BharatPremi, do you know if one can have both 485 and CP processes simultaneously?
SIMULTANEOUSLY you can't have both. Either AOS or CP. One can covert one from another but it introduces enormous delay. AOS-to-CP atleast 1 year more delay and for CP-to-AOS at least 3 to 6 months delay.

Yupp, we have to go through CP in Montreal. Our PD is Feb/2006. We hope to be current this year ! There seems to be some hope ?????

Hi!
My friend (in the US, on J1, no HRR) has been offered a position with a Non profit organization. They do not have experience with H1b process and want her to tell them about the process, and how she can work here legally (starting June).
I understand that she will not fall under the quota and does not have to wait till Oct 1st. Can someone please provide information (some links) on the following:
1) Can one do premium processing for H1b (first time for her), even though it is a non profit organization? Or is premium processing only for cases that fall under the cap?
2) I noticed that the fee is:
- 190 for application
- 500 for fraud security
- 750 or 1500 depending on whether there are 25 or more employees
- $1000 premium processsing
- $$$ for the lawyer to prepare and file the petition
Is it required by law that all the application fees be paid by the Employer, or can it also be paid by the beneficiary? I understand that the permium processing fee can be paid by the beneficiary, and perhaps the lawyer fees too.
3) Does the employer need to get any certifications/approvals from the Labor department before filing for H1B?
4) Can the entire process by done online?
I will really appreciate it someone could help with answers to these questions.

02/02/2007: What Did Senator Kerry Immigration Reform Bill Mean to EB Immigrants?
In highsight, the failure of the Kerry Amendment to H.R.2 to pass the Senate could be considered a relief to the EB immigrants. Review of the immigration reform bill in the H.R. will establish that the bill proposed for the employment-based immigration system practically nothing other than increasing the annual quota to 290,000. None of the provisons in the SKIL bill was reflected in the bill, including exemption of the spouses and children from from the numerical limitations, exemption of certain EB groups from the annual numerical limits, opportunity for filing I-485/765/131 for the I-140 beneficiary during the visa number retrogression, etc. etc. etc.! Had this been enacted, it would have affected the upcoming CIR bill or special legislation for Employment-Based immigration system reform. This reporter was shocked to learn that this bill provided practically no relief for the employment-based imigrants other than farm workers and the children eligible for DREAM Act bill. The bill was extremely imbalanced legislation in a way from the perspectives of the "Comprehensive" Immigration Reform.
We will see whether the Senate leaders will indeed complete and introduce the CIR proposal next month.

If what I have heard is true, your lawyers made it late.
The Visa bulletin came out almost 4 weeks back. You should have hurried the application in. Check with your lawyer to see is there any special ways to get your app in.
What i will say is hurry it now at least.

its common to have delayed approvals for primary and spouse, i wont panic unless its 2-3 months more, however as someone stated you shoudl check with lawyer to expedite if has been delayed
i have seen cases of many folks where spouse got it first and then the primary and vice versa, thats why i called out.

Same here, sent 2 inquires, the response was "you will be contacted as soon as it has been processed". Nothing more for 3 monthes now, or 5 monthes since initial filing.
Same here. My labor was filed on July 07 and Audit reply was sent in August 07. Attorney has contacted DOL twice and got same standard reply. Mine was filed at Chicago though.
I have no idea why Chicago is taking this long for my labor. All of my friends who filed at Chicago after me got theirs certified. I am the only one stuck.

Anyone received payment processing errors in the last couple of days on the E-File website? For some reason, while trying to complete payment for my AP e-file, when I try to use the credit card option, I keep getting an error that the e-filing payment processing server is unable to process payments at this time. I have been trying every hour for the last 2 days...and the stupid USCIS Customer Service number has no options to report this error...
I would send an email or snail mail to the Service center - detailing the problem you encountered with both the payment and with the customer service number. It is always better to have something in a written format to back up your claims.
Hope they fix it! I have to get ready to apply for mine in a month......

Well, if there were preadjudicated cases, which is very very likely, getting ready for September approvals, with VB published weeks ago, should be very routine and simple task. It is quite possible that a lot of approvals should be coming out withint the first few days in September. Best wishes to all waiting, particularly to those wth senior PD's left out last year.

One's life time is too short to determine whether changing citizenship to US citizenship is worth or not. And hence to define it as a "wisdom" or "short sightedness" is also almost impossible. Two school of thoughts can just pop up 1) What would be the gain vis a vis loss changing citizenship 2) why one should get rid of the citizenship where one was born. And both of them are more realted with philosophical and moral issues rather than short term material gain...

I accept what you say. But consider this psychological issue: You lived in a country which is 100% different in every thing for most of the life time and then going back after you think to retire. All your kids are either born or grown up here and they no longer wish to come with you when you want to go to your parent country. Again you will be living alone in another country. Instead, we can get our Citizenship and live atleast near our kids. Further, if you are detached with the wordly things and wish to live alone, it is OK.
One more thing, we have come here wantedly without thinking about the future and at all stages of our life we will be confused. I have seen some people with determined mind. They come at the age of 20 - 25, earn a lot, get married to working women, both of them work here , have kids (US citizens), and they go back to their parent country with good money when the kids become 7 years old and both husband and wife will be in the mid of thier carrier. But it is not the case for majority of the people. Many have come with grown up kids etc., and they can not just like that go back. Necessarily they are bound to be here and atleast for those people, to live without anxiety, I would like to have the citizenship process to happen faster if they live here legally for 10 years.
