So that would mean a whole bunch of people (remember eb3 are 50 k and eb2 are only 12k) have the same concern and they have raised the same concern in this same forum so that would mean IV is aware of the concern.

    Now what has IV done about it ??

    Meeting a lawmaker with the support of IV behind you is not a reflection of a big effort on your side. The power behind that is IV. Now for me or any other EB3 to meet a law maker is not something i would consider an effort since EB3 are willing to put the same effort which you are putting only if they believei n what they are doing. To believe a person needs to feel that they are working for a cause that will impact their situation. Sadly this is missing and that is why EB3 people are cool about the whole meet the law maker process

    Regarding the statement I repeat the IV provisions which are for ALL EB and not any specific category/country. THe problem with EB3 is the with the way the EB system/inventory is set-up. can you tell me what specific steps has IV articulated to resolve the specific issue of EB3

    By your own definition this is a chronic issue and what we are taught is that any issue which is chronic needs to be redressed and when it is not it becomes a big issue which cannot be handled

    As always, there is the name calling stating that EB3 people are armchair critics and whiners but when you are part of a community and you have issues you will air your greviences in the same community not to some one who has no idea or does not care about it

    What is really suprising is that in EB community itself EB2 does not care to listen and provide and open discussion about EB3 issues. Now according to me that is shocking

    BTW i commend your effort of meeting the law maker but if you introspect the only reason you are making an effort is because you believe your efforts will bear fruit in the form of a GC soon (I believe you are EB2 with a priority date of Apr 08 and current EB2 dates are May 2006)

    Thanks for the offer, but this is just a preliminary meeting for me to meet some of the people I have worked with over the past year via phone and email. However, since these people have some influence, I also wanted to discuss with them some of the more important issues facing skilled immigrants. I will mention the idea of meeting with more people in the future. I think it is important for them to be more in touch with those who are affected by immigration policies. My sense is that many of them don't understand the issues very well.

    What's so immoral about sending them to their home country without splitting families? We are not putting them in prison/guantanamo. The first amnesty was a big mistake and not justifiable. C'mon 8 billion is a expensive? Illegals cost California 10.5 billion a year in welfare, stamps, education...

    There have been a number of publications that have shown that the vast majority of the "illegal" immigrants actually pay SS and Medicare taxes. They also contribute to federal and state tax regardless of the benefit that they receive from it. (Some of these publications have been presented in Congress over the years). What some of the right wing folks (like Lou Dobbs) say is that they are sucking the system dry. That is very debatable. The fact that they can only avail of emergency medical care is the fault of the system here in the US.

    Not sure if you are aware that a majority of the farmers especially in the South are willing to hire American workers but have had no success. The only thing that the US DOL have managed to confirm is that there is a shortage of workers. Can some of those be filled by American workers? Sure some but not all. Its just that lots of them don't want to fill those positions for various reasons. An American I met a few days ago was telling me about how he was unemployed for almost 3 years. He is a well educated person and didn't think it made sense for him to find low-skilled labor!

    Agreed. I still fail to understand how a change in medical insurance can boost the economy or improve unemployment.
    The reason there has been this huge push for health care reform is that it becoming a huge drain on the system. About 60% of bankruptcies in the US were due to medical bills. You and I might be lucky that we are healthy and employer paid insurance. Millions don't have that benefit. Also consider that some people couldn't buy insurance because they had hit a "lifetime limit"! So if someone has cancer (which I might tell you is frightfully expensive to treat), and then had a relapse, you could very well hit that lifetime limit. So once you retire, you would have no recourse. Also remember that health care was declared a human right by the United Nations. (see the UNDHR Article 25)

    I agree that the immigration system here is a violation of civil rights because we, too, like the "illegals" contribute to a system that we cannot benefit from anytime soon. (Like social security and Medicare). We do need to push legislators to come up with a good immigration policy. Bashing another immigrant because they came here to do something different from you is not going to get us very far. Be compassionate towards those people too. They too contribute positively in a very different way to society here in the US.

    ND Oct 15th 2007.

