Just Thought
There is 200k application without 140 approval, this is including july filers.
there is lot of chnace for those who got their I-140 approved, even their PD '2006.
you can see people getting approved PD'2005 EB2 cases, even then VB says now 2004'apr for EB2.They are not processing based on PD now and in future also i gues.Since we have already filed.PD will restrict only to File I-485 in future.

I am dismayed and sad � and wanted to step up to the plate for our good friend. I hope you will appreciate my spirit.
Guys, this guy is an asset for any team. How many of us know his name�versus others you know? I do not mind going out on a limb for Robinder as a person � all you need to do is read what he writes. Robinder will be the last person to seek any publicity out of this. Let�s get all the help that we need from this very influential and highly networked individual for our current and future print and visual media initiatives from Robinder who genuinely believes in the cause and wants to help IV.

It is nice to see that the senior leadership is taking notice of the 'pain' some of us are going through right now.
Disclosure : I have already received 2 year EAD (thanks to IV). I have taken initiative to bootstrap the effort to help others who haven't been so fortunate. Since we are all in the same boat let us watch each others back for a change, instead of trying to backstab each other at every available opportunity.
This is NOT a yet another case tracker /EAD tracker thread. I don't believe that just tracking stuff will change anything. Be it EAD issue or any other, real world action is needed to solve it.
I have started this thread to guage the impact this issue has had on our community , how many members are affected, what actions have been taken by them, so that next steps can be taken. If a large number of members are impacted IV may decide to take up the issue.
Here are the options available to applicants
1) Call National Customer Service Center and create a Service Request (SR) to expedite the case
2) Fax and mail a letter to Service Center requesting to expedite the case due to possibility of job loss. Since the burden of proof is on the applicant - a letter from the company that EAD is necessary for continuation of job may help.
3) If steps 1 and 2 don't produce the results and CRs refuse to open SRs citing silly reasons, USCIS Ombudsman may be approached.

4) Approach your US Congressmen/women Representative/Senators. Every office has a different form for requesting Immigration help. They can open an inquiry with USCIS on your behalf.

We shouldn't feel embarassed at the question "Did you follow up with all these avenues available to you?". Our answer should be - "Yes. We did all that and it didn't help". And we should be able to produce the proof that we did do all the four steps mentioned above.
If you have done all the four or after you have exhausted all avenues, AND are willing to take it further - speak to the media, participate in possible IV campaign etc., post your details. We need members ready to go public with the issue if we want to succeed.
Right now, I have started this as an individual initiative. But I am sure that IV will get involved once it's proven that a large number are impacted and there are enough members to turn it into a campaign.

as per the law u can switch employers after 180 days from recipt of ur 485 application...unless the CBP wants to give u a hard time...he should not jerk u around on that....

I have seen lots of posts about pre-adjudication..how do we know if any case has been pre-adjudicated or not?...recently i got an RFE on my spouse case for Marriage Certificate and Birth certificate bonafide..there is no RFE on my case and had an FP done on 08/11/2009 second time and noticed soft LUD on my case on the day of FP...dose this means they are working on my case...:confused::confused:

Yes but in Canada you will breathe clean air and drink clean water. You will have electricity 24 hrs a day and water 24 hrs a day. You wont find trash on the street and you wont be considered second class citizen if you arent SC/ST/OBC due to reservations. You woint have to give "donations" to get your kid admitted to Class 1. You wont face a system where a simple court case drags to 50 yrs or a case where doctor will not treat if before police does a "Panchnama" if you had an accident. You wont have to bribe everyone from minucipality to police to start a business.
Canada is already worse than India (atleast for IT sector). Hard to find jobs. Salaries are 75-80% of corresponding US jobs. And Candian $ is also cheaper (though catching up with USD).

makemygc, i think you got a bad dmv officer who did not know anything about 797. When I was in FL i renewed my DL many times showing 797.

What if DMV refuses to renew the license if I-94/H1 is extended for 1 year (mostly in the case of H1 extension beyond 6th year) but is not stamped on your passport. This happened with me. DMV officer insisted on visa stamped on my passport and he was not ready to accept the I-797 form which I was showing. Finally, I've to go to other DMV and count on my luck to get my license renewed.
This is a as much a problem with DMV as a problem with employees. I did not 100% agreed with your comments that it's a problem with an employer. Now a days even filing 6 months prior to expiration is not guranteed to give you a timely approval.

Is it possible to do so ? Can we apply for 2nd EAD application even without first one, and having got the receipt notice for first one ? If yes then this is a good solution, but then who knows how long the 2nd one will take to be approved, making it a worthless effort.
It is possible, but what's the point? It will have later receipt date. It is better to file a lawsuit to force the USCIS to issue EAD. It will cost only $350 :)

Thanks for coming forward to help this cause. Your contribution, words of support and enthusiasm helps everybody to maintain higher level of motivation which is so important for this kind of volunteer effort . Thank You.
We also need more active members in Miami as it is a huge city. Would you like to take up the responsibility to post the flyers in Chinese/Indian/Philipino stores or other places where people from these or other immigrant community gathers? Or maybe simply send out emails to send the same message to your friends. It is ok if there is any constraint.

Are they not supposed to make sure that they have enough senators on their side to pass this bill. Whatever we have won till this point is due to the efforts of core team and people who come to this website using media/campaigns. I have not seen results of any lobbying efforts by this lobbying firm. Am I wrong somewhere ?

Luckysiri, I am sure things will work out for you and your family. You definitely need to expose and name your employer whose sadistic attitude caused so much pain and suffering during these critical months. We need to teach such employers a valuable lesson so that they don't ruin some one else's peace of mind. Good luck.