    He is extremely happy and over the moon after a long wait.... My case was added in later 2008 Aug RD as a dependent and my status hasn't changed yet. I don't know if it is important that I get mine ASAP as well... Will I be getting it soon, as well? Any thoughts. Do I need to follow up?

    Coming to point, in my previous blog �Peace of mind � Do you have?� the whole purpose of writing that story detailing every minute & every hour is I want people to come out of comfort zone & see the reality. There are lot of people who live in comfort zone & when I say comfort zone all they care is they have a job, paying bills on time, enjoying weekends with family, vacation etc. I want them to come out of this comfort zone & see the reality out there & that is the reason I tried my best to put out my story in detail so I want people to imagine in my shoes for 1 min & think of what they would be doing if they have to face this situation tomorrow so they can better prioritize & plan accordingly. I have written this �Peace of mind topic� keeping in mind for both who bought houses & also those who did not buy house because not having a house will not put anyone in comfortable position when a job is lost.

    I was under assumption after I finished & posted my article that people will take my experience & take a quick look at their priorities & be prepared but instead I have seen some comments like �bullshitting, Bollywood Melodrama, Cribbing, loan defaulter�s, fools, pretent to be shell shocked, overly optimistic etc but I failed to understand that how these comments are going help others ( I know your intentions were good ) instead my whole point of writing has become useless because some wants to target only the original poster & neglecting the actual content. To clarify few things let me explain on some serious concerns raised by others on why I bought a house in first place & as I said in this article this belongs to people who bought houses by mid 2008 & before. My simple answer would be �good quality of life� & I know that this wont suffice you & it might lead to another negative debate. So let me explain in detail.

    I have been in this country Since 2000 & I have seen & survived previous recession so I know what it�s like. I was also present in NY city when 9/11 happened & I have to go through what every asian looking went through those tough period & believe me it was not easy. I also survived NY Blackout spending the whole night at port autority. The reason I am saying all this I am not a new comer to this country & I have seen both good times & worst so I know deep inside that whatever decisions I take I am not just taking for sake of it & neither did I buy house as soon as I came so I can gain equity. Now after all this 8 years & moving two Jobs & shifted to California in 2005 on a full time job my priority date is still now 2007 EB3 after so many years. When I shifted to California in 2005 on fulltime job I would have bought a house but I didn�t because of several reasons like many of you 1) i was not able to afford 2) My wife moved to H4(worked on H1 in NY) at that time. It is only after my wife got EAD in july fiasco & after she got a Job we started looking for house in beginning of 2008. My H1 was approved & stamped on January 2008 & I know for sure that I will be in this country for next years & we also have a EAD . Now that we have Dual Income & market has come down slow low & no one can predict when it will reach bottom we started looking for bargain foreclosures houses.

    The only reason we want to buy a affordable house is to give a good quality of Life, stability & good neighbourhood for my daughter ( actually born in September ). So here you have two options either you choose to be in rented place & pay almost same amount in good neighborhoods for what you pay in mortage or you start looking for a house for affordable house & mortgage in good neighbourhood. I chose the later as the only downside is I have to pay that 10-15% downpayment & I was willing to take the risk as I knew I am here for sometime. Now for the current 30 yr fixed mortage payment is only 300$ more than what I used to pay for rent. Little did anyone know during early January that major financial companies will file for bankruptcy. It is only in late 2008 when Lehman failed & the actual crash started to happen & market collapsed which lead into recession.

    So imagine even if I did not buy a house & had that down payment with me, the fact that loosing a job will not put me into comfortable position even if I had a GC. The least it would help is pay bills for few months without a job & I am sure all those people who did not buy houses didn�t plan to live on their savings until market gets back. I also mentioned in previous article �is it easy to leave everything behind? Yes if you want & No if you want to fight� & I said No, I want to fight. I mentioned that I did have some reserves & I have many backup plans even incase of worst scenario. I was merely pointing out that it was one of my worry but I did not mention anywhere that I am bankrupt. Also since my wife was on EAD now we were confident that atleast one of us will find Job sooner than later

    So the notion that people who bought houses without a GC are dumb, fools, morons & all other filthy language against these people should change. As every individual is different & everyone has their own priorities & life style they chose to Live. Also people who came here ( highly skilled ) know what they are doing & some take calculate risks & some chose to lead simple life. No one should dictate others life on how they should live their life. Again I read somewhere interesting that there is very thin line between stupidity & guts & ultimately it is the person who take decisions will have to face the consequences (good or bad). So guys� buying a house is not choosing happiness for material things, at least not for me. You need not associate all the people who bought a house are trying to live American dream at whatever cost.

    So guys/gals I sincerely believe that you did nothing wrong & should not be ashamed if you have bought a house because that is the quality of life you chose to live. The worst anything could happen is you will sell all this & go back to your country but not empty handed. You will go back with your assets ( lovely wife, children & skills you gained ) & these assets will help you shine wherever you are. You can also proudly tell your children & grand children that you never had to live pathetic life in America & you have always lived American dream in America.

    I will end this by telling a very short story.

    Back in 2002 one of my colleagues daughter who was 10 yrs at that time immigrated to USA. After living for few days one day she asked her mother �Mama have we become poor� The reason the girl was asking was back in home country in their village they used to live in big bungalow with 4 bedrooms, big backyard, two cars, so many friends, maids etc� but when she came here she was living in Single bedroom, No backyard, No Car at that time & no friends sadly. The answer to her daughter question can be given in two ways, 1) no baby we are richer than before as we now have more bank balance or 2) give her a good quality life style which you can afford & that means nice community, friends, decent house etc what ever makes you & your family happy. ( it is also possible in rented community ) but again that�s what I meant by choosing their own lifestyle.


    Finally I did not buy a house because of material benefit, ego, equity etc. Home Owners should be ashamed if they don�t have proper justification on why they bought the house in first place & I know deep in my heart that I did nothing wrong & I am still & always be happy as long as I am in my own house.

    For your PD and EB category, you are able to enjoy 4 years of AOS benefits just because of IV. You will soon get your GC, only because of IVs continuous fight with CIS.. But hey you won't see it because it all happens behind the scene and someone else is picking your tab...

    Such people come running to IV if they get a denial/ NOID and lose hope. Rt. now they are busy tracking their cases, predicting and hoping to be current in a month or two. People who feel the pain of retrogression value what we do for them.

    i don't get it you are saying that members don't have to search...and yet someone has to keep it up on the home page...which is it? yes a sticky thread would have saved work and not required someone to keep it up. Why wasn't it done in the first place. When a service is supposed to be offered every week...it should be offered every week...or else there should be an announcement that is will not be offered this particular week and that it will continue next on said week.

    No reason to be frustrated when people are asking simple questions...another idea would be to put the answers to the most frequently asked questions on the FAQ page...which does not work right now....so that you don't have to repeat the answers.
    Its an easy solution i think.

    Giving a long lecture of frustration is not the best way to attract people to an organisation.
    Think about it...do u go buy clothes from a store that voices their frustrations about the prices of raw material...of do u go buy it because they were nice to you...had great customer service...nice selection of goods...and fair prices.

    I am sorry but working for hours on end alone, voicing frustration at lack of participation, treating members like they are morons for not being able to find supposedly simple things is a really terrible way to attract more people to an organisation. The cause may be noble...but who will wanna join some organisation where people just complain about how miserable things are.

    Please pause for a moment and think about what i am saying. This is exactly why you have less participation and less donation. IV needs to transform into a vibrant fun place to be while still upholding the noble cause.
    This is just unbelievable nitpicking. Completely unproductive.

    A "grassroots" organization like IV is what its members come to the table with - making it fun etc. is also dependent on the members - not some specific, designated individuals.

    Alright guys, I cannot tell you how excited I am to report that i got a call this morning from my attorney and my online case status also states that Card Production was ordered for my case!!!

    After 8 long years.....i finally have been approved for permanent residency. After 7 years, i will finally, with peace of mind, go back to India to visit my family. Thanks to IV, everyone's help on these forums for helping me keep my sanity over the past 2 years....

    After 15 years in the US, I will finally have my green card in hand soon.
